*Motions Hearing for both (@ 1:30pm Hawaiian-Aleutian Time) - HI - Telma Boinville (51) (Dec. 6, 2017, Oahu) – *Stephen Brown (23/now 27) & *Hailey Kai Dandurand (20/now 24) arrested (12/13/17), charged & arraigned (12/18/17) with 2nd degree murder, 2 counts kidnapping & 1st degree burglary. Both plead not guilty. SB bail $1M, KD bail $500K. Bond reduction denied for HD (8/25/20).
Telma’s 8 yr. old daughter was found bound & gagged with duct tape.
Trial was set to begin for both on 10/3/22 & was continued to 1/2/23.

8/31/22 Update: Brown’s new attorney, William Bagasol asked the judge to delay the trial so he could adequately prepare. First Circuit Court Judge Rowena Somerville said she was granting the continuance based on Bagasol’s request for transcripts along with the court’s schedule. “I am going to grant the continuance, but I’m going to continue it to January,” Somerville said. During Thursday’s hearing, the judge also considered motions to dismiss comments the co-defendants made during their arrests. The defense claims they’re inadmissible because Brown & Dandurand were not read their rights. Deputy Prosecuting Attorney Scott Bell prosecutor questioned six of the police officers involved in the arrest of the defendants. All six of the officers who testified under oath said they did not ask Brown or Dandurand any questions, both made those comments on their own and were unprovoked. The judge is expected to rule on the matter Tuesday, 9/6/22 when the hearing continues. Somerville is also expected to address Brown’s request for a separate trial. If granted, Chin said it’s likely the trial date will get delayed again. Calendar Call hearing on 9/20 @ 8:30am & 10/28/22 @ 1pm & trial will begin on 1/2/23.

8/31/22 Update: #516: Appearances were entered by counsel & defendant Dandurand in custody, defendant Brown not present. Mr. Bagsol stated he was unable to contact defendant but left a message with the module to return his call. Court stated defendant Brown refused transport. Court also noted that defendant Brown refused transport on 6/4/21 & inquired if Mr. Bagasol was willing to waive his presence & proceed today. Mr. Bagasol replied that he did not have the authority to do so. State objected to any continuance noting he was ready to proceed on all matters & informed the Court & counsel that he had secured travel arrangements for a mainland witness who is scheduled to leave tomorrow. State further noted that defendant Brown had notice of today's hearing & presented argument. Re Rule 43, Mr. Bagasol stated not enough to comply with to proceed without defendant Brown. Court state it needs to make a record that defendant is purposely absenting himself & Mr. Bagasol was given the opportunity to contact him. Wednesday marks the fifth anniversary of the North Shore slaying of 51-year-old Telma Boinville, whose 8-year-old daughter was found bound and her mouth duct-taped upstairs at a Pupukea house, while her mother was viciously beaten and stabbed to death downstairs.

Accused killer Stephen Brown, 23 at the time of the crimes, will stand trial Jan. 3 at age 28 without his alleged accomplice, 25-year-old ex-girlfriend Hailey Dandu rand, then 20.

Oahu Circuit Judge Rowena Somerville ordered Oct. 31 that the defendants be tried separately—this after the court having denied for years both defendants' numerous motions to sever.

Brown's court-appointed attorney, William Bagasol, asked the court a number of times for severance, asserting that it would be unfairly prejudicial to his client if he went to trial with Dandurand since she intends to pursue defenses of battered spouse and post-traumatic stress disorder.

They were both being held and continue to be held at the Oahu Community Correctional Center, unable to post bail—Brown, $1 million ; Dandurand, $500, 000. A no-contact order was part of the conditions of bail.

The state had also repeatedly objected to the severance.

But Deputy Prosecutor Scott Bell agreed to separate trials of Brown and Dandurand, stating in an Oct. 17 court document that the state intends to introduce an alleged statement that Brown made to a minor witness that incriminates Dandurand, so a joinder is no longer defensible.

According to court minutes, the court granted the severance based on the state's statement that it agreed to it.

Trial for Dandurand has not yet been scheduled.

HONOLULU (HawaiiNewsNow) - Prosecutors said Stephen Brown and Hailey Dandurand used a bat, knives and a machete in the brutal killing of a Haleiwa woman in 2017.

In a hearing on Wednesday, prosecutors described some of the weapons the duo used to kill Telma Boinville while she was cleaning a vacation rental home in Pupukea.

“Three throwing knives... a machete,” said Deputy Prosecutor Scott Bell.

Bell added the duo also used a baseball bat.

“The bat is in close proximity,” Bell said. “The deceased had injuries consistent with blunt force trauma.”

Prosecutors also submitted video of Brown allegedly licking blood from his hand and another video of Brown telling police officers to shoot him after they arrested him at a Mililani shopping center.

Prosecutors presented a substantial amount of evidence that Brown’s lawyer asked Wednesday’s hearing on admissible evidence be heard in secret.

However, Circuit Judge Rowena Somerville rejected the request for a secret hearing and admitted nearly all of the evidence submitted by prosecutors for the next trial.

Brown is scheduled to go to trial next month. [on 1/2/23].


Do not know what is happened with Dandurand's case - nothing updated in the court site for her. But on the docket it does have a calendar call hearing on 12/28/22 - so I will put her there for the time being.

1/3/23 Tuesday, Day 1: #684: Court convened without prospective jurors present. Case called & appearances were entered by counsel & defendant Brown in custody. Court state it was in receipt of the motion to continue as well as State's memo in opposition. Defense incorporated its prior argument, additional brief argument presented & requested the Court to reserve ruling on Dr. Blinder if he completes his report. State incorporated its earlier argument on 12/29/22 as well as in its memo in opposition & requested the Court to deny the motion. Court made its findings, noted its limited order filed re Dr. Blinder & stood but its ruling & denied the motion. State to prepare order. Defense waived signature. Re: Defense's 2nd motion for leave. Jury selection for Brown’s trial began Tuesday in Circuit Court. The prosecutor’s office said they expect the process to last through this week, with opening statements to begin Monday. But former Attorney General Doug Chin said jury selection may take longer.
