“ST. ANTHONY — Chad and Lori Vallow Daybell are being investigated for conspiracy, attempted murder and/or murder by the Idaho Attorney General’s Office, according to a letter obtained Friday by EastIdahoNews.com.

The letter from Deputy Attorney General Colleen Zahn is in response to Fremont County Prosecuting Attorney Marcia Murdoch’s April 7 request that the AG assist in the investigation of Tammy Daybell’s death.

Zahn writes the attorney general’s office will provide prosecutorial assistance without local prosecutor involvement, and the attorney general will take charge of the case.

‘All decisions regarding the case shall be the responsibility of the AG,’ the letter states.

The investigation does not necessarily mean charges will be forthcoming.

Chad has not been arrested or charged with any crimes. He married Lori in Hawaii within weeks of Tammy’s death.

Armed with a new technological device the Utah Cold Case Coalition is set to dig deeper in the many unsolved murders and crimes in the state.

Ground Penetrating Radar (GPR) is often used by law enforcement to search for buried bodies, but it’s become more affordable for groups like the Cold Case Coalition.

Friday, the coalition focused on a new search location at a cemetery in Springville. They chose that location based on a hunch. Chad Daybell who is involved in a missing children’s case in Idaho once was a gravedigger at the same cemetery.

Jason Jensen with the coalition said Kiplyn Davis’ family knew of Daybell.

During Friday’s GPR search Kiplyn’s sister, Karissa, and her husband watched with interest.

“Maybe there was a possibility that they put her body in one of these graves,” said Van Tussenbrook. “You know with another person obviously.”

For now everyone will have to wait for the results. The data collected will be sent to a lab for analysis.

The sheriff initially said Tammy Daybell’s autopsy would take approximately 4-6 weeks from when her body was exhumed in Springville, Utah last December. Chad Daybell has not been charged. Neither has Lori Vallow. #FindJJandTylee

One reason the AG is taking over? Fremont County Prosecuting Attorney Marcia Murdoch is not running for re-election this year. If Chad and/or Lori are charged and Fremont kept the case, there would be disruption in the prosecution's team. The AG will provide continuity no matter who is elected as prosecutor.

REXBURG, Idaho – Court documents confirmed the Idaho Attorney General’s Office will be taking over the Lori Vallow case as a headstone was placed for Tammy Daybell in a Springville cemetery.

The headstone at the Springville Evergreen Cemetery has a large duck being followed by five little ducklings, which sources told KSL were for Daybell’s favorite pet duck and each of her children. It is also adorned with her favorite flowers, carnations.

A caption on the headstone reads: “Tammy was a beloved wife and mother, devoted daughter and sister and friend to all animals.”

According to a report from the East Idaho News, Daybell and Vallow are being investigated for either conspiracy, attempted murder and/or murder by the Idaho Attorney General’s Office.
The letter, sent by Deputy Attorney General Colleen Zahn, was in response to a request for prosecutorial review by Fremont County Prosecutor Marcia Murdoch.

The documents confirmed the Idaho Attorney General’s Office will take full responsibility of the case. Fremont County officials will cover the expenses associated with the case, except for attorney general office personnel salaries.

Humphries said he was pleased to hear the case will be handled by the attorney general’s office because it will provide continuity.

Murdoch’s term will end later this year and she was not expected to seek re-election.

In her letter, Murdoch states that if the AG doesn’t have the resources, both offices could approach the U.S. Attorney’s Office for help.

“I have reached out to (Bonneville County Prosecuting Attorney) Danny Clark, and he has told me that he cannot take over the Daybell case,” Murdoch wrote. “I also have reached out to Jan Bennetts, Ada County prosecuting attorney, and requested her office take over the case. She has told me she is not able to take the case because of their lack of resources.”

"Murdoch asks the AG to take over because her office “does not have the resources or the experience to handle the case.” It appears the attorney general had denied an earlier request to take the case, and Murdoch asks Zahn to reconsider.

JUST IN: Waiting for document on updated motion for bond reduction. Hearing for Lori Vallow is now set for 4/24, instead of this Friday. If she does post bail, her address will be sealed.

FULL LETTER OF ACCEPTANCE: Here is the Idaho Attorney General’s letter time Fremont County Prosecuting Attorney Marcia Murdoch to take over the investigation into Tammy Daybell’s death. Naming the defendants as Chad Daybell and Lori Vallow for conspiracy, attempted murder and/or murder. It’s unknown how long this investigation will take. The autopsy and toxicology reports on Tammy Daybell have not been released.
