Police said the child was holding a loaded gun in an apartment hallway. Neighbors said the boy was waving it around, even pulling the trigger.

The child's mother told 13News the video of her son with a gun was scary, but also defended Osborne, saying he's a good dad.

Body camera footage from officers and cameras rolling from a docuseries featuring Beech Grove police show Osborne telling police he'd been sick and sleeping all day. He told police he didn't own a gun because of previous felony convictions.

"Where did you put down that toy?" officers ask the child.

As officers look through the apartment again, unable to locate the gun, one officer asks the child where he put it. The child takes officers straight over to a desk in the living room where the handgun was laying.

I was really surprised that this case didn’t receive more press.

A four year old waving a gun around, caught live on video, father had at least 7 prior convictions……..

Shane Osborne was charged with two charges of neglect of a dependent and dangerous control of a firearm after the toddler was seen waving a pistol.

Osborne "explained that he had been ill all day and did not know (the toddler had) left the apartment," an officer said in a probable cause affidavit.

The toddler is identified in the affidavit as "K.O."

Officer Rainerio Comia asked K.O., "where he put his 'pew pew,'" after another apartment search seemed to turn up empty, according to the affidavit.

That's when K.O. led officers to a roll-top desk where officers found a Smith & Wesson SD9VE, the affidavit said.
