I agree completely!!! BH was not at all prepared for the cross on JY. I could not believe she completed her cross in under an hour!!! To be fair she only had the lunch hour to prepare and she had no idea what he was going to say when he was on the stand.She did have one line of questions that IMO were effective. JY had said he was working on his marriage with MY. BH asked, "Were you working on your marriage when" she then repeated this with all the examples of extra marital activities etc. That was the only part of her cross that to me was effective.
Grammy Jean, I don't think this is entirely true. The state went to great lengths to discredit Mrs. Beaver and I thought they treated her horribly. If you listen to her testimony, you will hear how she was bullied over the years when giving her statements and how there even came a time, she wanted to back out. She couldn't take it any more. I am sorry, but they were really rough on her and the court allowed it. Her testimony never wavered and she knew what she saw. She lived on that street for 21 years.
A busybody would have been down at the Youngs house later that day butting in and giving her information. She never did that.....

That would explain why you are so familiar with the evidence from a critical perspective ... in my opinion. At one time, you must have looked at all the same evidence and accepted it, only to each time see a small loophole ... but letting it go because there was lots of other evidence. Did you at some point realize that there was actually a small loophole (eg: the gas attendant has a verified unreliable memory) in almost all the evidence? I'm not one for looking at the facts independently, rather than as a whole, as it is the sum of the parts that matters. However, in this case, each sum has a weak link such that eventually, the sum of the parts does not add up.

"Something to do?" Ever try to read a newspaper outside at night, in the dark, in windy conditions? How did that work out?
How was he able to hold the newspaper and smoke a cigar at the same time? Remember the wind was gusty that evening -- he went into great detail about how he had to light up an entire match book in order to get the cigar lit. Where was the newspaper then? Finally, how would he have been able to see anything as small as sports scores in the dark?
More flotsam.
There was so much that changed my mind, but, mostly when we hit trial though and were able to clear up the "rumors". That did it for me. Also, Jason testifying, I found him to be very believable and if a small detail was missed here or there, it was minor. It was years after the fact.
But, the big thing, is this case never had that big gotcha moment, where you can't just argue or excuse something. In this case, the gotcha moments were supposed to be a camera, (that had been tampered with before) a rock, a shirt that could be anywhere, and a pair of shoes that even Karen Morrow(expert witness) could not say if the prints came from.
For every piece of evidence there was an explanation.
JY's prints in the drywall............no way to know how long they had been there.(Freeman)
The state trooper who investigated the car accident and testified to such (Hicks)
The hair in Michelle's hand, did not belong to JY, etc, etc.
And the search warrants kept coming with the media playing up the dramatic headlines.
The Other woman, Young's in financial peril, Large insurance motive in the Michelle Young case.

JY's character being attacked at every level to make up for what the state lacked.
It just went on and on....and then the state's eye witness. Do you ever wonder how they were going to make this work. Their eye witness , one of the biggest pieces to the case, they even told her so, they told her they needed her. How was she going to hold up under cross, after the Jury heard she was brain damaged and had memory problems and the witness who witnessed the encounter could never be found. I bet they were worried, I wonder how she will do in Trial 3?

I didn't know this came up in testimony. An insider/family friend posted it.
Thanks ... the thing with the witness with memory issues ... I think it is a fact that she no longer has any memory of the event. It has been so many years that even someone with a good memory will lose some clarity of memory. It believe that the only way that witness could testify again is if she is told what to say.

I am sure LE were tough on her to try to break her down. That in itself is a shame and that is one reason why people don't want to get involved My daughter knows CB's daughter and CB has gone through a lot of grief from people. I know she wishes she never got involved.
I do believe she saw what she thought she saw I just don't happen to think she saw it when she thought she saw itI will admit this may be my bias as I am a believer that JY is guilty.
His stepfather said he went with Cort. The State's attorney was taken aback. Made me lol because I could tell he/she was flustered.
How do you know she has no memory of the event? What do you base that on?
No, I am saying this is something that was overlooked. However, I still have not listened to the ME testimony about how someone found face down could have their blood pooled on their back.
I remember the DA discussing why he went to the front desk a second time. They surmised that he got confused and took the wrong set of stairs to the first floor. He was forced to make an appearance there. Conjecture, yes but it was presented.
