Thanks! Even though I think motive was established in Casey's case , it clearly shows how important the jury takes these unanswered questions seriously when it comes down to making their decision.

I agree that juries want the whole story laid out for them if the prosecuters know it. The whole "Closing Arguments" is where the prosecuters will usually try to give the story of what, how, and why things happened if they know it.

They should only do that if they really know for sure though because sometimes it seems like closing arguments have some theories in them and I think that can lose a case for prosecuters when they go too far out on a limb with their theories of why things happened. Sometimes its best to just stick to what they have proven and leave it be at that.

IMO, the Jodi Arias trial prosecuter went a little too far out on a limb with certain specifics that were uneccessary like the timing of when he was shot.

It didnt matter when he was shot because she stabbed him so much anyway. The timing of the shot became a big rigamaroo and IMO the prosecuter could have just not tried to say when it exactly happened.
Things like that they need to be careful with.

Dont get me wrong. I love Juan though and cant wait for the sentencing re-try of Jodi. :)

The state may have a good argument about the jurisdiction of this particular type of court and also whether any testimony could affect the upcoming trial.

I dont know how they get around the testimony aspect of this and I did wonder if the lawyer filed in the wrong type of court. This sure is interesting.

The use of the term "buyers remorse" to me implies the suspect may be more involved than the state realized when they made the deal. What other reason would there be buyers remorse unless the perp was much more involved.

I tend to disagree. It's a case of conflicting "rights" and I think the right of the potential defendant is a much higher priority here.

If the state is inconvenienced, that's their own fault. No one forced them to make a deal. But they did.

I understand the state's right/desire to be able to keep their evidence close to the vest, but (a) they have to disclose it to the defendants anyhow, pre-trial, by law, and (b) imo once the deal is made, it's a contract, and the one granted immunity has the right to what he bargained for and to protection from self-incrimination, absent any actual proof that he violated the deal.

In the Sierra Lamar case the DA is going for the DP without a body. Everyone is concerned that there will be enough evidence for a conviction.

I'm not at all concerned, goldenbear.:)

In fact it reassures me even more now that they are asking for the death penalty against Torres. IMO, they know proof positive they can prove BARD he kidnapped and murdered Sierra.

I immediately felt the DA had irrefutable evidence showing she had been murdered and that is why Torres was quickly arrested and charged.

A court hearing is under way Tuesday in a dispute about an immunity agreement in the case of a Tennessee nursing student who disappeared three years ago.

In court Tuesday, prosecutors argued that Chancery Court cannot stop criminal charges from being brought against Austin. His attorney argued that the state has not stayed true to their word in the immunity agreement.

Court's ruling that it lacks jurisdiction leaves lots of questions unanswered on this. Interesting and frustrating at the same time.
