He was the first prosecution witness in 2004, and 14 years later, he took the stand again to talk about what he saw as the first deputy to respond to a missing persons call that would end up being one of Mesa County’s most notorious cases.

Looks like they started yesterday about 9am, as the tweets were posted about 10am. Thinking the Prosecutors went one hour with their opening statements. :dunno:

I think that "Monday afternoon" comment was a mistake Niner. The article written at 6pm says it will resume Wednesday morning.

There won't be tweets during court sessions because the judge has banned tweets. Reporters have been told they can take notes and report later.

The later article says there were 5 witnesses yesterday, which I will summarise because of the 10% copyright rule.

1. Mesa County Sgt Tim Orr was the first to arrive at the house after the 911 call. He said Blagg was standing outside and although he said he wasn't ok he wasn't crying. He went into the house to look around with another officer.

2. Sgt John Coleman also went into the house. He decided to call in detectives.

3. K-9 officer Geraldine Earthman was off duty that day but she attended with her dog Zara. Zara picked up scents of Jennifer and Abby near the garage door but nowhere else. The defence said that wouldn't be unusual because J&A used the garage entrance every day. It's a bit confusing for me because Earthman didn't actually go inside the house, and also J&A's scents should have been in their own home. I'm wondering what type of scents this dog is trained to detect, it doesn't say.

4. Jackie Fasnacht (Abby's teacher) said Abby never showed up for school.

5. Glade Johnson (Deputy) interviewed neighbours and recorded video of the crime scene late that evening. A fan was running in the bedroom. Abby's school uniform was laid out unworn. The defence is arguing mistakes were made.

Johnson will return to continue cross-examination Wednesday morning.

I'm going to be the odd man out here and it's not going to make me popular. :facepalm:

Not defending this guy, I don't know if he's guilty or not. Just don't like convictions when there isn't enough evidence. :gaah:

I remember when this crime happened, I also remember watching a Forensic Files or similar show about it. I've never seen the "smoking gun" that proves he did it.

Is there proof Abby is dead at all? Odds are slim sure, but what if this another Groene type case, except Jennifer was tossed in a dumpster? I would never be able to accept Abby was dead until it was proven. I would be terrified she's out there waiting to be rescued.

I don't have much doubt in my head (if any) that Blagg is guilty, and that the original jury got it right, but the evidence whilst strong enough for me, might not convince everybody. Great shame that they never found Abby, but credit to LE for the enormous effort they put into finding Jennifer. Hopefully where she was found will help convict him again.

For the life of me, I cannot understand why the fact that a juror has experienced partner violence should influence whether they sit on a jury in cases like this. I understand that this is the procedure and she did not disclose information, but why should that action of one person overturn a verdict? Presumably they reached a unanimous verdict, and the point of having a jury is that you have a random mix of people with different experiences. Just seems almost designed for defence lawyers to find another excuse to overturn a conviction, and for needless expense.

Hope Michael Blagg doesn't get so lucky this time. Tbh, after I had heard his first answerphone message to his wife on the podcast, I was convinced of his guilt! Ultra creepy and phoney.

The reason that it was overturned is because it only takes one juror to hang a jury.
So if that juror had been eliminated as she should have been, her replacement may have acquitted him.

I worked on a similar situation a few years ago. Juror misconduct was found after the guy was convicted on half of the charges. The jury had "compromised" and convicted him of half. Even though the circumstances were that he either committed all of the crimes or none. Also, he faced life in prison whether convicted of 1 or 70 charges. It was utterly sickening.

After trial it was discovered that a couple of jurors had an abuse history they lied about and a couple others were texting alternates during deliberations. His was overturned and the prosecution gave him an awesome deal that sent him home immediately, rather than retrying him. (I fully believe he was innocent so this was a good thing.)


Russell last year also curtailed an attempt by Fang and Troxell to introduce a new potential alternate suspect to jurors: Phillip Bruinsma of Whitefish, Montana, who was recently sentenced to two 100-year prison terms for child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬 and sex assault-related charges. Among Bruinsma's possessions, Jennifer and Abby Blagg's names were found written on sticky notes on a list including details about several other missing girls. But Judge Russell ruled in September that the defense did not make a strong enough connection between the Montana man and the Blagg case.

I think this was a mistake. They should have allowed them to point at this guy. The prosecution could have brought in proof he wasn't in the state at the time if they wanted.

This is a guy who's been convicted of crimes against children and has their names written on something in his possession. He's not an innocent guy down the street who should be protected. Does that prove he did it? Of course not. However, it's an issue that can be raised on appeal. In the interest of avoiding a 3rd trial, it should have been allowed.

Has anyone attempted to interview this guy?

A husband and wife fought? :shame:
It is totally reasonable that they fought on Friday about the 🤬🤬🤬🤬 addiction.
Then he wrote her the apology letter that they later found.
The prayer request sounds like par for the course in this household.

I don't understand how ANY of this proves he killed her.
I know it sucks when there isn't enough evidence, but if there isn't enough evidence the guy shouldn't be convicted. :twocents:

This was the first time Campbell, who usually usually worked out of the Mesa County Sheriff’s Office, had been called to an actual crime scene.

She was there on Nov. 14 and 15, 2001 and took directions from investigators about what to bag up.
Among the items was a 22-caliber handgun found in the closet of the master bedroom and a note taped to the bathroom mirror.
The note was an “urgent prayer request” written by Jennifer Blagg asking that Jesus give her the “keys to peace.”

Underneath the text was a footnote from Jennifer Blagg.
“Fought with Mike on Friday,” she wrote. “I unexpectedly got sick this weekend … but staying home from church blessed me with Stanley’s ‘Key to Peace’ sermon.”
Prosecutors say the Sunday before she was murdered, Jennifer Blagg watched a televised sermon from Dr. Charles Stanley called “Why We Lose Our Peace.”

Your argument that he might be innocent is the same argument why this evidence was not allowed....defense did not have enough evidence for a connection.
