I certainly think so, yes! Winning the appeal was a really big deal. Being able to have renewed optimism about regaining freedom would certainly feel different.

I think I read that the CoA only overturns convictions in about 1-3% of all cases appealed.

So you know he is psyched? Even though his daily routine hasn't changed? He feels a difference?
Surely not a physical difference? A psychological difference you mean?

Roger Smith did not represent JY at either trial. He had public defenders, Bryan Collins, who is now a judge and Mike Klinkosum who was involved somewhat with the Innocence Project which overturned Greg Taylor's case in NC.

JY has hope anyway.....a very good chance at least of a Trial 3, and probably making bail..
So, I would say he has something to look forward to, that, and clearing his name.

Here is a gotcha moment for the defense!!

The pdf says that if Jason killed Michelle leaving CY behind, he would not want anyone else finding CY risking having her say she saw him..........Page 48

Brillant and this is why they got paid the big bucks. Never thought of this.

CY didn't see him. She was sleeping.

That's right. However, there is no door between the kitchen and the garage. There is a cased opening between the kitchen and the stairs that lead to the garage.

And this is exactly what I said earlier. BTW I don't care how many floor plans you post, I will stand by my assertion you can see through the kitchen and into the den after coming in from the garage and turning left.

CY was only 2.5 and I also don't think MY would leave her purse on the floor, no matter how clean the floor was....Purses, pocketbooks don't go on a floor, especially if there is no carpet..not when there was a shelf or counter or even a chair or stool right there. It almost looks like the purse was put there in plain view, like look "no robbery"......

Have you seen the other photos from the crime scene where things have been re-arranged.......clothes in the laundry basket, remote controls, things in and near MY's closet upstairs on the floor and on the doorknob.....there are photos of things being moved, who did that?

And, if they did that, then MY's purse could have been moved as well!!!!!

If you notice it is next to other bags and CY's shoe is on top of one of them. The entire pile looks like it was dropped there intentionally. Weren't car keys found on the counter?

JY would know where MY routinely kept her car keys.

The State would disagree with you. They assert that he cleaned her up so I don't know how he cleaned her w/o her seeing him. Someone cleaned her.

(They also assert that she witnessed the murder via the daycare testimony)

Otto and perhaps he really didn't want to do any of that? Perhaps this is what made him cheat on his wife? Complain about her? Talk to her like garbage? A lot of men feel pressured into marriage and being a father very often, and almost always when I wife is murdered and the husband is guilty these are the number one reasons. He was a crappy husband we know that, does it make him a killer? He was found guilty.

He was found guilty after an unfair trial.

Nobody testified Jason was pressured into marrying Michelle. In fact, I think they actually had two ceremonies.

Some people might think that discussions about an unplanned pregnancy are more important than actions that follow that discussion, but I'm of the opinion that the actions speak much louder than words. They did get married, they did plan a family.

Well we finally agree....actions speak louder than words.

JY's actions do reflect his feelings for Michelle. He berated her in public and around friends, demeaned her in public and around friends, talked about their sex life, evn saying he was "glad they were trying for a baby so he could "get some."

He removed his pants in friends homes, he pissed in his pants and on the floor at friends homes, and his famous penis tricks. Wow oh wow his actions DID indeed speak for themselves. He had not one ounce of respect for Michelle Fisher Young....not one!!

It's not that a 2 year old child is a poorly behaved child at the time of challenging boundaries. Two year old children normally push the boundaries because they are learning. It is normal for a 2 year old to do the opposite of what that child is told. That said, Jason's daughter understood that biting resulted in a spanking, so clearly she had some experience with misbehaving.

The prosecution certainly did not try to state that MY routinely kept her purse in the path of the kitchen floor/doorway because it simply isn't believable. There are bags right next to it that had one of CY's shoes below it and one shoe on top. Plus, CY's doll is on top of the kitchen counter right next to the doorway into the kitchen from the garage. All of it gives weight to the cop's theory that CY was taken out of the house.

All of the discussion about the purse won't get us anywhere but I agree there is something odd about it being on the floor. With a desk right there and this is a big house, there would be no reason to set a purse on the floor.

MF mentioned the purse in the 911 call so she clearly wanted to draw attention to it it seems.

Did MF mention CY's shoes right next to the purse?

Yes, but it doesn't really matter because foreign prints were found on the medicine cap in CY's room and on the jewelry box and no one cares. If they found foreign prints on her wallet, they would say, "who cares?" too. I do hope they run them through the databases again to see if they get a match before a new trial.

Jenna Nielsen's murder remains unsolved so cops need to run those prints through again whether or not there is another trial.

This was an incredibly sloppy investigation. There needs to be not just a new prosecutor but a new Sheriff in town.

I just tried to answer this thought by thought. Hilighted my answers but it didn't work. So here we go.

Exactly when had he spoken to an attorney by phone? Where is that documented? The info we've had is that they were still searching for someone in the evening.

What killer has ever planned the perfect crime? People make mistakes.

Has your distrust of LE precluded your calling them if you need them?

The state resorted to unlawful tactics? Do you mean introducing the civil suit or is there more?

Why does it need to be documented when Jason spoke to his attorney? Nobody needs an attorney to invoke their right to remain silent.

It would strengthen his alibi about when he left Birchleaf, CY certainly would not be able to verify this.

When he left Birchleaf didn't matter. His alibi covers where he was at the time of the murder. He also made phone calls to the home and to other people that could be tracked.

Jason couldn't control the ME's office. Michelle's body was found within hours and the ME, if they had done their job correctly, would have been able to more accurately pinpoint the time of death.

Perhaps this will help in terms of understanding the location of the purse in relation to the kitchen, the hallway that leads to the front entrance, and the dining room.
