I think the State filed the motion to the Westville to show that what RA's Defense was saying about his living conditions is a bunch of crap, that he was treated no differently. And who knows, maybe RA got loose lipped?

CVS - I'd say they are requesting records of his employment for dates and times he was working around the murders and also the fact that he would have had to pass a fairly thorough/complex test in becoming a licensed Pharm Tech.

Good question! Prosecution has 4 subpoenas duces tecum and 2 subpoenas.
Defense has 4 motions to quash.
I don't know any way of telling which ones they want to quash.
 
I kept searching him in Indiana prisons, state and counties, nobody of his name with M or Matthew as middle name. Nobody 50 or 51. Including thos previous two, middle initial and age, no Richard, Rick, Rich, Ricky or R. It's like he disappeared.

Is there a Federal prison they'd put him in? Maybe he's presently in a hospital facility somewhere not on prison grounds? Like NYC has Bellview, is there a state run mental institution near Logansport?
This is Judge Gull's order. Maybe he's in the psych ward of one of the DOC facilities? New Castle has one.

On November 3, 2022, the Judge of the Carroll Circuit Court, at the request of the Carroll County Sheriff, entered the following order: "Accordingly, pursuant to Ind. Code 35-33-11-1, the Court ORDERS the Sheriff of Carroll County to transfer Defendant to a facility of the department of correction designated by the commissioner of the department as suitable for the confinement of Defendant and provided that space is available." These types of orders are referred to as "safe keeper" ordered. The Department of Correction has complied with this order. Consistent with that Order and the "safe keeper" statute, the Department of Correction is authorized to move the Defendant within the Department of Correction to accommodate his medical and physical needs pursuant to medical directives by the Department of Correction physicians, psychiatrists or psychologists

While we're pondering the unknown, MS brought up this interesting filing. I assumed it was probably from RA but it was strange that it didn't note who it was from. Below it is the one where RA requested an attorney and you can see he was the one who filed it.

I believe the location of RA is not public knowledge at this time. Westville was supposed to be kept unknown but the IN DOC messed up and posted his location on a publicly accessed website.

Thanks FG, it sure sounds like he went somewhere appropriate for his current physical and mental health. Being how that info would certainly be under HIPA now it makes more sense he's "disappeared" from the prision record right now.

We don't know who wrote it or where it came from. "Correspondence to/from Court Filed"
How would the judge send her order to Westville? **Forget this**

I think her order would go straight to DOC?

Maybe a response wasn't needed, it's not in her hands to decide it since it's the health and well being of a Westville resident? Westville can act on it's own?
 
In my opinion, the reports of RA's deteriorated condition - i.e. him "falling apart" is a direct consequence of:

1) Realization that he is probably not getting out of prison...EVER.
2) He can't kill himself...they've probably taken away almost everything that he could harm himself with (hence leaving him with just a mattress on the floor and no bed frame (metal).
3) Everyone in his family abandoning him and being all alone.
4) The guilt of living with the truth... that he can't admit to out loud.

He probably can't eat or sleep and doesn't want to take showers etc. You can't make someone take a shower.

But (again) in my opinion, he created this for himself.. it was his own doing.

Those poor poor girls are who we need to really think about, and not this lowly criminal. I really do not feel sorry for him.

I think that's quite possible. Maybe something someone overheard, something regarding the charges, RA's health/mental health, concerns regarding treatment by staff, etc. It could be anything. I think it's likely that whatever the letter is about, it would have been read by prison staff before leaving the facility. Don't they monitor all calls and correspondences?

It is my understanding that all mail incoming and outgoing is monitored (subject to being read at corrections' discretion) except for legal mail. legal mail is not subject to monitoring.

Thank you, that's good to know and makes sense. I'm assuming this letter was legal mail, since it was on the court record?
 
Those poor poor girls are who we need to really think about, and not this lowly criminal. I really do not feel sorry for him.
Some have expressed concerns about a person that is presumed innocent being kept in a prison, housed the same as the convicted felons that are now being punished. This is not, and I'm not that you're saying it is, equal to feeling sorry for him. I believe that RA is absolutely guilty but I respect anyone that insists he is innocent until proven guilty and must be treated accordingly and not differently than other defendants awaiting trial.
What should the judge have done?
She certainly couldn't make a decision based on animous toward the defendant. A fair trial and appeals were probably a consideration. The more grounds for appeals that the defense sees, the more likely they will go to trial and then appeal. I wish he would get the death penalty but a jury wouldn't decide on that until after conviction and I don't trust that path to the DP. The safest route is for RA to plead guilty, MOO, because I want the surest path to justice for the victims.

Another inmate writing a letter of that nature would be possible evidence and could not be entered as inmate correspondence into the court record. That would go to LE and the prosecutor for follow-up and the defense would have to be notified asap if there was any new evidence developed, as discovery must be done and the pretrial is nearing.
