I have never thought Todd's small stature would prohibit him from both murdering and moving/disposing of her body.

To me after reading the indictments, it seems clear that Katrina was killed in the home, then her body was placed in the trunk of a car and transported to the river.

It's not clear whether they actually found a bat, or maybe the ME said the blows could have been made with a weapon similar to ...

My thoughts are with Katrina's family and loved ones. I wish they never had to hear the ugly details of her death.

But if you read the news station reports it says the state believes TS forced KS into the trunk where he then beat her to death.

I would think the trunk must have a great deal of evidence, if so.

I think I would trust the facts within the actual indictments.

I would think so too. As would the house if it happened in there. Which is why it makes no sense to me that after searching the house & the car LE said they werent sure if there is foul play or if she left on her own. If they found blood evidence they obviously would've known it was foul play

They may not have been ready to say it publicly as yet, or perhaps did not have the DNA back to be sure 100% that the blood was hers? Maybe the husband was still "cooperating" at that point and they hoped he would continue.

Don't forget that the media is not doing homework and not checking for accuracy. They just don't. The goal is to get it online and fast. Sometimes you see an "update" which just means they corrected an error, but more likely the misinfo will stand.

And... talking about the media, has there been video of his last court appearance?

Are cameras banned? I know Winnebago allows cameras in some cases.

I know that WIFR and WTVO had cameras in the courtroom but never saw any video of it. Was thinking maybe it was not priority as his appearance was at same time as Connecticut school shooting

My guess is no cameras inside. I went back to check, and his last court appearance (11/24) just showed people outside the doors. And-- Smith appeared via video link from jail.

*eta: and if there's cameras allowed inside, shame on Rockford area news crews (CT or not).

BTW, I added the 11-count GJ Indictment to the Case Archive.

Todd's Public Defender is Margie O'Connor. Interesting tidbit, she used to be a
Deputy State's Attorney of the Criminal Division.
Winnebago County State's Attorney, Joe Bruscato fired her and 4 others in Dec 2008 in a "restructuring".

His last appearance was actually 12/14 @11am for his arraignment. WIFR &the WTVO had permission to have cameras in the courtroom but never aired any video

Right, 11/24/ was the previous appearance. There he appeared via closed circuit TV from jail.

What a shame the media is not taking the opportunity if it is actually provided to them.

Or maybe I just want to see him sob, as they described.

I was really shocked. They had posted on their FB's that they got permission to have cameras in the courtroom then the day before again posted they would be in the courtroom but never aired it. I wish there was a fast fwd button. Im so anxious to find out what evidence they have. Not hearsay & curcumstancial crap. Real evidence. Im still not convinced he did it

I wonder what his daughters and their Mom think. They know him better than most, and they might know his "moods" and whether he could easily become agitated and if that would escalate.

Well I hate to tell you, but circumstantial evidence IS real evidence. The judge will inform the jury of that fact when time comes to deliberate. It is what it is......

I know and I think it's sad. If her death happened they wah LE believes then they will have solid evidence. A beating like that would've had pooling of blood where she was laying as well as spatter & cast off. There is no hiding that. If we can convict people on theories & what if's then why not her supposed boyfriend? "What if" the errand she ran was to see him. "What if" he was angry that she was at the house with TS. "What if" that anger got out of control. Do any of you remember who Darlene Ewalt is?

im irked that i cant see him sobbing...i hope he sobs for rest of his wretched life. but for the sake of not possibly tainting a jury pool then i will keep my wants to myself...LOL.. i wonder if it has anything to do with the convicttoddsmith.com poll/hateful commenting situation that is causing problems for the prosecution and they just dont need any more media caused mischief for the defense to use against them...whatever they have to do to get him convicted and to keep his weasely self in that prison cell LWOP...i say go for it! :jail:

I agree with you to an extent. If he did this I too hope he sobs & is miserable for the rest of his life. I personally wish they would hang an autopsy photo in the cell of guilty people so they have to see everyday what they did. But I disagree with "whatever it takes to get HIM convicted". I'm more concerned with being certain that the guilty party pay for the crime

No I don't think you are getting it. Circumstantial evidence IS REAL evidence, always has been. It isn't theory. It's kind of like you go outside and the grass, your car and the sidewalk are all wet. You didn't see it rain, but you can safely conclude that it did. You don't have to actually see the rain falling down to know that it did.

Proving a crime isn't always going to be cut and dried, most murderers don't leave a video of their crime so more often than not we have to rely on circumstantial evidence to tell the story. That's just the way it is..... Real life is not CSI.

sorry, we crossed conversations ... lol. im not talking about using non-provable things to convict an innocent person.

i AM talking about tainting jury pools with over-media saturation which in the end comes back to allow the criminal a loophole in which to appeal and possibly walk free. thats what too much media can and has done to cases in the past. i believe that todd smith is guilty, todd smith has given a confession to how he BEAT HER WITH A BASEBALL BAT TO DEATH. he needs to go to prison and stay in prison. and the media needs to stay out of it. and by the looks of it, the media agrees. megan dwyer/23 news is an attorney so for her to not be all over this and trying to put it on the news speaks volumes to me....jmho....

He gave a confession? Where did u find that out? And thank goodness it at least spares the family a lengthy trial & hearing the gruesome details. And if he did then he absolutely should never be let out
