GUILTY IA - ‘Bachelor’ Chris Soules Arrested Following Deadly Crash, April 2017

 • #41
I wonder if they are only mentioning alcohol containers because Chris refused to do a breathalyzer. I would think that if he took the test, they would be pretty clear on whether or not he was, in fact, intoxicated.

Does anyone know how this works? I assume you can refuse to take sobriety tests, right?

From the video of the hearing I just posted it took LE a few hours to get him.

They never had a chance to get one in a sufficient time?

A bit of a clearer picture come out now.

'Bachelor' star Chris Soules charged in deadly Iowa crash

 • By RYAN J. FOLEY, ASSOCIATED PRESS
IOWA CITY, Iowa — Apr 25, 2017, 4:55 PM ET

................

Soules wasn't injured in the accident and left the area before emergency responders arrived, the Buchanan County Sheriff's Office said. He was arrested later at his home in Arlington, which is about 10 miles (16 kilometers) north of Aurora and 75 miles (120 kilometers) north of Iowa City.

....................

Soules, 35, was arrested about five hours after the crash and then booked into the Buchanan County Jail on a charge of leaving the scene of a fatal accident, which carries a penalty of up to five years in prison. He was released around midday on $10,000 bond, and will be required to surrender his passport and wear an electronic monitoring ankle bracelet until his trial, jail officials said.

....................

Soules' lawyers, Sean and Molly Spellman, didn't immediately reply to messages seeking comment. His spokesman, Stan Rosenfield, issued a statement saying Soules "was devastated" to learn that Mosher died.
"His thoughts and prayers are with Mr. Mosher's family," said Rosenfield, who declined to comment further.

I am shocked and disappointed. I watched him on both The Bachelor and Dancing. I adored his family. I know they are broken hearted over this recent turn of events.

Are the only charges filed as fleeing the scene of an accident? His vehicle plowed into the rear of another vehicle causing the death of that driver. I foresee manslaughter charges being filed. jmho

I'm still in awe myself over this whole thing. I watched him on everything, Bachelorette, Bachelor, BIP, DWTS and been keeping tabs on since.

I know a lot of the BachelorNation cast drinks and parties their fair share. He just had given me the vibe that he had been doing well and perhaps wised up a bit. Guess maybe not? Then to leave the scene and what followed afterward? Not how I would have expected him to handle things. Very sad for both families.

It will be interesting to see how this develops so far I'm just :jawdrop:

Quote button acting funny again...... No doubt he wanted to sober up. I should have used the word legitimate instead of logical, because there was no reason for him to leave. There is no way he wasn't drinking. I wonder where he was at for 5 hours.

If he was drinking, he might've wanted to sober up.

'Sad deal all around': Chris Soules' Iowa hometown reacts to fatal crash'

Chris Soules was a farmer in rural northeast Iowa before his sisters submitted an application for him to appear on ABC’s reality dating show “The Bachelorette,” rocketing the quiet Iowan to fame.

In the years since his 2014 TV debut, Soules has kept himself in the public eye by appearing on multiple reality shows as well as hosting local events and speaking at agriculture-related conventions.

For the most part, he seemed to side-step the problematic headlines other reality stars have been known to court.

But that changed Tuesday when Soules was charged in connection to a fatal crash between a pickup truck and a tractor Monday evening. Local authorities allege Soules was driving the pickup truck and left the scene after the crash.

......................

“It’s a sad deal all the way around,” said Mary Jo Brown, Arlington’s city clerk. “It’s a tragic accident and I feel bad for the family that lost someone last night and also for Chris and his family.”Arlington mayor Dan Handel echoed Brown’s sentiment: “It’s just very sad news because I knew the guy that got killed. He was a local farmer and a very good person. He was definitely someone who would be willing to help you with anything if you were in need.”

"It’s just pretty devastating to have this happen in our area, in our town.”

I hope people learn from this. I don't condone drinking and driving at ALL. And I've never lived in a rural area. But I can imagine one thinking they could have a few drinks and drive, since it's just a bunch of back roads or whatever. I don't think most people who use this kind of "logic" think they might kill someone.

This is really sad. He should definitely pay the consequences for his actions.

Well according to what I've read for at least 2 of those he was hiding in the house while they obtained the Warrant?

Does that mean it took them 3 hours to find him? That part is not clear to me yet.

EXCLUSIVE: Driver Killed in Car Crash Involving Chris Soules Remembered as a Great Family Man

A local resident of Aurora, Iowa, who knew both Chris Soules and victim Kenneth Mosher, is speaking out about the tragic fatal car crash that occurred in their town on Monday night.

The former Bachelor star was taken into police custody after he fled the scene of a car collision that resulted in Mosher's death. According to the local resident, who did not wish to be identified, Soules and Mosher "knew each other," but "didn't run in the same social circle."

"Their families have been farming in this area for several generations. Both families have always lived around here," the source told ET on Tuesday. "Kenny's 66 [years old], Chris is the age of [Kenny's] kids. They were farm neighbors [their farming land adjoined]. Not door-to-door neighbors."

