So she lived on everyone's money and now the poor good people of Idaho will be shafted for her defense from their hard earned tax dollars.
How come her husband doesn't have to pay for her defense?
I hope she doesn't get any money for that movie. Someone should do a civil suit where she doesn't make any money. JMO

Am I the only one who has been refreshing like crazy for the last 24 hours?

I’m trying to think of it instead as taxpayers’ money being used to uphold the Constitution, but it isn’t really working.

Maybe think of it as gaining justice for those who crossed paths of LVD

All jmo moo imo

Just curious if now that LVD is declared indigent, will the state fund MM? If the state funds MM will he be given stricter guidelines that he can’t visit all day (MM may be visiting LVD or a different client but not sure how to confirm that)? Will we see a court appointed attorney? Will CD declare indigency too?

All jmo moo imo
all excellent questions!

I remember when MM complained that hiring Rachel Smith was such a financial burden to the taxpayers. I doubt he will complain about himself as a financial burden to the taxpayers since it appears they will be paying for his on-the-job training as a criminal defense lawyer.
Full Time on the job training!

She's going to be entitled to representation by the taxpayers whether it's MM or not. Hell, might as well be him. Can you imagine if the good people of state paid for someone who could potentially derail the justice for Tylee & JJ? I bet RW (and others) would have zero issues with MM "staying on the case".

But looking on the bright side, poor Lori won't have to worry about keeping a roof over her head for a good long while.

I honestly hope we don’t lose MM because then we are starting from scratch which pushes all the dates back farther.

All jmo moo imo

I still think there is much more coming down with the abandonment of dates, sealings, etc...Even if that doesn't happen, I personally don't think a different lawyer is going to change much. Sadly, the judge has allowed this to get out of control and we're a LONG way to getting this resolved. Just my opinion

When murder charges drop, a suitably qualified defense lawyer will be required. If MM stays on, will taxpayers have to fund both?

O.K. I'm sure she is "indignant." But, the court has declared her to be indigent. That's a fine line -- between the two. I guess Chad blew through all the monies for his own defense. She is now a pauper.
Does it mean that Chad likely spent the remaining Tammy's life insurance money on both defenses, but (due to the contract with JP) the house value is only used for his defense?

sFrom what I can gather, and believe me I am on a learning curve, declaring indigency is a process involving affidavits, applications, etc. So, MM was on top of this with submission. He chooses to continue representation, and this means that he will be paid from this point on by the state, but the state is not responsible for any costs incurred prior to the declaration. He also has to submit a separate application to be paid by the court/state from this point forward. I'm sure he has done so.

I've included one of the sources that I used to wrap my head around what the change in status means going forward. Again, this is purely my attempt at understanding the process.

Law is fascinating. I never thought I'd say that. Now I understand why my Mom started taking courses and wanted to get into law.

With that being said, if one of our talented and experienced members in law could help me/us understand this, that would be awesome!:)

It'll be interesting to see if he continues to put in as much time at the women's facility now that he's being paid by the taxpayers. Does he still bill by the hour? MOO.

The state has essentially infinite money and resources. Scott Reisch always says they'll find the money. Would this mean that the defense would be afforded those same luxuries? It's been stated (Even by the defense) how expensive hiring experts, independent studies, etc...Would this give the defense the ability to spend however they want? Or do they have to make requests to the court for each item. I'd assume there are limitations but have zero idea. Can anyone chime in

If Lori gets a public defender (in addition to MM), will she be at a disadvantage compared to Chad who has JP? Scott Reisch believes that some public defenders are top-notch lawyers.

I'm surprised it took this long to be declared indigent if MM was billing for all his time and expenses for the last 15 months or so, even if CD was paying the expenses prior to his arrest in June.

Well, we knew that this was coming, sooner or later. I wonder if MM will be more attentive now? Or less?

Waiting for CD to also take this path.

I thought it was posted early on that Chad sold his home to a child. Wasn't it the plan for Chad and Lori to purchase a mobile home as the newlyweds new home?
