I disagree. We will see.

We will see..
I mean we have to get there first, the guilty verdict needs to be upheld and then things will get mighty interesting.
Let's not forget that Meredith Kercher is British and they may be a tad offended if the U.S. were to deny extradition. There will be many factors that come into play. I would hate the U.S. to jeopardize our treaty over someone like Amanda Knox. I'm sorry but as much as some don't want to admit it, she does not have a majority of the support here. Americans are very divided on this case and many that do support her only know what is reported in our MSM, that is partially controlled by a PR firm.

Why? <modsnip> She did not kill MK. That is RG and he is in prison for it.
I hope the US would fight for all our citizens who are unjustly convicted.

No, That is not true. It is put into the treaty to protect our citizens.

It is not put in to "protect our citizens" the treaty is written as only requested and requesting parties, it is written as a guideline to protect all.
Again I'll say it, Italy does have its own form of double jeopardy as well.

Why? I don't understand the hatred for AK. She did not kill MK. That is RG and he is in prison for it.

What hatred for Amanda Knox? There are many who agree she is guilty but it's not a hatred for her that drives that opinion. She did not kill Meredith in your opinion but lots of people disagree with you on that opinion. That is my point on why this is not the case for the U.S. to be setting a extradition precedent with, it's not worth it. This case is debated over and over with supporters from both sides of the table.

I see a lot of ill will toward her. Not just about the crime. I see a lot of hatred towards her. You may not think it is worth it but I believe when the experts all hash it out if they find them guilty again, That they will not send her back.

I see a lot of ill will towards people who believe she is guilty, in fact they are often referred to as "haters."
While I for one do not hate her, I simply agree she is guilty. I have followed this case since only months after the murder. I honestly went in thinking she was being railroaded and thought she was innocent. I have followed the trial closely and read everything from the court that was available, including books written on the case. I of my own accord came to conclusion she was guilty and would have no problem voting as such if I were a juror. That is why I hope they do extradite her.

Nobody hates AK, they just want her to be held accountable for her actions. Yes, she did. She delivered the final blow.

RG did not do this all on his own, the only other two people that could have helped him was AK and RS.

Bloody footprints linked RS to being there and a shoe print consistent with the size of AK's feet were found in blood. same size and everything.

I want to welcome everyone back! It is good to see everyone. I want to interject a friendly reminder before tomorrow's hearing. Passions and emotions tend to run high with this case. I don't have an issue at all with people who may think she is guilty and if that is all there is, That is everyone's right, <modsnip>
I don't believe she is guilty at all.
We will see how that all shakes out.

I can do the same thing you just did, did you happen to the read the article I linked?
From it
"The only legal argument that Knox, her lawyers, and other advocates have made thus far is that she should be protected by America’s commitment to preventing double jeopardy. They claim that Article VI of the U.S. extradition treaty with Italy incorporates the American meaning of double jeopardy. But the Article only relieves the U.S. of its obligation to extradite if the subject is charged with the same crime at home. Even if the Double Jeopardy Clause of the Constitution were in question, it would offer Knox scant hope.

After reading the actual treaty, the BBM is my understanding as well.

I don't get how folks who say they have followed this case all the way through, don't understand that she was acquitted. The original guilty verdict was overturned. Don't believe me? Google any article the day of and the days following the verdict. I believe it was October ??, 2011
She was set free after 4 years in prison because the guilty decision was overturned. Then the corrupt justice system had to save face and go after her again because that is what a corrupt system does... It allows them to convict whoever they want.
Now, as far as double jeopardy and extradition, we can all argue til we are blue in the face. All we have to do is wait and see what happens. If there is any justice in this world she will not be going back to Italy. Unfortunately RS is in a different predicament and his life is truly on the line, hence the reason why his defense team is distancing him from AK.
If you are waiting for RS to come clean and tell the truth, you will be waiting a long time, because they both have been telling the truth from day one.

Amanda Knox is not Casey Anthony. She is not Jodi Arias. That is the problem here. Folks look at AK and see those two lunatics. The reason for that is because of a smear campaign brought against her by the corrupt prosecutor Mignini. He did THE EXACT SAME thing before AND was convicted!!
It ain't rocket science to see what went on here. IMO

Thank You for this. I completely agree. We will soon find out if the prosecutor will get away with corruption once again.

<modsnip> smear campaign back in 07-08 by prosecutor Mignini. I think what we are dealing with here are folks who didnt start following this case until the trials. And after AK was aquitted the tone from the american media changed because it became obvious that she was set up by a corrupt system. Initially, the media was very anti-AK.

There really is no need to argue over extradition and double jeopardy. We are going to find out the answer. And I will go on record to say she is not going back to an Italian prison.

From the Daily Mail 3-25-15:

Knox's lawyer Carlo della Vedova described her client as 'very worried' about adding: 'She hasn't been sleeping much.'

Della Vedova also scotched rumours that the American had been trying to get pregnant to avoid possible extradition.

'That is absolutely false. She is not engaged either,' he said.

So according to AK's attorney, she is NOT engaged, but there was a story recently that said she was ...

The misinformation in this case is unbelievable !

:moo:

Any misinformation has come from the prosecutor in Italy.

No it has not and btw Mignini is not involved with this case anymore. He was only involved during the first trial back in 2009.

There is more than one prosecutor. moo

The american media back in 2007 was very pro amanda.

You know what I hate about crimes like this? Finding unbiased information. It is harder than you think. So when you go looking you have to swipe and move on a lot to get to the truth. For me the facts I have seen I believe she is not guilty of this crime. I can not one smoking gun that puts her in that for me.

  • #238
Yes it is. I understand that and it applies here.
What matters to me is that if this ridiculous court calls her guilty again and tries to extradite her, that the US says no. And I think they will.
The treaty has a clause that they do not have to send anyone back when double jeopardy applies as it does here.
So I don't care for the Italian system. I am completely thrilled that my Great Grandmother and Grandfather moved here and no one I love is subject to this system.

If the Italian courts are "ridiculous" for their laws and criminal justice process, then the Canadian courts and many European courts are equally ridiculous. That raises the question: if so many countries follow a "ridiculous" justice system, and the US is the odd man out, can it really be said that the US system is correct and another widely practiced justice system is ridiculous? I think that Canadians might take issue with the suggestion that their justice system is ridiculous.

Knox has not been subjected to double jeopardy in Italy, so there is absolutely no reason that she should not be extradited to serve a prison sentence in the event that the guilty verdict is affirmed. Should US citizens be allowed to commit murder in foreign countries and then complain because US laws don't apply to that foreign county? Essentially, that's the situation with Knox.

I am not getting into this argument. I find the Italian system ridiculous and slanted toward the govt. Here while we have some guilty go free, the system is set up to protect the innocent. It does not matter if their system calls it double jeopardy, ours would.

I am from Nebraska. If I go to Colorado and buy pot and bring it back to Nebraska to smoke, can I insist I be tried by Colorado law since I purchased the pot legally?

It's my belief that when you are charged with a crime, you are held to the law of the jurisdiction a crime occurred.
