"To many on the island of Oahu, Hailey Kai Dandurand is a glowering figure in baby blue jail clothes, half of a duo accused of one of the more brutal and high-profile killings in Hawaii in recent history.

The Bend native, and her ex-boyfriend Stephen Brown, are charged with killing Telma Boinville at a North Shore holiday home in late 2017. But as the trial date keeps getting pushed back, Dandurand’s defense is trying to have them tried separately, arguing she wasn’t an equal party to the killing and is in fact another victim of her co-defendant, Brown, who has a documented history of violent and coercive relationships with women."

"I was sleeping,” Dandurand wrote in her petition. “He wanted me to wake up. So he slapped me in my face about maybe 15 times."

Did An Abusive Relationship Lead To A Young Woman's Involvement In A North Shore Murder?

Feb. 28, 2021

Before she became the co-defendant in one of Hawaii’s highest profile murder cases in recent memory, Hailey Dandurand was pursuing a liberal arts degree at Kapiolani Community College after relocating to Oahu in early 2017 from her native Oregon.

In August 2017, she met and started dating 23-year-old Stephen Brown. The relationship soon turned abusive, according to court documents.

Dandurand has said that she suffered repeated attacks by her former boyfriend in the three months leading up to the gruesome and apparently random killing of a 51-year-old Sunset Elementary School substitute teacher — a crime for which they have both been charged.

Now, with trial set to begin Aug. 9, the state has agreed not to oppose defense efforts to have the two tried separately.

Dandurand’s defense attorney Barry Sooalo says Dandurand was under the influence of Brown’s abuse at the time of Boinville’s death and did not willingly participate in the alleged murder and kidnapping.

Trial for 2017 North Shore murder moves forward

The murder trial for Stephen Brown and Hailey Dandurand moved forward on Friday, March 5, with the suspects being tried together rather than at separate trials.

The court said the charges against the suspects are connected and involve the same pieces of evidence.

Friday’s hearing also took up the matter of whether to allow testimony for the victim’s daughter.

Dandurand’s defense attorney Barry So’Oalo says Dandurand was under the influence of Brown’s abuse at the time of Boinville’s death & did not willingly participate in the alleged murder & kidnapping. Last June, a judge granted Dandurand a restraining order that bars Brown from coming within 100 yards of her for the next decade. Last week Deputy Prosecuting Attorney Kyle Dowd filed a motion to withdraw the state’s original opposition to pleas from both defense teams for separate trials, making a joint trial less likely. The issue is set to be discussed at a hearing on Friday, 3/5/21.
3/5/21 Update: Appearances by counsel & defendants. Mr. Breiner also present & made his appearance on behalf of the surviving victim. Court stated the State withdrew its opposition to defenses prejudicial joinder. State confirmed noting they would also prefer separate trials. Mr. Goo presented argument. Mr. So'Oalo submitted his motion & requested the Court grant same. Court says both cases against each involves the same physical pieces of evidence & numerous witnesses & the minor should not have to testify at 2 trials. Severance is not obviously imperative in the interest of Justice. Court concludes that the defendants should be tried jointly. Both motions are denied w/out prejudice. Court will allow victim witness advocate to site in the jury box behind Mr. Dowd re State's motion that the victim witness advocate sit near the witness. Arguments re minor to be competent-Court finds minor to be competent. M.E. (minor) sworn in for testimony. Defense's exhibits were marked & received into evidence. Mr. Goo objected to the media being present at all & presented argument. Court will not allow minor to be filmed during her testimony. Mr. Breiner informed the Court & Counsel that M.E. is very upset & terrified & requested the victim witness advocate be next to her to hold her hand. Mr. Goo again questioned competency. Court agreed with the State noting emotions do not equate to competency & made its findings. Court ordered Mr. So'Oalo not to make any comments to media (that were prejudicial) or he will be sanctioned & reported to ODC. Cross exam of M.E. by Mr. So'Oalo. Court informed that media was waiting outside for extended coverage. State had no objection, but defense objected. Court noted defense’s objection & that application for extended covered filed & granted access. Kevin Emery sworn in for testimony. State's exhibit 1 received into evidence over defendant Dandurand's objection. Cross exam by Mr. Goo. Officer Aaron Eveland sworn in for testimony. Cross exam by Mr. Goo & Mr. So'Oalo. Detective Nguyen sworn in for testimony. Cross exam by Mr. Goo & Mr. So'Oalo. No redirect. Lt. Fujitani sworn in for testimony. ID'ed defendant Brown & Dandurand without mask removal. State's final witness: Corporal Kaawa not present to testify as he has a high fever & not feeling well. Court furthered all motions to 3/31/21 @ 1pm. Counsel had no objection to the continuance.

