It was part of the appeal, but the court overruled the defense on this - so Cassidys behavior and comments will come in at any subsequent trial.

I understand that. But I hadn't read the appeal until yesterday. And before that the way some posters were talking is that part of the appeal was due to CY comments. So therefore, I assumed they were right. It wasn't until after reading it I understood that the reason for the appeals was because the court erred in admitting the custody case and the civil suit. Those 2 things only!

I have never once loaded up my laptop, taken it to the car, then while in the car removed the power supply from my computer bag for the drive to my destination. And I'm talking about daily commutes for xx years. You just don't take the power supply out of the bag until you get where you're going, unless you're plugged in at an airport or elsewhere along the way. So this is likely another lie.

I believe he left his room to scope out cameras, entries/exits. He made up the "went to the car to get my charger" bit, along with the rest of his story, once he knew what the State had as evidence.

Furthermore, a frequent business traveler learns quickly to "leave room - take key card." It becomes 2nd nature. You learn from the first (or second, if you're slow) lockout.

As far as not closing the hotel room door because he didn't want to disturb any potential neighbors? Really? This guy who does "dick-tricks" and gets naked at gatherings, and is disruptive to the point of being excluded from social events, all of a sudden becomes Mr. Considerate of Others, those "others" being both strangers and not even known to exist in the adjoining rooms? Alrighty then!

Speaking of oddities, neither Josh nor Shelly ever asked him if he did it. Ryan Schaad, the BFF, arranged for JY to meet with Roger Smith (criminal defense attorney from a well known firm). They immediately thought he was in need of an attorney. And yes, this was because their answers to law enforcement questions did not put JY in a favorable light, per his BFF's. And they withheld some (negative) information from LE at first, such as the fact that JY was having an affair and felt he was in love with Michelle Money. They withheld this (key) bit of info from LE on November 3, 2016. Seems like they were trying to protect him. Why would BFF's try to protect him and make sure he didn't speak to LE? Because they thought (or knew) that JY was involved. IMO.

I take my power cord out all of the time when I am on a road trip because I have a converter so I can plug my laptop into my cigarette lighter. It would make sense he had a converter as well.

He would have no idea where the elevator camera pointed.

I forgot my key card all of the time as a frequent business traveler.

Was he drunk as a skunk when he was going out the door, or doing a dare?

The attorneys knew he had no alibi during the night. Many people have no alibi during the night. Therefore, it makes sense not to talk.

I've never called someone 20+ times in a row. Not even when my brother had been found dead (heart attack). A dropped call I'll try again and 2 more times. Then I stop until I have a better connection. Or sometimes I'll wait until later when I can use a land line. 20+ calls to his mom indicates urgency, a need to connect right then and there. Something had him dialing overAndoverAndover to the one person he knew he could count on, unconditionally. I believe it was very much about his need to get someone over to his house to get his daughter. Pat calling MF was something that never happened before. Another unusual occurrence that day that Michelle was killed. Urgency over an ebay printout.. not buying it when we know he printed the map at the same time and then took the map with him, leaving the ebay printout.

Just because you do not do something does not mean that your way is the normal way.

Why? We dont know anything about them or why they were in that driveway.

Good point. Why didn't law enforcement find them?

That would be 8 Jurors !! It was 8-4 for an acquittal. I felt the prosecutor(BH) let JY get the best of her. She was so angry for not being prepared!! Now, that I think about it, she did tell the Jury in the 2nd trial about how many days he waited to talk, so that was an indirect hit on his right to remain silent.

Yes I agree. You would think that after waiting to take this case to trial after so many years shw would have been more prepared. It did upset me. SHe had her chance and it was like she walked on eggshells with him! IMO

I use mapquest and other apps all the time. I look at routes and timing to plan. But I never print until I'm ready to leave.

Besides, to get to Galax or Hillsville, you simply take I-40 west and turn right at Winston Salem. And he had just been in the area of 4 Brothers when his BFF recently got married.But yeah, print eBay and directions stuff, then grab only the directions? Speaks clearly to the premeditation of this crime.

Really? I don't remembe that? Does anyone remember how long before the night of 11-2-11-3 2006 had they started turning the pumps off?? TIA

Why did she have posterior livor when she was found face down? If she was face down, livor shb anterior.

I've read it twice and see no mention of liver. Can you please direct me to the specific part that states this? TIA

Back on April 1st, when the information was released , it was posted here @WS the reasons for JY being granted a new trial. It is on Thread 1, Page 1.,,,,,,,,,,,,,,,,, 2 .5 months ago.

Also what his computer did show that night was Jason on sports sites not ( as you stated) using his sales software as JY testified to on the stand. JY also testified the reason he went down was to check sports scores from the USA Today a day old paper when he had just been on sports websites. IMO another big JY lie.

He got the USA today to take with him to read while he smoked.

Why did he wait until last minute? I am sure he knew the general direction he was headed to but why not know exactly where ahead of time? This meeting was set up weeks in advance.

To me, this just proves JY did not plan anything, not even his trip. And this is exactly how JY was described by friends and family in court testimony. He was not a planner.

Another thing, and I have to look this up to be positive, but after he made the gas stop before he left Raleigh, he talked to his Mom almost all the way to Greensboro, NC (Cracker Barrel), then he spoke with MF and then he had some other calls along the way before he reached Hillsville. Basically, he talked on his cell the whole trip, so I don't find anything out of the norm by calling his Mom the next morning and planning on talking to her some more while he drove. This trip was not just straight highway , it was through the mountains and cell phone reception was bad and probably getting worse as his travel continued.
Phone records show he was pretty much always talking to someone, MY, MM, and his friend DB, soooooooo, when did he have time on his trip to plan the last details of the murder?

One way to judge the credibility of Jasons testimony and alibi is to see if there are any lies. One that comes to mind is that Jason said he went to his car to retrieve his charger and reviewed his sales software until 11:53, but computer forensics shows that he did not use his sales software that night.

Can you post the link to the testimony of the computer forensics person who found he did not look at his computer that night? I listened to the testimony of two computer forensic witnesses, but did not hear it.

I agree completely!!! BH was not at all prepared for the cross on JY. I could not believe she completed her cross in under an hour!!! To be fair she only had the lunch hour to prepare and she had no idea what he was going to say when he was on the stand.She did have one line of questions that IMO were effective. JY had said he was working on his marriage with MY. BH asked, "Were you working on your marriage when" she then repeated this with all the examples of extra marital activities etc. That was the only part of her cross that to me was effective.

Yeah thanks. But what I was referring to in my post is that some posters were making a big deal about CY excited utterance and the daycare workers testimony and saying it wouldn't be admitted next trial due to the appeals decision. But the court sided with the state on that part. So more than likely we will see it again at the next trial.

JY did use his computer. According to the expert he was on sports websites. I will try to find the link later.
Anyone following the Seth Mazzaglia trial. It makes the Jodi Arias trial look tame!!!!

What I remember is that Jason claimed that he needed his power cord because he wanted to review his presentation for the following morning. I believe that a search of his computer revealed that he did not review his presentation.
