Sidney Moorer’s retrial scheduled to begin in August

CONWAY, S.C. (WBTW)- Sidney Moorer’s retrial for kidnapping charges in the Heather Elvis case will happen next month.

According to court documents filed Tuesday, jury selection in the re-trial case begins Monday, August 29 with the trial scheduled to start then upon qualification of the jury panel.

Friday, July 15, 800 Juror Summons and Questionnaires were mailed out. Those questionnaires have to be sent back by Monday, August 15.

Sidney Moorer gets 5 month jail sentence for violating gag order w/video

CONWAY, SC (WBTW) – The hearing to decide whether or not Sidney Moorer violated a gag order placed on his case in March 2014 was held Friday morning.

The hearing began around 10 a.m. and News13’s Lucas Lalonde sat in to hear the judge’s decision. The judge first reviewed the contempt of court charge with Moorer and his attorney Kirk Truslow.

In Friday’s hearing, Moorer acknowledged that he did violate the gag order by doing an interview with WBTW on the second day of his kidnapping trial, June 21.

Former county detective countersues domestic violence victim

Former Horry County Detective Allen Large denies in court documents filed Thursday that he coerced a domestic violence victim into participating in a nude catfight video and is now suing the woman claiming she ruined his reputation and crippled future job prospects.

The woman identified only as Jane Doe 3 who filed the civil lawsuit against Large “has blatantly misrepresented facts in order to abuse the system and obtain some type of money,” said the countersuit filed in the U.S. District Court of South Carolina, Florence Division.

Large’s counterclaim says that he never assaulted or threatened the woman whom he considered a friend, and that he is “shocked and horrified” by her claims.

Former Horry County Police Chief named finalist for chief job in Georgia

STATESBORO, GA (WBTW)- Former Horry County Police Chief Saundra Rhodes has been named a finalist for the job of Statesboro chief of police.

According to the Statesboro Herald, city officials named three finalists for the position.

Rhodes was named Chief of Police in 2012 after working as Sergeant, Lieutenant and Captain.

She retired on May 6, 19 months before she was eligible for retirement. Documents released show that Horry County paid out more than $61,145.37 to the South Carolina Retirement Systems to allow Rhodes to retire early with full benefits.

Criminal defense attorney says moving Moorer trial would be a complicated process (w/video)

CONWAY, SC (WBTW) - Sidney Moorer, the man accused of kidnapping Heather Elvis, is still waiting to see whether or not his retrial will happen in a Conway courtroom.

Just over a month ago, News13 told you Judge Markley Dennis said he was concerned about the fairness of the trial after the community had already seen the evidence in the case.

Criminal defense attorney Stuart Axelrod says in order for Moorer to have a fair trial, the case cannot be tried again by an Horry County jury.

“In this case, the publicity was so strong. I was surprised they even sat a jury in the first place. “The jurors said they could be fair and impartial, they didn’t know anything, but I think every person in the county, I think every squirrel in the county knew what was going on in this case, ” said Axelrod.

Grand jury indicts 4 former Horry police officers; 2 face sexual misconduct charges

A grand jury indicted four former Horry County Police officials late Thursday, including former Detective Allen Large, who is accused in several lawsuits of coercing women to participate in a subgenre of 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬 called catfighting.

The S.C. Attorney General’s office is prosecuting the cases in which Large faces five counts of third-degree criminal sexual conduct and six counts of misconduct in office, which combined carries a maximum jail sentence of 110 years.

The indictments allege that Large knowingly used coercion to engage in sexual battery with multiple victims and knowingly engaged in inappropriate relationships with the victims of cases he was investigating.

Sidney Moorer set to be released from jail on Wednesday

HORRY COUNTY, SC (WMBF) – Sidney Moorer is set to be released from jail on Wednesday following his imprisonment for violating a gag order during his kidnapping trial in the case of missing woman Heather Elvis, according to J. Reuben Long Detention Center Director Tom Fox.

On July 29, a judge sentenced Moorer to five months in jail for breaking the gag order by speaking to a local media outlet on the second day of trial. He was immediately incarcerated following that hearing.

Moorer case moved to Georgetown County

CONWAY, SC (WBTW) – On Wednesday, Judge R Markley Dennis Jr. issued an order granting a change of venue in the case of Sidney Moorer.

According to the order, the venue will be changed from Horry County to Georgetown County and the jury will also be selected from Georgetown County.

Moorer is accused of kidnapping Heather Elvis who disappeared in December 2013 and hasn’t been seen since.

Shots fired outside home of Heather Elvis

Horry County, S.C. (WPDE) — Police are investigating an attempted murder case after a family member of Heather Elvis was shot at near their Horry County home Wednesday night, according to a police report.

Police were called to an address off Sly Fox Trail in the Socastee area in reference to a shooting at around 10 p.m. on Wednesday, Nov. 9. The address is listed as the home of the Elvis family.

The victim, whose name is redacted from the report but is listed as "he," told police he was taking out his trash and heard popping sounds when he reached the end of his driveway.

State files motion to reconsider moving Moorer trial to Georgetown County

CONWAY, SC (WBTW) – The 15th Judicial Circuit Solicitor’s Office has filed a request for a change of venue in the Sidney Moorer trial.

According to court documents, Deputy Solicitor Nancy Livesay filed the motion on Nov. 10, just one day after Judge Markley Dennis issued an order to move the second trial against Moorer to Georgetown County.

According to the order, the venue was changed on Nov. 9 from Horry County to Georgetown County and the jury will also be selected from Georgetown County. There’s no word as to when the judge will make his decision.
 
Prosecutors, defense spar over Moorer trial location

Prosecutors don’t want Sidney Moorer’s kidnapping trial moved to Georgetown County, but they may not have a choice.

Following Judge Markley Dennis’ decision to move Moorer’s retrial from Horry County to Georgetown County, the state filed a motion on Thursday asking Dennis to reconsider his decision to change venues. Moorer is charged in connection with the 2013 disappearance of Heather Elvis.

“The state does hereby ask for a hearing to be scheduled where the state will request the court to reconsider its prior order changing venue,” the motion stated. “The state will submit only to the court and defense a memorandum prior to the scheduled hearing in order to comply with the gag order.”

Family of Heather Elvis speaks about change of venue in kidnapping case trial

MYRTLE BEACH, SC (WBTW) – The family of Heather Elvis held a press conference Friday to discuss their feelings on the change in venue for the trial in their daughter’s kidnapping case.

Ms. Elvis went missing in December of 2013, police say she is presumed dead.

Sidney Moorer is accused of kidnapping Ms. Elvis. He faced a Horry County jury in June of this year, but the judge declared a mistrial after the jury was deadlocked. A new trial is set for next year in Georgetown County.

Lawsuit alleging sex assault by former HCPD detective scheduled for trial

CONWAY, SC (WMBF) - A lawsuit against Horry County and the Horry County Police Department has been scheduled for trial later this month.

According to a December 2015 lawsuit, a woman identified as Jane Doe called HCPD in 2013 to report a sexual assault. The lawsuit states the detective assigned to her case, who has been identified as former Police Detective Allen Large, insisted on meeting at her home the following month. It goes on to say, he sexually assaulted her and she was unable to resist the unwanted advances out of fear of retribution. In the lawsuit she claims she was caused mental anguish, pain and suffering and permanent impairment.

The federal lawsuit is also against Horry County and Horry County Police Department, as well as Former Police Chief Saundra Rhodes, Scott Rutherford, Thomas Delpercio, William Squires, and Dale Buchanan, who were Large's supervisors at the time. The attorney for these employees responded to the lawsuit today denying the claims.