3/7/21 Update: Judge Rowena Somerville agreed that each case had the same evidence & number of witnesses and did not want to subject Boinville's minor daughter--the only witness to the crime-to testify at two trials. Denying State prosecutor's & Dandurand's counsel of 2 separate trials.

Status conference held in chambers; discussion re trial schedule & expert witnesses; fees still not filed by mr. So'Oalo. President counsel for Dandurand, defendant Brown not present. Court waived Browns' presence for purposes of this hearing. Court stated i was in receipt of the Motion to Compel as well as the supplement & declaration. Mr. Goo had nothing further to add to his motion. Dowd & So'Oalo had nothing further to add. Court stated on 2/21/20 Dandurand filed motion to determin status, stating she was indigent & required the services of Dr. Duke wagner, Dr. Mindy Mechanic, Dr. Robert Geffner & attorney Jill Spector re battered spouse defense. This was 10 months after rown's first Motion to compel was granted & 1 1/2 months after Brown's 2nd motion to compel was filed requesting same documents. On the same day, the 12th division returned same motions to Mr. So'Oalo instructing him to add each experts breakdown of their estimated time/cost & a statement as to why their testimony was necessary. As of this morning, Mr. So'Oalo has failed to follow up with the 12th division re his ex parte motions for litigation expenses for the expert witnesses. The court, hereby, grants the motion & clarified the material & infomation disclosure deadline of 6/11/21 includes any expert reports, opinions, findings, witnesses, discovery & documents. Court informed counsel that if these items are not turned over by that date, sanctions will be considered & the preclusion of evidence. *Motions Hearing for both (@ 8:30am Hawaiian-Aleutian Time) - HI - Telma Boinville (51) (Dec. 6, 2017, Oahu) – *Stephen Brown (23/now 26) & *Hailey Kai Dandurand (20/now 23) arrested (12/13/17), charged & arraigned (12/18/17) with 2nd degree murder, 2 counts kidnapping & 1st degree burglary. Both plead not guilty. SB bail $1M, KD bail $500K. Bond reduction denied for HD (8/25/20).
Telma’s 8 yr. old daughter was found bound & gagged with duct tape.
Trial set to begin for both on 8/9/21 (thru 8/30/21)

5/6/21 Update: Next status conference hearing on 6/18/21 @ 1:30pm. 5/13/21 Update: Prosecutions Motion to compel fingerprint exemplars & allow law enforcement to photograph defendant Brown & Dandurand. 5/24/21: Granting defendant Brown's motion to compel. 6/4/21 Update: Case was called & appearances by DPA Kyle Dowd, CA Nelson Goo, attorney Barry So’Oalo & defendant Dandurand. Defendant Brown not present. Mr. Goo explained why. Court waived defendant Brown's presence for purposes of this hearing. State streamlined motion & nothing further to add. Mr. Goo objected & presented argument. Mr. So'Oalo joined in Mr. Goo's argument. Mr. Goo raised prior motion to suppress re fingerprints on Louvers. State presented argument. Court inquired how the process would be streamlined. State explained reasoning. Court noted duplicative & denied motions. Mr. Goo to prepare orders. Attorneys Dowd & So'Oalo waived signature. Mr. So'Oalo updated the court that reports being turned on 6/9 & will turn over to counsel on 6/10. Mr. Goo noted possible discovery re medical. State informed counsel of records of prior medical examiner (Dr. Happy), updated the court & possible motion to compel to be filed to obtain such records. If that's the case, motion to compel will be heard 7/9/21 at 8:30am & RSDT hearing on 7/23/21. Mr. Goo stated motion to sever needs to be revisited once the documents are received & noted client needs more time. Court reminded counsel of status conference hearing on 6/18/21 will be via telephone.
6/18/21 Update: Status conference was held. Court received Motion to Compel will be at motions hearing on 7/9/21. Phase 2 pending report that will be produced. Trial on 8/9/21 will probably be continued.
