*Grand Jury Convenes (for Joshua, Tylee & Tammy) (@ am MT) – ID – Joshua Jaxon (JJ) Vallow (7) & Tylee Ashlyn Ryan (16) (JJ last seen Sept. 23, 2019 & Tylee on Sept. 9, 2019, Rexburg; found June 9, 2019 buried in Daybell’s yard in Salem, ID) – *Chad Guy Daybell (51/now 52) arrested & charged (6/9/20) & arraigned (8/21/20) with 2 felony counts of destruction, alteration or concealment of evidence & concealing remains. Plead not guilty. $1M bond. Fremont County
*Charged (7/1/20) & arraigned (8/21/20) with 2 felony counts of conspiracy to commit concealment, destruction or alteration of evidence. Plead not guilty. Bond stays at $1M. Fremont County

4/28/21 Update: From State's response to Defendant's Motion to Preserve DNA Evidence: "...On April 12, 2021, the State received the results of DNA analysis of debris found on tools that were seized from Chad Daybell's property. The State also learned that some samples obtained from the examined items were possibly suitable for DNA analysis but that those samples were of such size and quantity that the testing process itself would consume the entirety of the sample(s). On April 18, 2021 the State received another report from the State Lab regarding a possible blood sample from an apartment that would require consumptive testing to test the DNA..." Next motions hearing on 6/9/21.

5/7/21 Update: Grand Jury subpoenas have been issued in the Daybell/Vallow case regarding the deaths of JJ Vallow, Tylee Ryan & Tammy Daybell. Grand jury scheduled on May 17-20 at Fremont County courthouse. 5/7/21: Motion to seal filed by defense Response to request for discovery by State: Daybell's 4th Supplemental discovery disclosure filed by defense. Subpoena issued: Nate Eaton & Heather Daybell filed by defense. Eaton to appear as witness on 6/9/21.
5/11/21 Update: The Committee to Protect Journalists today expressed concern over a subpoena ordering an Idaho reporter to testify in court, and called on the state’s judiciary not to enforce such an order. Attorneys should refrain from subpoenaing journalists, and U.S. courts should not grant such orders, which imperil reporters’ abilities to do their jobs,” said CPJ Program Director Carlos Martinez de la Serna, in New York. “EastIdahoNews.com reporter Nate Eaton belongs in the courtroom’s press box and not on the witness stand.” Yesterday, Nate Eaton, the news director at the local website EastIdahoNews.com, posted on Twitter an image of a subpoena ordering him to appear in a local county court on June 9 to give witness testimony in a conspiracy case he has covered extensively, relating to the deaths of two children. While Grand Jury proceedings wouldn’t show up in the publicly accessible court docket, I think it is worth noting that the Fremont County docket for this week had scheduled cases listed for the same prosecutor starting Wednesday morning and going forward. I tried many variations of search terms online & im pretty confident that, due to not seeing the prosecutor having other cases behind Wednesday scheduled, that it seems more likely that the grand jury is meeting.

I look forward to hearing what the very generous @SleuthD-o-doubleg may be able to see for us starting tomorrow (Monday). I’m curious to see if CourtTV was indeed correct, despite being I think one of, if not the only, source reporting it. I agree with others that sometimes they feel a bit sensational in their reporting but I also feel like they may have heard from some who were actually summoned for this....but we shall see/hear soon enough.

Just trying to see the “other” side of this and I think there are a few possibilities, all with varying levels of realistically happening.
He could have some other clients currently detained and isn’t meeting with just Lori every time he goes. He could be meeting with just her and the sheer size and complexity (paired with his lesser experience in criminal defense) means the in-person time takes longer when he does visit her. I tend to think the jail limitations in how he has to meet with her, and the voluminous amount of digital evidence, does make it harder to meet with your client and trying to both look at the same thing while trying to share a laptop and work with glass in between you. I know Scott Reisch and others basically said “this is normal dude, you’d know that if you actual did criminal defense work before” when Means was telling the Court about the very difficult constrictions. I also know that various Supreme Courts have talked about the physical limitations in detention centers due to COVID and how they can unfairly impact someone preparing for a trial....but this has been discussed ad nauseam before so I won’t bore you all again with more of it.

