Anyway ... I am a little behind on the outline but it's coming along: The "circus" started in Arizona yesterday -- the penalty phase re-trial for Jodi Arias.

Back to Holly's case ... How do you admit you are guilty of rape and then you have your initial court appearance and boom -- plead NOT GUILTY ?

Did Dylan actually confess? That's what LE has been telling the public, but if so, they should have a signed statement to that effect, detailing the particulars he was confessing to.

Maybe all they have is an allegation - neither on tape or in writing - that he said something self-incriminating to the cops. I recall the odd wording in which his alleged self-incriminating "tampering" statements were said to have been overheard by one cop as he talked to the other, which is a fairly bizarre type of accusation (since it raises the question as to why the cop in the conversation wasn't the one swearing to the details). If this is more of the same, it would change the entire tenor of the supposed confession and perhaps even its admissibility.

At every turn, this whole case has been odd, making it hard to trust that what we see is what is real.

Well, according to TBI, Dylan "confessed to rape" as well as he was charged with 2 counts of rape according to the indictment in the Decatur County Circuit Court.

The Tennessee Bureau of Investigation announced that John Dylan Adams, 26, was indicted on the charges this morning [10-14-14] by a special Decatur County Grand Jury. The news release said that on Sept. 17, "Adams admitted to TBI agents that he was involved in the forcible rape of Holly Bobo on April 13, 2011, at the address of 235 Adams Lane in Holladay, TN, in Decatur County."

The charges against the younger Adams brother both come from alleged confessions to the TBI, after Adams had previously been detained in federal custody on gun charges. The younger Adams brother's name came into the news early on after the arrest of his brother

As to what is "real" :

- The Adams property was searched 3 times.

- The perps that have been charged so far, ZA/JA/DA/SA/MP, are all CAREER CRIMINALS.

- An "immunity deal" was/may still be on the table for SA ... no doubt, he told LE "something."

- Holly's "skull" was found but it is "unknown" as to what other remains were found.

Just a few ... no doubt there's more ...

That's my point. There's a sizable difference between allegations that "he said" something or other, and an actual confession where someone breaks down, admits they did such-and-such, and it's documented on tape and in writing with his signature at the bottom.

LE had been painting this as a situation where they have an actual confession, but the "not guilty" plea would seem to indicate that it's not exactly that. It remains to be seen what (if anything) they have to validate a "confession" was made.

I am not terribly concerned that a not guilty plea indicates a false or coerced confession. A family member was recently brutally assaulted and her attacker confessed to her crime when picked up for another similar crime. He just plead not guilty in his prelim hearing on the 20th. It is SOP for defenders, even in instances where perp has confessed, to still plead not guilty for their clients.

Lots of stuff concerns me about this case thus far, but the not guilty plea from DA is not one of them.

The TBI has threatened to arrest SA for months now and they have yet to revoke his immunity agreement. This is because he was unable to lead them to, or show them on a map where Holly's remains were. If the body was moved to a secondary location (or even third) then SA thought he was telling the truth. But jumping thought to thought, I feel SA had a very large part in Holly abduction and/or murder. The girl (I cant remember her name??) that double dated with Holly at the coon hunt stated that she saw a man in glasses resembling SA. He was supposedly staring at Holly and speaking on the phone. The TBI knows this IMO and they need him to be their witness because I feel he knows A LOT of what went on that day in April. (however he most likely will be ripped to shreds on cross.) This is all JMO and pure speculation.

I take it this refers only to Bobo rape charges against DA, and not to the charges for murder and kidnapping against ZA and JA.

It's not all that uncommon really. Even if a full confession, recorded, videotaped, transcribed and signed before a notary, it is still just one piece of evidence. Confessions can be and are challenged by defense attorneys as either being coerced (don't think coerced as in beaten until they confess, coerced has a different meaning here). Given the fact that he supposedly has some mental deficiencies supposedly, that arguably could make him even more susceptible to being coerced by LE. I don't know if that's the case here. Just an explanation on how one could admit guilt but still plead not guilty.
