Colorado 'Evangelist' visits Rexburg to pray for community and missing kids

REXBURG – A Colorado evangelist felt God calling him to visit Rexburg to pray for a community experiencing the loss of two children and whose mother refuses to cooperate with police in finding them.

Joe Shortino arrived in Rexburg on Tuesday and brought with him his 200 pound wooden cross. Attached to the cross are an American Flag and Prisoner of War flag and a crown of thorns.

“The Lord specifically told me that I should come to Rexburg. I’m here to pray for your town and the people. I know there’s been a lot of stuff going on here specifically with the missing children. The Lord said that’s why I’m here - to pray for the town,” he said.

Many of you have asked about a hearing today in the Lori Daybell case. The judge is expected to say whether he is stepping aside after a motion was filed by her attorneys to have him disqualified. Daybell will not in the courtroom and it will be done telephonically - so we will not have a camera there but Eric Grossarth will have a full report once it's finished (the hearing will likely be very short).

REXBURG — Lori Vallow Daybell’s court case will see a new magistrate judge and a change in her legal team after a hearing held by phone Friday afternoon.

Earlier this week, defense attorney Mark Means filed paperwork asking that Judge Farren Eddins no longer preside over the case. A reason was not listed. Eddins approved the motion and removed himself from the case. Now court administration will assign a new judge.

The move came after Eddins approved the preliminary hearing to be held May 7 and 8 (instead of the previously scheduled March 18 and 19) at the Madison County Courthouse. In court documents also filed earlier this week, Means and Madison County Prosecuting Attorney Rob Wood requested the proceedings be moved back.

HAPPENING NOW: A teleconference hearing with Lori Vallow Daybell’s attorneys in Boise, The Madison County Prosecutor, and Magistrate Judge Eddins. The defense filed a motion to disqualify Judge Eddins from the case, todays hearing is expected to determine if he will stay on.

Deseret News has a bit of a recap. Nothing new but they point out there may be a clip showing Chad getting out of the car:
  • The footage shows Lori Vallow exit a blue Nissan Rogue with Chad Daybell, the news outlet says. He pulls a tire from the back of the car and puts it in a storage unit. They move a car seat together and put it in the locker, too. Then, they leave.
  • The next day, the footage shows another man — “likely Cox,” according to EastIdahoNews.com — carry the car seat by himself.

Defense attorney says Lori Vallow faces 28 years in prison

“It doesn’t appear they are even being taken care of; desertion charges alone carry up to 14 years each, but you can be assured that Idaho is looking at more serious charges including the potential of a child homicide or two.”

Skordas says the only way Vallow can avoid possible jail time is to produce the children.

“If you want to cooperate and you want to produce the children, we can get you out of jail,” Skordas said.

Skordas says this is going to be a difficult defense for Vallow’s attorneys.

The Madison County jail in Rexburg, Idaho, isn’t changing its preparations over the coronavirus even though Lori Vallow Daybell, a high-profile client is one of the jail’s inmates, Isaac Payne, the public information officer there, told the Deseret News.

Payne said: “Her presence doesn’t change our preparation in anyway. She gets treated the same as any other inmate we have.”

Vallow Daybell sits behind bars at the Madison County jail on a $1 million bail on charges of desertion and nonsupport after her two children, Joshua “JJ” Vallow and Tylee Ryan, went missing last year.

But Payne said she will be screened like anyone else in the jail. He said Badger Medical, which offers all medical needs, will be screening all of the inmates’ health throughout the COVID-19 outbreak.

“We screen their health anyway. They come into our jail. They get a medical screening when they arrive,” Payne said. “So that’s going to be amped up a bit and that they’re just gonna be watching all the inmates health. Our medical staff is on call 24 hours a day if we need them.”

With her two children still missing, jailed Idaho mom Lori Vallow’s legal team has undergone a shakeup.

Two of Vallow’s attorneys withdrew on Friday from defending her against charges related to the September disappearance of the kids, 7-year-old Joshua “J.J.” Vallow and 17-year-old Tylee Ryan, according to a videotape of the court proceedings obtained by EastIdahoNews.com.

Her remaining attorney, Mark Means, also filed a motion seeking the removal of Judge Farren Eddins, who agreed to remove himself with no reason given for the change, according to the video.

Neither Vallow nor her attorneys were present for the hearing that was conducted over the telephone in Madison County, where Vallow stands accused of two felony counts of desertion and nonsupport of dependent children, as well as resisting or obstructing officers, criminal solicitation to commit a crime, contempt of court and willful disobedience of court process or order.

No reason was given by her two other defense attorneys, Brian Webb and Edwina Elcox, for withdrawing from Vallow’s case.

Before removing himself, the judge set a preliminary hearing date in the case for May 7 and 8, following a requested delay sought by both Means and Madison County Prosecuting Attorney Rob Wood.

Vallow remains jailed in Madison County on a $1 million bond.

Each count filed against Vallow carries a maximum penalty of 14 years in prison, according to the prosecutor’s office. Wood said that cumulatively, she could face 30 years in prison if convicted.

"As with any citizen of our Country, Mrs. Daybell is entitled to all the privileges and rights that accompany our cornerstone belief of innocents, until proven beyond a reasonable doubt otherwise," a statement from attorney Mark Means read. "It is this innocence that Mrs. Daybell assertively maintains regarding all charges."

Means is now Daybell's sole attorney, after her two others, Edwina Elcox and Brian Webb, stepped down from her legal team on Friday.

He didn't immediately respond to ABC News when asked why Elcox and Webb stepped down.

"Furthermore, Mrs. Daybell is guaranteed access to a fair and impartial judicial process. There is no room in the process for conjecture, innuendos, and or speculation to alter this Constitutionally guaranteed process," his statement sent Monday read.

She's facing five counts in the case of her missing children, 7-year-old Joshua "JJ" Vallow and 17-year-old Tylee Ryan -- two felony counts of desertion and nonsupport of dependent children and one misdemeanor count each of resisting and obstructing an officer, solicitation of a crime and contempt.

JJ and Tylee have been missing since September. During an investigation by Rexburg police, they found “no evidence or verification of anyone providing for the housing, food, clothing, education or medical care” for the children since that time.

Police have also condemned Daybell for being unwilling to assist in their investigation to find the kids, including when she failed to produce them after she was ordered by an Idaho court to do so.

About two months after her children were last seen, she moved to Hawaii with her new husband, Chad Daybell.

Chad Daybell previously told ABC News that “the kids are safe,” but he did not elaborate.

Lori Vallow Daybell was extradited to Idaho, where she and the children had been living prior to their disappearance, a little more than a week ago.

“In the coming days we look forward to the opportunity to work through the judicial process to prove Mrs. Daybell’s innocence,” the statement from Means read.

She is currently being held at Madison County Jail on $1 million bond.
