8/19/20 Update: Defense attorneys for Oberhansley & prosecutors met Tuesday for an online hearing with Clark Circuit Judge Vicki Carmichael after her court received notice that his competency had been restored during a second stay at Logansport State Hospital. Jury selection is scheduled to begin Sept. 8 with the jury pool coming from Allen County. Other charges hearing on 9/24/20.

I believe they held the hearing today but I missed almost all of it. I kept checking until 10:30 and they were not streaming but when I came back an hour later, they were.

I didn't have time to listen but I did catch they are still going to Allen Co. for the jurists, they will be wearing masks during the trial and JO (at least I think it was him) put in a request for a haircut before the trial.

JEFFERSONVILLE — The judge in a six-year-old Clark County homicide will decide if any mental health evidence can be permitted at the defendant’s second trial scheduled for next week.

During the hearing, in which attorneys wore face masks and spoke to the judge between clear partitions positioned at their tables and the bench, legal teams argued specifics around the mental health evidence, which Clark County Circuit Court No. 4 Judge Vicki Carmichael has taken under advisement.

Clark County Prosecutor Jeremy Mull requested the court allow no mental health evidence be brought before the jury, following a stipulation filed last year between the parties when Oberhansley requested to have the intent to use the insanity defense removed from the case, against the wishes of his attorneys.

Judge Carmichael granted the defendant’s request and Mull later withdrew his intent to seek the death penalty, filing instead an intent to seek life without parole.

Jury selection is expected to start Sept. 8 in Allen County, with attorneys seeking to secure 12 jurors and four alternates. During the trial itself, which will be held in Clark County, jurors will be spread out among the gallery seats to maintain social distancing. The open seats they will use were already marked Monday with numbers. All other seats were closed off with caution tape.

The public will not be permitted to attend the trial in person due to COVID-19 safety and space precautions; however, it will be live-streamed via the Indiana Supreme Court website.

I"m glad you asked... I have a list of cases I check just about every day; but this change must have come in at the last minute. I even checked the Supreme Ct site yesterday to see if it had been scheduled yet.

That made me laugh...

Reminds me of a recent case I was watching. They had all agreed to a plea deal, judge went over all the points and was to the very end where she said: 'Do you want me to accept your guilty plea?' and he said: 'No.' and then went on to say he was only pleading guilty to get it over with. So it was rescheduled.

During the trial itself, which will be held in Clark County, jurors will be spread out among the gallery seats to maintain social distancing. I haven't found anything else on this case. The timing of the filing may have caught reporters off guard... being a holiday weekend. I've even checked Allen County news but I don't really expect any news from there at this time.

Guess we will find at 9am ET - 4pm here... maybe just a hearing on the defense's motion to continue....

He's the only one on the Clark Circuit Court 4 calendar for 9 am. I know Clark Co. livestreams but I don't know if Ct 4 does.

Actually, I'm not even sure if that's just a marker for the beginning of the trial or if something actually happens with the attorneys, etc.

Clark Co came on and the Magistrate went first. He went through his cases and now Court #2 is hearing cases. This stream has an interesting configuration...15 frames are showing at once some are the defendants and some are attorneys. It saves time to have them all there waiting like what happens in the courtroom.

He only has around 15 to hear; maybe he will turn the stream over to Court #4 to hear what's going on with Oberhansley.

Clark Co has ended streaming, with nothing from court 4. Maybe it's a cost issue that only a couple of courts stream in these smaller counties.

I wonder if they will still go ahead with jury selection. Remember that Sandifur's trial was rescheduled due to Covid and another one jury trial I was watching was rescheduled, too. They gave the cause as C.R. 4... it that a Covid ruling?

I've been watching a couple of Elkhart Co. cases, trying to get a time frame for the sentencing. One is a jury trial on 8/17/2020 and that's the last entry. I can't find him in the Inmate Lookup or even a news article about the trial. The other one assisted a criminal who committed murder + failure to report a dead body. The judge accepted the plea bargain on 8/17/2020 and sentenced him on 9/03/2020. He got 3 years + 3 enhanced with 1 year suspended on the first count and 1 year, (suspended) on the second count. Plus other stuff.
