i hope I do not have too many duplications:
Always include first names of defendants.
Always indicate if Federal or State Charges-dates,courthouse(Decatur or Henderson)Who is the judge,attorney,prosecution,witnesses.search warrants
Is this the first hearing?What is the hearing purpose? i.e.Is this the initial hearing to determine if there is enough evidence to go to the Grand jury? When is the next court date?(has it been rescheduled,why,or for what reason)
Where is the defendant?in jail?
Current location-charges(multi both Federal & State charges)
Next court date-charges
Have there been charges dropped,can they been refiled, date?Why



I found it helpful to have in my notes that Dylan Adams had testified (MNS link)before the grand jury prior to Zack Adams arrest. So if there is a link indicating grand jury activity( I note it)Grand Jury activity is difficult to keep track of ;I understand it is intended to be that way. MOO

In this day and age why are they not taping these conversations and documenting them? I cannot count the number of convictions that have been overturned and set aside from false confessions just this year. The Ryan Ferguson case in MO is a prime example. He has filed a $100M case against the city and each LE investigator that coerced a confession from a co-defendant. IMO all interrogations should be recorded, both audio and visual. Both for evidentiary value and documentation that no coercion took place. And especially in this case with Dylan where LE knows full well his challenged IQ is being thrown around.

I do not know for sure it was not recorded. Yet MSM articles state that one special agent overheard Dylan making statements to another agent. As in that is the evidence used in securing the GJ indictments. In the case I cited earlier (Ferguson) detectives spoon fed information to a defendant to get a confession. When the "confession" was shown to the Jury at trial, they were shown an "edited" version that only shows the confession and not the coaching part. Long story short both convicted. One overturned nearly 10 years later. The other still in jail waiting for retrial. Don't want to see that happen in this case.

I think that a lot can be read from the fact that LE talked with the Bobos before dropping the charges. Some may not agree with me but I think that the only reason the Bobos would agree with this is because LE convinced them that it would be more beneficial to cut a deal with Mark (the deal of dropping the charges) in exchange for valuable testimony to nail the ones charged with kidnapping and murder. The Bobos agreed; that says a lot.

Those particular charges were statutory, the Bobo's opinion was irrelevant. They would not get to decide if the charges should be dropped or remain. The prosecutor might have informed them, but in no way was he seeking their approval. The real reason the charges were dropped was because he knew they would get tossed for lack of evidence, and if that happened he would not be able to refile if evidence subsequently turned up.

By dropping the charges before they were dismissed by a judge, he could keep the door open for a later date if any evidence to support the charges materialized.

Normally if something is a recorded the investigator will say something to the effect of "X informed me that bla bla bla" in their affidavit. The recording would serve as corroboration for what the investigator alleged. In this case the corroboration came from another investigator listening to the exchange, which implies that no recording was being done. That is probably the reason it was phrased that way. The lack of a recording is likely the real the reason those charges were dropped, since they had nothing else to corroborate what was being allegedly being told to them.

Dylan Adams Set For Court Hearing Wednesday

Dylan Adams was set to be in court to face rape charges. Agents with the Tennessee Bureau of Investigation said Dylan Adams admitted he was involved in the forcible rape of Bobo on April 13, 2011, the day she went missing from her family's home in Darden.

Also received an email from Vinelink this morning saying DA has been moved and is out of custody (court). Not sure why the article says Dylan was set for court as he does have court today. Typo.

Dylan Adams is still scheduled to appear in Circuit Court in Decaturville on Wednesday at 9 a.m. before Circuit Court Judge C. Creed McGinley for his initial appearance on the two counts of rape.

I have not seen any updates on today's court appearance and do not know IF it will be live-streamed.

That bond seems kind of low considering the crime accused. I wonder if locals could chime in on whether that is low for the area. Where I live a family member's attacker received 1/2 million bond.

My opinions only, no facts here:

My read is that the system generally works this way: after receiving a confession in the interrogation room, the authorities pursue a Grand Jury indictment, followed by a formal court appearance where the suspect (hopefully) pleads Guilty at arraignment.

But, if the suspect shows up in court at arraignment and now pleads Not Guilty, then we will be back to where we started.


BBM: And that is exactly what happened this morning at Dylan's hearing on the 2 counts of rape: DA pleaded NOT Guilty to rape !

That is a low bond amount. As low as $2500 (10%) could bond him out.
