BOISE — While cause and manner of death are still pending, authorities released the name of a 9-year-old boy who died early Wednesday morning, and whose father and stepmother have been arrested. The stepmother now faces a first-degree murder charge.

Erik Osuna, 29, and his wife, Monique Osuna, 27, both face charges in the wake of 9-year-old Emrik Osuna’s death. The boy was not breathing and had no heartbeat when police and paramedics first responded just after 9:30 p.m. Tuesday to the 1000 block of West Broadway Avenue, according to the Meridian Police Department. He was taken to a local hospital, where he died at about 1:30 Wednesday morning.

Police arrested the Osunas hours later, each on a felony injury to a child charge.

Monique Osuna is now charged with first-degree murder, while Erik Osuna is charged with injury to a child and infliction of great bodily injury — both felonies — and destruction of concealment of evidence, which is a misdemeanor.

Both appeared in court virtually from the Ada County Jail Thursday afternoon. At that hearing, Tamera Kelly, the case’s prosecutor, described the cruelty she said Monique Osuna inflicted on Emrik, who was Erik Osuna’s biological son, in the months leading up to the child’s death.

Monique Osuna had been working from home because of concerns about the spread of the coronavirus, Kelly said, which meant she had access to Emrik all day. Kelly alleged that Osuna beat the child with a frying pan, a belt, a wooden spoon, and a dog leash. According to Kelly, Monique Osuna told the police she used the dog leash “because it was heavier than the belt.”

Kelly detailed how Monique Osuna described assigning strenuous physical punishments to the child — such as jumping jacks and wall sits — that he had to complete while she worked. Monique Osuna told police she put Emrik in a closet at night to sleep and withheld food from him, according to Kelly. Erik Osuna also told police the boy had recently only been given rice and water to eat.

Neighbors told police they could hear shouting from the house, according to Kelly.

While Kelly didn’t describe Erik Osuna as taking as much of an active role in the abuse, “he admitted … he did nothing to save his son,” she said.

Police and paramedics received a call about the child at about 9:40 p.m. Tuesday, Kelly said. But she said officers recovered a text message Erik Osuna sent to Monique Osuna at 5 p.m. that day about taking the boy to the hospital.

Police and paramedics found the boy had bruises on his legs, buttocks, groin and torso, Kelly said. He was severely malnourished and dehydrated.

BOISE, Idaho — Emrik Osuna loved grilled cheese sandwiches. He loved putting things together, and Transformers, and anything to do with ninjas. He was funny and loving with a personality that could light up any room he was in, family members say, and he deserved more of a life than the one he got.

Relatives of the 9-year-old, who died this week after months of starvation and abuse prosecutors say amounted to "torture," say news of the boy's death has left them heartbroken.

His uncle, who works at a grocery store distribution center, can barely look at the abundance of food on the shelves without weeping. Marie Osuna, Emrik's aunt, says her whole family is grappling with waves of pain, confusion and anger.

"I just started bawling, started crying - I just can't believe it," she said. "It just shocks me. I don't know how anybody can do that to a child."

Emrik died in the pediatric ICU at St. Luke's after he was found without a pulse inside his family's apartment in Meridian Tuesday. Prosecutors say there were clear signs of abuse: the child was malnourished, badly dehydrated and covered in bruises when he died, a medical examination found.

Just dammit.
Another angel has flown away to a place of peace.

Was he being "home-schooled" in that special way the abusers conduct their special kind of home schooling?
Did the stepmother just get tired of him being there and not being away at school because the area schools were doing remote teaching?
How long had this been going on?

We have all worried about some children being victims of more frequent or new abuse at home because they have not been in their regular school buildings due to Covid. Was this horror one of those?

My going out in the street and screaming won't help

Please know that I have absolutely nothing against remote classrooms and teaching. It's the only remedy for many school situations. My grandchildren have participated in remote schooling, and it was/is effective and a good alternative.

"We trusted her. We trusted both of them to take care of him. And it's not like our family wasn't more than willing to help," Marie Osuna said. "They could have reached out to us, they could have said something, you know, if they were frustrated with him."

Emrik's father was in and out of his life for the first few years, Marie Osuna said. But in that changed after the boy's biological mother was arrested and sentenced to prison in California for abusing her twin toddlers, Emrik's siblings, leaving them with serious injuries. Emrik was also abused by his mother, according to relatives.

In 2018, Marie Osuna and her husband took him into their home in Orange County. It took the boy a while to open up, his aunt said, but he quickly blended into their family.

"He was just like one of our own. He loved us. He would call me mom," she said. "He was just a good kid, he was happy. I just don't understand what happened."

Erik Osuna ultimately was awarded custody of the boy, and Emrik moved to Idaho to live with his father and stepmother.

Oh no. This poor kiddo, abused by his own mother and then gets abused by these two monsters. How can a father just sit there and allow anyone to hurt his child like that?

This poor child. Abused and then rescued and then abused until he died. Both of those women and the father should rot.

Such an adorable little boy. So ya hit him with a frying pan, dog leash and Lord knows what else.

Erik, I am so, so, so sorry you endured such pain and you were failed.

Let’s see how they like rice and water for weeks.... The charges against Dad are not enough in my opinion.

Now, the stepmother is charged with murder -- and the boy's father, who allegedly "admitted … he did nothing to save his son,” according to prosecutor Tamara Kelly, is charged with injury to a child, infliction of great bodily injury, and destruction or concealment of evidence, reports the Meridian Press in Idaho.

In addition, the father allegedly told police that Emrik had only been given rice and water for weeks before he died, according to the prosecutor.

The couple faces up to life in prison without the possibility of parole in a sentencing hearing set for June 9, according to KTVB.

Sweet boy, I need to believe that you are playing in paradise somewhere.

I won't say what I would have done had I been one of the first responders who saw his little battered body.

I will never understand how situations like this happen. Parents losing their cool in a moment is one thing, but prolonged abuse and neglect resulting in the child's death is beyond comprehension. May their justice, both on Earth and beyond, bring hundredsfold the pain and suffering Emrik endured.

Rest in peace, little man Emrik. :(
