was I surprised by this? Not really. His original conviction was overturned only on a mere detail. He should have avoided this whole thing and tried to see if he could plead guilty to murder second in exchange for a truthful recollection (including his daughter). Although its certainly possible he tried doing it and he got rejected. So who knows.
