A man from Lafayette was convicted on three felony charges in the 2023 death of his 4-year-old nephew.

A jury convicted Montrell Jolly of neglect of a dependent resulting in catastrophic injury, aggravated battery and battery resulting in death to a person less than 14 years old, but told the judge it was hung on a murder charge against Jolly.


Wonder what happens now - can't find any other articles on this case.

Neglect of a dependent can be charged as a Level 3 felony if it consists of endangerment, abandonment, cruel confinement, or deprivation of necessary support and results in serious bodily injury. A Level 3 felony carries a maximum penalty of 20 years in prison and a $10,000 fine.
Neglect of a Dependent Is Not a Good Thing |

Aggravated battery as defined in subdivision (e)(5) is a Class X felony for which a person shall be sentenced to a term of imprisonment of a minimum of 12 years and a maximum of 45 years.
720 ILCS 5/12-3.05.

Level 2 Felony: Battery resulting in the death of a child under 14 or an endangered adult.
Penalty: 10 to 30 years in prison.

FYI, in case you cannot access the article due to being outside the US. I wasn’t able to find any other articles since his last jury trial near the end of July. See below:

The 12-person jury found Jolly, 35, guilty of neglect of a dependent resulting in catastrophic injury, aggravated battery and battery resulting in death to a person less than 14 years old. It could not reach a unanimous decision on Jolly’s murder charge after nearly five hours of deliberation that outlasted sunset.

Jolly waived his right to a jury trial deciding his habitual offender status Thursday.

The court still needs to decide whether Jolly is guilty of murder and of being a habitual defender. Meyer set a status hearing on the case for Aug. 1.

Such a heartbreaking story... and not convicted of murder?! How?

The "Similar Threads" on this page called my attention to the fact that we have multiple threads about children under 5 being beaten to death for putting their shoes on the wrong feet. 🤬 I hate humanity today.
