Henderson’s murder trial set for Dec. 17 | Bureau County Republican

Henderson, 26, is charged with three counts of murder for the death of 16-year-old Diamond Bradley of Spring Valley. Bradley was last seen on Jan. 23. She was reported missing the next day and found stabbed to death alongside a rural Putnam County road on Jan. 27.

Henderson was taken into custody on Feb. 5 after investigators linked him to Bradley through interviews, surveillance footage and cell phone data.

He was initially charged with the Class 3 felony of concealment of a homicidal death and was being held on a $1 million bond. Public Defender Roger Bolin successfully got that charge dropped during a Sept. 6 status hearing.

Bolin has argued the 120-day limit of the Speedy Trial Act has been exceeded, and Putnam County State’s Attorney Christina Judd-Mennie agreed to drop the charge to focus on the murder charges.

The three additional felony murder charges entered on Aug. 30 each carry concurrent $1 million bonds with 10 percent to apply. Henderson has entered pleas of not guilty on all counts and will decide whether to have a bench or jury trial at a Sept. 13 status hearing.

Plead not guilty. $2M bond. Met online.
Trial was set for Oct. 1, 2018, changed to Dec. 17, 2018.
7/26/18 hearing: waived right to speedy trial, but Public Def. Bolin stipulated the agreement was only for Aug. 6 to Oct. 1 when trial is to begin. Judge will decide on Aug. 30th re Motions to Dismiss Charges. DNA results will be back, and more changes might be coming.
8/29/18 Update: was arraigned on three counts of first-degree murder Thursday as Putnam County grand jury indictments were unveiled during a court hearing. Plead not guilty to all counts and was scheduled for a review of the case next week (9/6). He remained in custody, with his bond doubled from $1 million to $2 million. Status hearing set for 9/13. Judge wants to send out notices to jurors 9/6. Barring the dismissal of that charge, an agreement reached between the lawyers during a recess Thursday would formally set the murder as well as concealment charges for trial on Oct. 1.
9/6/18 Update: Judge Kouri granted a motion to sever suspect Henderson’s concealment & murder charges, the state dropped the lesser charge. He approved a defense motion put forth by public defender Roger Bolin to sever charges of concealment of a homicidal death from the three counts of murder his client was charged with last week. Both sides have agreed to a trial date of Dec. 17. At a status hearing (9/13) Bolin will notify the parties whether his client will opt for a jury or bench trial.

Actually his bond is $2 million - it was updated by the Judge on 8/29/18. :)

Man charged with motel shooting bound over for trial

The link is not about this case. It's another Diamond Bradley (age 33) that was shot 4 times in a motel in Missouri. The name Diamond Bradley seems to be quite common. This is the 3rd one I have heard about on WS (and all of them are missing or victims of crime :eek: ).

"HENNEPIN — Preparations for Putnam County’s second murder trial of the year continued Thursday with the scheduling of a Nov. 21 hearing on pretrial motions in the case of Richard Henderson of Standard.

Henderson, 26, is accused of stabbing Spring Valley teenager Diamond Bradley to death in January and dumping her body in a ditch along a rural gravel road. He’s scheduled for a bench trial beginning Dec. 17 before Circuit Judge Stephen Kouri.

At Thursday’s brief status hearing, Kouri set a Tuesday deadline for filing pretrial motions. State’s Attorney Christina Judd Mennie said the prosecution does not anticipate filing any at this point, but public defender Roger Bolin said he does expect to, though he declined to disclose any details....

Henderson, a former greenhouse worker, was initially charged Feb. 5 with concealing a homicidal death. After three counts of first-degree murder were added later, the concealment charge was eventually dropped by prosecutors in order to avoid having to try him on that charge first under a speedy trial deadline.

Because there will be no jury selection process for the trial, lawyers in the case believe it should be completed during the week before Christmas....

If convicted, Henderson could face life in prison rather than the normal range of 20 to 60 years because prosecutors allege the crime was “especially brutal and heinous.” He remains in custody in lieu of $2 million bond."

"HENNEPIN — The attorney for a man accused of killing a Spring Valley teenager will have until Nov. 6 to file pretrial motions for his client.

Roger Bolin gave notice to Judge Stephen Kouri today that he intends to have motions relating to the defense of Richard A. Henderson, 26, of Standard ready by Election Day. Kouri will hear those motions at a Nov. 21 hearing....

Bolin also said he’s prepared for the Dec. 17 trial date, though it hasn’t yet decided if Henderson will take the stand in the upcoming bench trial.

State’s Attorney Christina (Judd) Mennie said she doesn’t have any motions to file at this point — whether she will depends on what Bolin files she said. Mennie said she too is ready to commence with the trial and is confident in her case."

"In a Thursday status hearing lasting about a minute in Putnam County Court, the defense attorney for murder suspect Richard A. Henderson told the judge pre-trial motions would be filed by Nov. 6.

Henderson, 26, of Standard, is accused in the January killing of a 16-year-old Bureau County girl. He previously decided to waive his right to a jury trial and will have his fate decided by Judge Stephen A. Kouri during a bench trial scheduled to begin Dec. 17. ..

A motions hearing was set for 10 a.m. on Nov. 21.

While Public Defender Roger Bolin didn't elaborate, he did say after the hearing that a few pre-trial motions will likely be filed and that he had recently received additional evidence to review. He also said he didn't know whether Henderson would take the stand during his trial....

Both the prosecution and the defense are expecting the trial to last only three or four days.

Henderson was initially charged with concealment of a homicidal death, a Class 3 felony with a sentencing range of two to five years. However, Bolin successfully got that charge dropped during a Sept. 6 status hearing.

Bolin argued the 120-day limit of the Speedy Trial Act has been exceeded, and Judd-Mennie agreed to drop the charge to focus on the murder charges.

"While it was expected Public Defender Roger Bolin would file motions Tuesday afternoon in Putnam County Court for the upcoming bench trial of Richard A. Henderson for the murder of 16-year-old Diamond Bradley, the negotiated plea deal sentencing Henderson to 53 years was a surprise.

“The talk of negotiations really picked up last night, but we didn’t know until (Tuesday) whether he’d take the deal or not,” Putnam County State’s Attorney Christina Judd-Mennie said after the hearing.

Henderson, 26, of Standard, pleaded guilty to one count of first-degree murder, a Class M felony. The state dropped the remaining charges...."