Besides that, and despite what many think of Means and his experience, I myself think he genuinely cares about his client and ensuring she has a fair trial. I think this, again combined with his more limited defense experience, could mean he’s just spending hat seems like a ton of time there. (I believe he truly cares - regardless of innocence or guilt of his client - based on things he’s said on CourtTV and on his own social media, he seems to hold some strong views about how the government needs to be checked and that everyone does deserve a fair trial if and when they’re accused of a crime. I also think this is a really good perspective for any defense attorney but that’s besides the main points here.

It wasn’t until I filed some records requests seeking previous cases from all the attorneys (defense and the state, I mean) in this case that I realized Means, who has never just done defense work, that he’s done quite a bit more than I think most expect. I know there’s always been this idea circulated everywhere that he’s never done defense work or handled a felony case....but that isn’t accurate at all. This is also how I found out that the deputy prosecutor has handled a ton of divorce and family cases, which I thought was odd, but I try to remind myself of the small-town perspective and how that likely affects this. Prior too, IMHO, (who has much more experience than everyone else just in terms of how long he’s practiced) has handled all sorts of defense work & has been very successful for some of his clients in the past IMO.

But - to your original question - I think it’s really the sheer size of this case, the extensive to/form travel time from where Means lives to the detention center, combined with his lesser defense experience that are creating what we see as someone being there all the time for very long periods of time. That’s just my opinion on why he’s there so often though.

I think at least for the children it is probably likely that more charges will be brought. We don't know how much evidence they have for TD. Here's a description of the probable cause standard:

(a) Sufficiency of Evidence to Warrant Indictment. If the grand jury finds, after evidence has been presented to it, that an offense has been committed and that there is probable cause to believe that the accused committed it, the jury ought to find an indictment. Probable cause exists when the grand jury has before it evidence that would lead a reasonable person to believe an offense has been committed and that the accused party has probably committed the offense. For whatever this may be worth to anyone here...

I have a quick call to the Clerk’s office earlier today and inquired about the court schedule. Without sharing too many unnecessary details here, I had asked about the upcoming week and in general terms if everything scheduled is shown online, and what, if anything, are some things that may not show up online in the schedule.

She had explained briefly that some cases of certain types won’t be posted to the public docket and timing/dates will be known only to the parties involved; and that other types of things like grand jury won’t show up on the public site. In an attempt to try and verify what I saw online, I was able to confirm via them that Blake (the prosecutor) was not scheduled for any “cases” today and tomorrow, but no more info beyond that.
For whatever that is worth, might be nothing and it might be something, so I’m eager to hear any developments that may come later today, tomorrow and/or later this this week

Local update: MM is at the women’s detention center today. After running a couple quick errands in St Anthony, the court house parking lot is full.

^^^^Agreed. Some of their coverage may seem a bit sensationalized and focusing too much on specific aspects of things, but I think they have a pretty good record for getting out accurate information that has been verified as much as they can. In the past, like when they shared court documents that were later sealed, they explained the ruling change from the Court/the situation and subsequently removed their videos and posts that were about and contained those records. The way Chanley announced it, IMO, sounded as if they had some verifiable information from maybe those who were summoned for the grand jury.

We won't here anything yet. The Grand Jury are made up of laypersons. Prosecutor puts forward what information he has. It's then up to the Grand Jury to decide if infact an indictment can be issue. No links sorry but I believe grand Juries operate in Ohio the same way.

Anything seen or heard at a Grand Jury hearing, is Private and Secret nobody attending can talk about what went on.

I think we may have to wait a few days to hear their verdict, not 100% sure on that but.

Did you know that the UK got rid of Grand Juries in 1933? Again no link so we can make this one JMO

How would you be able to tell if there is a grand jury??? Asking for a friend who would really like to know how to figure it out.... I know they are supposed to be super duper secret, but their has to be a paper trail somewhere, right?