Since news broke, the small town, which has an estimated population of 171 as of 2015, according to the United States Census Bureau, has been shaken up by the accident.

"We're doing OK. It's a difficult situation here. Very difficult," the source shared. "The mood here is pretty somber. This doesn't happen every day. It's a rare occurrence. It's a very tragic loss."

...............

The resident tells ET that it wasn't unusual for Mosher to be out on a tractor that late at night, as it's corn-planting season right now.
"They're out there planting corn. He had a patch of land north of town," the resident explained. "[Kenny] farmed till dark. That’s a regular farm road. It’s not unusual for farmers to be out on the road at eight o’clock as it starts getting dark. That’s when [the farmers] go home. They work all day."

"He loved farming. He was a wonderful grandpa. Great guy," the resident added of Mosher's passion and character.

..................

Soules -- who is from Arlington, Iowa -- was released from jail Tuesday afternoon on $10,000 bail, which was posted by his mother, Linda. He is now required to check in with a probation officer regarding his ankle bracelet monitor, and was asked to turn in his passport. The reality star, who also appeared on Dancing With the Stars, was scheduled to film something out of the country that was Bachelor related.

Hiding in a house. Coward. I sure wish a verified attorney would chime in here. It's pretty obvious he hid because he was intoxicated, but how does that work out for the legal ramifications? Did he submit a blood test later? Can they determine how intoxicated he might have been at the time of the accident? Was the alcohol in the vehicle in an open or closed container? So many questions...... Seems like the current charges are pretty mild for an accident that that killed someone.

Former Bachelor Chris Soules Allegedly Had Alcohol in His Car and Refused to Leave His House After Deadly Crash: Authorities

..............

"Court documents obtained by PEOPLE confirm that Soules was allegedly in possession of alcoholic beverages and containers. (A rep for Soules did not immediately respond to PEOPLE’s request for comment on these specific allegations.)The Iowa State Patrol claims Soules took off after rear-ending his pickup truck into a tractor near Aurora at around 8 p.m. on Monday. (The area is reportedly about 15 miles south of Soules’ farm in Arlington.)

Both the truck and the tractor were driven into a ditch, resulting in the death of the tractor driver, who has been identified as Kenneth Mosher, 66, of Aurora.
The Iowa State Sate Patrol alleges that Soules fled the scene. His vehicle was later found at a home that he was present at, and Soules allegedly refused to leave the house until officers obtained a search warrant several hours later.

“Mr. Soules would not come out of the home. It took hours to get a search warrant to retrieve Mr. Soules from inside of that house in order to continue the investigation. That took hours,” the state prosecutor said in court. “At no point did Mr. Soules come out of the house, or cooperate with law enforcement at any point in trying to get in contact with him regarding this individual and the [fatal] accident.”

Chris Soules Spoke of Lonely Post-Bachelor Life a Month Before His Arrest in Deadly Car Crash

Bachelor alum Chris Soules spoke to PEOPLE about his single life after reality TV just one month before being arrested in Iowa after allegedly leaving the scene of a fatal car accident that left one individual dead.

Soules, 35, starred on season 19 of The Bachelor in 2015, but he and his final pick Whitney Bischoff broke off their engagement in May 2015. While others from the show are finding love (including Bischoff, who is engaged to Ricky Angel, a regional sales manager based out of her native Chicago), the man nicknamed “Prince Farming” is struggling to find love again.

Iowa is an implied consent state, meaning a refusal to submit to a blood, breath or urine test is an automatic suspension of license for one year.

Does his refusal to come out of the house without a warrant mean refusal in the same legal manner as implied consent?

From Speeding to Driving Under the Influence: Bachelor Chris Soules' History of Past Arrest and Violations

I know he wasn't charged with driving under the influence-yet.

I am going to guess the ankle bracelet isn't the kind to monitor house arrest, but rather the kind that detects alcohol.

Shame on me, but here I find myself thinking Chris should plea.....and then pitch a new reality show about treatment and recovery and all the proceeds should be split between his victim and organizations to prevent drunk driving.

I am going to go ahead and guess that he has a lawyer on speed dial, with the amount of publicity he has had over the years. I am also going to guess that the attorney advised him to deny the breath test and force a warrant, as to buy time (decreasing alcohol content) and also to make it harder to prosecute.

I am a fairly compliant rule follower. My brother (an attorney) and my the guy I used to date (a police officer) always used to tell me that if anything ever happened and I even had a sip of alcohol, I should refuse the breath test and instead force the blood test, which takes much longer to get to and draw. I never thought I would be able to do that, because it seems so----- non-compliant and shady! And they both used to say it isn't non-compliance, it is a right. Police dude used to also tell me that lots of people in a situation where they left a scene would say that they had not been drinking, but took a shot when they got home because they were nervous. He said any time that you place more time and variables in between the moment and scene of the accident to the moment and scene of blood alcohol testing makes it harder to prove.

All that to say---- his actions after he left probably were guided by a professional. My heart breaks for the farmer who was killed. I can never imagine not trying to help a person that I harmed, even if it were to bring more consequences to myself.
