A Rockton woman accused of killing her newborn baby in December 2004 had her arraignment postponed after being granted a new judge in her case.

Katie L. Stockton appeared with David Doll, first deputy public defender, Thursday in front of Judge Joseph McGraw, but did not enter a plea.

The case will be reassigned to Judge John Truitt with the next court date set for Sept. 16.

Stockton was wearing red jail garb and showed little emotion as she entered the courtroom.
She was arrested Aug. 5 after new information purportedly linked her to the crime.

Winnebago County sheriff’s deputies say Stockton is the mother of Baby Crystal, a baby found frozen to death on the side of a country road near Stockton’s parents’ home.

Doll had little to say after the hearing.

“We will handle court in court,” he said.

Winnebago County State’s Attorney Joe Bruscato, who was joined in court with Deputy State’s Attorney Marilyn Hite-Ross, also would not reveal much about the case.

“I am not going to comment about the case or case strategy,” he said.

Meanwhile, Winnebago County Coroner Sue Fiduccia said test results on two other infants found in the trunk of Stockton’s car may be available next week.

Stockton’s 1993 Saturn was located in a South Beloit police impound lot Aug. 11, about a year after it had been impounded.

Katie Stockton's murder arraignment postponed

The woman police say is Baby Crystal's mom gets her murder arraignment postponed after a request by her lawyers. Katie Stockton December 2004. She was supposed to enter her plea today. Now that will happen September 16.

All parties return to Courtroom A in 13 days for Stockton's arraignment. This time, before a new judge, Judge John Truitt. Stockton's defense filed a motion for judge substitution which was granted at today's hearing. The Winnebago County State's Attorney's office also has that option in the case.

"At this point in time, the state would have no plans to file any motions to substitute the judge, but we would reserve that right in the event circumstances were to change," stated Winnebago County State's Attorney Joe Bruscato.

"Our position is pretty much going to be, we don't want to discuss with the media," explained First Deputy Public Defender David Doll. "We'll handle court in court. And I understand what you guys do, and I have great respect for it, but that's the way I do what I do."

Bruscato also didn't have much to add about the case. "At this point in time, the State's Attorney's office will not be engaging in any pre-trial publicity. We want to protect the fairness for the defendant."

Katie Stockton pleads not guilty to upgraded murder charges

The woman police say is Baby Crystal's mom pleads not guilty in court Wednesday.

Katie Stockton, 28, was in court to hear the upgraded charges against her in the "Baby Crystal" case. She now faces 10 counts of First Degree Murder for allegedly leaving the baby along the side of a rural Winnebago County road in a garbage bag in December 2004. The baby froze to death.

Stockton was arrested and charged in the case after nearly five years. She's being held on $1 million bail. Now that the charges have been upgraded she would be eligible for the death penalty if found guilty. The state has 120 days to decide if they will seek the death penalty in the case.

Shortly after her arrest in the "Baby Crystal" case, police found skeletal remains of two infants in the trunk of Stockton's car that was at an impound lot in South Beloit. The Winnebago County State's Attorney's Office is still waiting for autopsy results before they could possibly file charges against Stockton in the deaths of those infants.

Stockton's next hearing in the case is October 28.

Woman accused in Baby Crystal case pleads not guilty

Katie L. Stockton, 28, stood in front of Judge John Truitt with assistant public defenders David Doll and Susan Kalbantner as Truitt read all 10 counts of the indictment.

Stockton, wearing a red jail suit, spoke clearly as she answered Truitt’s questions. Family members sat in the front row of the courtroom, but Stockton did not make any eye contact with them or anyone else seated in the room.

The courtroom grew silent and others awaiting their cases shook their heads as Truitt read the first-degree murder charges.

Stockton could face up to 100 years in prison on the charges, while the death penalty also is applicable.

Winnebago County State’s Attorney Joe Bruscato, who appeared in court with Deputy State’s Attorney Marilyn Hite-Ross, would not say whether he will seek the death penalty in the case and did not divulge many details about the investigation.

Doll declined to comment after the hearing, saying it would not be appropriate to release any statements.

Winnebago County Coroner Sue Fiduccia has received test results on the two sets of skeletal remains of infants found Aug. 12 in the trunk of a vehicle owned by a Rockton woman.

A forensic anthropologist has confirmed that both infants were 38 to 40 weeks old at the time of their deaths. The babies are believed to have been delivered normally, but further testing must be done to determine the sex of the infants. The remains show no sign of bone disease or trauma or deliberate dismemberment. There also is no indication as to the cause of the infants’ deaths, because all of their internal organs are gone, Fiduccia said.

The forensic anthropologist believes the infants to be twins based on their similar size and development, but a conclusive determination cannot be made without further tests, which are pending.

At this point, there is no known relationship or link between Stockton and the babies, Fiduccia said. Results of further DNA tests may be available in 90 days.

The remains were found in August inside the trunk of an car owned by Stockton. The car had been in an impound lot for a year prior to the discovery.

Stockton is accused of killing an infant found by the side of a road in rural Winnebago county in 2004, which was dubbed "Baby Crystal" by the community. She was arrested in Kansas City in August of 2009.

The County Coroner's office reports that there is no sign of bone disease or trauma to the remains, and no signs of deliberate dismemberment. Further testing is on going.

However, authorities say they won’t discuss the results until the forensic examination of the second infant is complete. That work is expected to take up to six weeks, said Winnebago County Coroner Sue Fiduccia.

DNA testing is being conducted on both infants, Fiduccia said.

Stockton is in the Winnebago County Jail on $1 million bond. Her next status hearing is scheduled for 9 a.m. Oct. 28.

I'm wondering just how long will it be before these little angels get the proper burial they so deserve? I understand the need to get all of the tests done, but can't they take any need samples & give them a proper burial? It's just been taking so long for these tests to come back & in the mean time they are both left in a morgue still! :shakehead:

Coroner: Babies found in trunk likely female

ROCKFORD, Ill. — Authorities in northern Illinois say a Rockton woman charged with murder in the death of a newborn girl is the probable mother of two other infants found dead in the trunk of an impounded vehicle registered to her.

Winnebago County Coroner Sue Fiduccia (fih-DOO’-shuh) also said Thursday that the babies are thought to be female and are not twins.

She says a cause of death hasn’t yet been determined and it’s unclear if the babies were born alive.

The infants’ remains were found Aug. 12 at a South Beloit impound yard where the vehicle had been sitting for about a year.

The woman, 28-year-old Katie Stockton, is charged in the death of a newborn girl called Baby Crystal, who was found frozen in December 2004. Stockton has pleaded not guilty to first-degree murder charges.

=======================

Attorneys from the Winnebago County Public Defender's office have been assigned to Stockton's case. A message left with the office Friday was not immediately returned.

Authorities say they believe the two infants were born after Baby Crystal, but they don't know exactly when.

Winnebago County State's Attorney Joe Bruscato said no new charges would be brought against Stockton at this time because the causes of death haven't been determined.

The father of one of the two babies found in the trunk has been identified, Winnebago County Sheriff Dick Meyers said.
