DAVENPORT, Iowa (KWQC) - A status hearing was held for the man accused of kidnapping and killing 10-year-old Breasia Terrell in July 2020.

Tuesday, Henry Dinkins had a status hearing that was held remotely. According to court documents, that hearing covered witnesses and evidence that both sides plan to use during the trial which will be on Aug. 8 in Linn County.

The Scott County Attorney Kelly Cunningham says that they have 122 witnesses on their list right now.
[.....]
Cunningham talked about a couple of motions that she expects to file ahead on the trail regarding evidence. Those include:

    • A witness who pulled Dinkins out of the mud in the area near where Breasia’s body was found died of a massive heart attack in June. She will file a motion seeking to use his testimony, he was deposed in May, at trial.
    • When they did the cell phone download of Dinkins’ phone, there were internet searches related to “little girls of her demographic involving sexual behaviors.” She say she wants to introduce that evidence at trial.
[.....]
According to court documents, Dinkin’s trial is expected to last 20 days.
I followed Breasia's case closely when she was missing. I've always wondered what the motive was, even though deep down I knew. I was unaware of a witness in the area. I can't wait until he is sentenced to spend the rest of his worthless existence in prison.

DAY 3 – 8/14/23

  • Breasia’s younger brother, who was 8 years old when his sister went missing, testifies during direct examination that he saw his father clean a bloody machete with bleach.
  • Breasia’s mother takes the stand and talks about the many frantic calls she made to Dinkins the morning of July 10, 2020. She testifies that Dinkins told her he woke up and Breasia was gone and that he was going “downtown” to file a police report, which he never did. Her 911 call is replayed in court before the judge.
  • Dinkins’ girlfriend, who was living with him at the time of Breasia’s disappearance, testifies that she woke up the night of the sleepover to find Dinkins and Breasia missing. Dinkins returned to their apartment at 3 a.m. to grab something from the closet. She testified that she saw Breasia standing next to the Impala in the parking lot. Dinkins didn’t say where he was going and left, presumably with Breasia, who was never seen alive again after that night.

If I hear "Ummm Ahhh" one more time I'm going to pull my hair out. It's even worst than "you know"

You know not the most organized prosecutors I have ever seen. Some of the diagrams they have presented look like Ummm Ahhh a fifth grader drew or were Ummm Ahhhh a last minute ideas.

I sure hope they can get the job done. Which, you know, shouldn't take much from Ummm Ahhh what I have seen.

The witness is a man who helped HD get his car out of the mud near where Breasia's body was found.
Quoted from the article in my post

With as much publicity as this case got in the beginning with pictures of the RV, Camero and Impala on Missing Posters, I'm surprised the guy who pulled Dinkins out of the mud didn't come along sooner. It's my understanding he only contacted LE after Breasia's remains were found. If he had seen the missing poster with the vehicle and put two and two together, Breasia's remains may have been found much sooner.

Wow. Did he ever explain why he hadn't come forward sooner?

I'm behind and catching up. I just watched her brother's testimony and cross. I wish the prosecutor had asked him to go through the story of each day. I also don't like how the defense attorney uses legal terms when questioning him. I know why he does it but seems like someone would scream use age appropriate vocabulary when questioning children. In fact, it should be mandatory.

The kid (DL) was obviously confused about what day Dinkins took him and Breasia to the house where Dl said Dinkins was supposedly drinking. I think the judge will see through that.

The greatest piece of evidence in the whole trial might be when DL put the cell phone battery back in Dinkins phone and used the phone to play games while Dinkins was inside Walmart buying bleach. That put Dinkins on the map and in the vicinity of where Breasia was eventually found and DL with him. If not for that, there would be no connection to the Walmart, no video of Dinkins buying bleach, no connection to the area where Breasia's remains were found, no corroborating evidence to support DL testimony of seeing Dinkin pouring bleach on the bushes.

I see from one of the diagrams the procecusion has been using there is video of Dinkins vehicle at several locations on the highway between Davenport and Clinton. One being a private farm along Hwy 30, the others DOT camera on Hwy 61. Not sure if that has been brought up yet. I might have missed it.
