IN - Josiah Shaw, 13 mos, killed in Gary carjacking, 28 Jan 2008

The father, Terry Bethel, has been questioned in this case. He is currently being held at the Floyd County Jail. I have been unable to find out if he is being held for this incident or an unrelated matter. I will keep checking. I've gone all of the usual routes. Anybody know how to get some detail from his record? I have his Offender ID & DOB if anyone needs it. I don't want to post it because I don't know what he is being held for. However, from a news standpoint, this appears to be an unsolved case.
 
Did the mother ever recover, was she able to give any information about the shooting?
So sad!!! My money is on the father. Please tell me there's a special he)) for people like this!

Yes, the mother did recover. I was never able to find any information on what she saw. Other than the scads of reports on the original incident, there has been no follow-up reporting of any kind. It took me forever just to discover the father's actual name.
 
From what I could find from a few months ago, no one has ever been charged in this murder...I assume the mother survived as no mention of her, but there was a 2-yr anniversary memorial and as of then, no one was facing charges...unbelievable...

A jury trial in the civil case alleging the wrongful death of Josiah Shaw was scheduled to begin March 21 in Lake Superior Court Judge Bruce Parent’s downtown Gary courtroom.

But five days earlier, court records show, the case had been closed and charges dismissed.

Terry Bethel, Josiah’s father and Bethel’s brother Joe Noel were named defendants in the case.

Atty. Darnail Lyles filed the civil suit in September 2009. Lyles said he was approached a few weeks before the trial date by Atty. Scott King, who was representing the brothers and asked for a settlement. Lyles said the settlement agreement is confidential.

Dwight Taylor, a Gary resident and activist has held memorials and rallies each year since for Josiah Shaw and formed the Justice for Josiah movement, reminding the public of that night in January 2008. “It may be closed in civil court, but in the eyes of God and his family it is not closed. They won’t forget as long as the perpetrators walk the face of this earth,” Taylor said. “And we will continue to hold these memorials every year until there is justice for Josiah.”

Lyles said he filed the civil case because, “No one other than Bethel would benefit from the baby’s death. If I’m going to carjack, why would I take the car and then kill the baby.”

“Kwana was set up. Bethel told her to call him as soon as she left the friend’s house. She called him. And that’s when it happened,” Lyles said.

The Lake County Prosecutor’s Office said there was only circumstantial proof, choosing not to bring charges against Bethel.
