DAVENPORT, Iowa (KWQC) - The trial of Henry Dinkins, accused of kidnapping and killing 10-year-old Breasia Terrell in July 2020, could be held in Linn County.
On Monday, attorneys Chad and Jennifer Frese filed a document in Scott County District Court saying that Linn County is being considered for the trial and that Dinkins “acknowledges that he has discussed this matter fully with counsel and considered all options presented for a venue change.”
“He does hereby consent to a venue change to Linn County for trial,” the attorneys wrote in the document, which was signed by Dinkins.
A final decision on where the trial will be held has not yet been determined. A motion hearing will be held April 28, court records show.

On Friday, Dinkins was moved to the Marshall County Jail, according to online jail records.
He was being held in the Clinton County Jail.
Dinkins’ trial is slated to begin Oct. 17.

Held with no bond in the Clinton County jail.

Judge postpones by a week the trial of the Davenport man accused of killing Breasia Terrell
Henry Dinkins' October murder trial in Linn County has been postponed about a week because of a scheduling conflict.
Dinkins’ trial has been moved to Linn County and was originally scheduled for Oct. 17, but the conflict caused District Judge Henry Latham to move the proceeding to Oct. 25, according to court records filed Tuesday. A hearing on pretrial motions has been scheduled for Oct. 24.

Held with no bond in the Clinton County jail.

Trial moved out of Scott County to Linn County in Cedar Rapids.

A final decision on where the trial will be held has not yet been determined. A motion hearing will be held 4/28/22, court records show. Attorneys for Henry Dinkins file motion to have trial date pushed back
Attorneys for Henry Earl Dinkins, the man accused of the kidnapping and shooting death of 10-year-old Breasia Terrell in July 2020, filed a motion Tuesday in Scott County District Court

Attorneys for Henry Earl Dinkins, the man accused of the kidnapping and shooting death of 10-year-old Breasia Terrell in July 2020, filed a motion Tuesday in Scott County District Court to have the trial pushed back to a later date.
The trial is currently scheduled for Oct. 24 in Linn County District Court.
Dinkins’s attorneys, Chad and Jennifer Frese, of Kaplan & Frese LLP, of Marshalltown, said in their motion that given the fact that they were appointed to the case April 4, and given the voluminous materials of evidence to sift through and the number of witnesses to be deposed, that the ends of justice would be promoted by a continuance.

In his response to the motion by Dinkins’s attorneys, Scott County Attorney Mike Walton said that by agreement of both parties the trial was scheduled for Oct. 17. That trial was rescheduled to Oct. 24 upon the court’s own motion.
The state, Walton said, “is prepared and ready to proceed to trial on the scheduled date."

Scott County District Court records did not indicate Tuesday night that District Judge Henry Latham had ruled on the motion.
Dinkins is being held without bond in the Marshall County Jail.
