Baez saying LE not wearing protective footwear...

Duct tape out of the bag and the witness is reading the imprintation on it.

  • #23
Witness is reading the words on the duct tape. Henkel 200 degrees F. "That's all I can make out."

  • #24
JB & ICA are both looking a bit worried about these envelopes being opened... this is great! Duct tape first, and now we're onto her little tiny tattered shirt remains. IMO you can definitely tell from ICA's face that she is remembering what she did, she looks very angry and just shook her head no.

you may

(JB has a thing about taking witnesses down)

how far

I don't know, ask Mr Murdoch for a diagram

was it area A? was it ten feet away?

ask Mr. Murdock

But it wasn't the area where the bag and the skull was?

that duct tape appears to be the same kind of duct tape as the one found on the skull

it has the same imprint

yes

JB states there is a stipulation as to A-L through A-S being entered D-18 thru 25.

DIRECT EXAMINATION OF CSI WELCH BY JB:

She was in charge of documenting the scene on Suburban Drive. There were a large number of disposable items, trash. A lot of them were collected. Over 300 items collected. She did not recall when they stopped collecting.

She is familiar with the lanes and the baseline.

Any bones found past lane 6, 45 feet from baseline? According to her diagram, there did not appear to be any.

She was shown photos of items collected.

D-24 did not recall this being found thru sifting, but through clearing and searching through the vegetation. She did not recall any of this being submitted for further examination.
D-25 - other items collected. None sent to lab. Photo indicates they are misc items collected from lane 4.
D-23 - other items collected. None sent to lab. Came from Lane 1.
D-17 - identified Lane 1 and Lane 4.
D-21 - other items collected. None sent to lab. Came from Lane 3.
D-20 - other items collected. None sent to lab. Came from Lane 3.
D-19 - other items collected. None sent to lab. Couldn't tell where collected.
D-18 - other items collected. None sent to lab. Came from clearing area east of wooden fence. She marked that spot generally on Exhibit 17.

No further questions by JB.

CROSS EXAMINATION BY LDB:

DIRECT EXAMINATION BY DS:

CSI for OCSO. End of day report for 12/14 showed that ground vegetation had been cleared. She did not remove anything from the scene to take her photos of the remains.

PHOTO marked as Defense Exhibit 27. This photo appears to be the scene after the vegetation had been cleared.

Page 5 of her report - a log was located directly near the skull. During process of clearing and moving vegetation, the log was moved by S. Hansen and S. Mears on scene.

Next photo marked by clerk. She recognized it as an accurate representation of the scene after the remains were found.

OBJECTION BY JA as to when photo was taken.

This photo appeared to have been taken after hanging vegetation had been removed out of the way to no longer obstruct the view. Photo marked as Exhibit 28 and was published to the jury.

No further questions.

CROSS EXAMINATION BY JA:

Exhibit 27 - what portion of the scene is this? It appears to be a photo of the scene, but can't tell precisely without looking through the sequence of her photos.

No further questions.

REDIRECT BY DS:

How did you identify the grouping of photos? She took the photos and then uploaded them into the digital crime scene system and the system gives them a call ID number. She did not create the number, the system does. She has the numbers with her today. She does not have a call ID # 1838. She has 1840, 1842, 1845, 1849, 1893, 1903, 1913, 1919, 1923, 1934 and 2088.

No further questions.

Witness is excused at 9:31.

DS w/Jennifer Welch -

On 12/14/08 I made observations - cleared of leaf litter and vegetation ... and tree roots cleared 0-10 inches....

read last sentence of end of day observations - (see above) took photos @ scene when arrived - did you alter remains or anything touch remains....veg around the area was cleared - cut and clear away vines and roll them back.....

Photos are entered in data base under call ID numbers- call ID #1932 - she did not have a record of that....pics of scene after vegetation cleared...

show pic to JW - appears to be - photo represented vegetation had been cleared....it appears to be scene after vegetation cleared...

DS - in your report on pg 5...reference to log or tree near the remains what happened....log located directly near the skull during process of clearing - log was moved by Steven Hansen and susan M on scene...

DS another pic - to publish to witness - photo of leaf litter - from looking @ photo after vegetation had been moved away....no longer obstructing view....hanging vegetation? yes just moved it out of way - did not take it off the items....

admit into evidence - publish to jury.

DS that is all she has of this witness...

Cross - JA

republish pic - what portion of the scene this is? some object was found?

JW- does appear to be photo of scene = without going thru sequence of photos cannot tell where skull was....

redirect:
DS - how did you identify the photos?
Jw - don't understand question....

DS - series of photos -
JW = photos taken and when uploaded into system - call ID number is given - system created number - she has the numbers with her today....if she read them could she verify the number of photos but not which day....12/11 thru end of investigation.....#1838? no number....#1840......on and on

DS thank you..

witness excused subject to recall
