Man Accused of Raping, Giving Alcohol to 20-Year-Old Indiana U. Student Before She Died Mysteriously

Haven’t seen a thread posted here yet. So sad. The man charged has an extensive criminal history that involved violence. No murder charge yet that I see, but they’re still working to find out how she died.

This is my first time starting a thread, please let me know if I need to do anything differently.

…“Her roommate told authorities that she and McMillan had gone to a house party the night before where McMillan consumed more alcohol than she intended and grew frazzled and aggressive upon leaving the party together. The roommate attempted to have McMillan stay in the roommate's car together, but she allegedly refused, and got out without her phone, identification or keys, according to court documents.

Video surveillance between 2 a.m. and 4 a.m. that morning shows McMillan kicking and punching the doors of her apartment building, slapping elevator buttons, and losing her balance.”….

…”Surveillance showed Montgomery’s car entered the parking garage around 5 a.m. before exiting the frame and then leaving again nine minutes later, at which point McMillan is no longer seen wandering.”…


Montgomery claims they had sex, smoked, and drank together, and went back to his parents home. He says he called the cops when he noticed her condition deteriorating. Whatever happened, McMillan was obviously intoxicated and not able to make decisions for herself. Very sad that this happened to her. The teen and college years can be so scary.

Indiana University senior Avery McMillan's off-campus Aug. 17 death resulted in new rape and furnishing alcohol to a minor charges against 33-year-old Eric Montgomery.

Montgomery, who placed the 911 call, told deputies at the scene that he met McMillan that morning near campus before the two had sex in the parking garage of her building, smoked marijuana together and drank alcohol before they ended up back at his home on Arlington Road. He said he later found that her condition had deteriorated, prompting him to dial 911.

Records show Montgomery has several prior felony arrests, including a charge of endangering a person while driving intoxicated in 2019, domestic battery in 2018, burglary and credit card fraud in 2012 and dealing a counterfeit substance in 2011.

Oh my gosh….parking garages terrify me. I wish she had stayed with her roommate. But I have, even as an adult, been in the position of trying to “corral” a highly intoxicated friend and well… it can be like herding cats. This is so sad.

Agreed!! My sister and I are both “wanderers” — we go out and drink and then get sick of all the commotion and wander away to find a quiet spot….which is unfortunately a very dangerous thing to do in this world!!! At some point or another I think most people have had a night like Avery, and I’m so sad for her. Im also sad for her friend she was with, who probably feels just awful.

Avery McMillan died as a result of fluorofentanyl and fentanyl toxicity, Coroner Joani Stalcup concluded. Meaning McMillan died as a result of fentanyl.

Eric Manual Montgomery is charged with raping a neighbor in Ellettsville in August 2021.
The woman told police at the time that Montgomery had called and asked to come over because he was upset about a friend that had been killed.

In court documents, the woman told investigators Montgomery asked to be held while he cried and then began assaulting the victim and raping her.

Unfortunately, such terrible stories happen to students from time to time. I hope that the testimony of cameras and witnesses will allow an objective investigation.
