Is there any possibility of a Plea Deal on the Murder Charges?

I think that the State is normally happy to take a plea - saves lots of time and money.

plus you can never be certain with a jury trial. OJ Simpson? I think they're happy to just hand out some life in prison. this is not about winning, it is about justice.

on the other hand it could be down to just how much more the state knows than we know. if they could prove with a little more certainty than I currently have that KC taped that baby's mouth closed and watched her die, they will most likely get the DP they are asking for.

I suspect either way, plea or trial, kc will get life.

(dont get me wrong - the drama "hoor" in me is very happily waiting to watch a televised trial of dramatic ridiculousness. but it serves no purpose at all when it comes to justice.)

Anything could happen indeed. Although, I think the mood of Floridians will determine a lot as well. If the people are sending a lot of feedback to the SA's office one way or the other, it could influence their decision to offer a plea as well.
During OJ's trial, we were living in times of relative decadence. Not to say that salt of the earth people like those here at WS were not appalled with OJ-But none the less, some degree of tolerance for him was there, some level of comfort, resolution or satisfaction that the jury got from acquitting a guilty ex-icon.
Now, we are living in times of relative practicality, and I am not sure that acquiting KC would resolve a particular social ill in Florida. In fact, I think the opposite is true-I think now is the time that they will be most likely to convict KC, to send a message regarding the violence against children so often happening there.

I have no clue how to find out. :( I would NEVER have found this site if I hadn't googled *Justice for Caylee*. I don't wanna go O/T to far in fear of having a post removed. I'm still learning this site and it's rules. JB an Kim have been super though in trying to keep me on topic. I just can't figure out for the life of me why DC has been able to dodge that bullet so effectively. Why has he dropped from the headlines?

I appreciate your thoughts. I still think the DP is a good bargaining chip and it will be used in exchange for life and a plea. It takes both parties to broker a plea and I don't think it much matters who brings it up because both parties have to be willing to talk.
No cause of death is a problem for the prosection,imo and consequently makes the DP far from a slam dunk. that alone would be a good reason to perhaps offer life because no matter how good their case may be, I still think the DP is a stretch.
But I always qualify my DP posts by stating that I am strongly opposed to the DP on every level, so the DP is always a stretch for me LOL.

I've seen your stance before and have always wondered why (expense, morally wrong, religious...). Sorry to go off topic but my curiosity got the best of me this time.

I have discussed with case a lot with my prosecutor hubby and he keeps reminding me how common it is that a witness "will flip" in a case. I really wonder if Dom is potentially our "flipper"?? Not the dolphin that is! :crazy:

I am becoming more certain that there will be a plea deal for the murder charges.

How soon does the Defense have to notify the court that they would like a plea deal? Do they have to do it before a trial date is set, or anytime before the trial starts?

Defense seems to be going with their RK idea, or bluffing to string this out?

I believe they can strike a plea deal any time before the jury delivers their verdict. Both sides have to be willing to talk deal.
I do not think this will go to trial. jmho of course.

I agree. Given today's plea on the Check Fraud case the other shoe will drop.

It may take a looooooong time but unless there is a breakthrough in proving Caylee was dumped while KC was in jail or SODDI then there is no hope at trial.

I think JB wants his moment of glory at trial but given his recent performance at these hearings .... he should take a pass. He is not high profile murder trial material IMHO.

Absolutely agree - I think it will plea out for two reasons. JB HAD his moment of glory and now every time he opens his mouth he sounds like a complete duffer. He always did but now Andrea is around to tell him that - and he knows it, which is one of the reasons he is so nervous around her (like dropping his file on the floor).

And the second reason is the money seems to be drying up. If there aren't any big bucks in it - I think JB will take a plea and run.

KC is the one that has to take a plea, not the attorney.

Of course JBean, but I meant on her behalf. I'm feeling these days with Andrea around it isn't actually Casey who is making decisions solely by herself, but on the very strong advice from her attorneys.

Sorry I was doing 2 things at once. What I meant was that he can't take a plea on her behalf. She needs to understand everything and she and only she can make the decision to plea out if an offer is on the table. It doesn't matter what is going on with her attorney the decision to plea is her own, assuming there is a plea to take. The judge will ask her if she understand what she is doing and if she is taking it for any reason other than being guilty to the extent of the plea . the answers better be yes and no respectively or he may not even accept it.

Apparently,Jose said on JVM tonight that they will be going to trial for the murder case. I would assume he is speaking on behave of his client. We'll see....

Oh yes it is going to trial right now. I just mean I think there may be a ple deal before then.
Even if the state comes up with a plea deal, it doesn't mean that KC will take it and then a trial will be on.

Is confessing on the stand the same as taking a plea deal? If so, I think she will confess UNDER OATH, and tell her story about how and why she did it. She needs the venue to tell her story, AND say she is SO sorry about what she did, just like at today's check fraud hearing. Trying to gain sympathy from the jury.

she would not confess without having a plea in hand.imo.
Maybe the state will offer manslaughter and aggravated child abuse and she will get 40-60 years and have to give the details of what happened.
The state would get an assured conviction, she has no avenue for appeal (unless her representation proved to be completely inadequate), the state would save the cost of a trial, she would not be put to death, she would be in jail for a very long time and we would all find out what happened to Caylee.
