His hand-holding of her victimology is infuriating me! What I can giggle at is at times you can tell he wants her to say something consistent with having been abused and she just won't. I do so love that.I heard that too. I agree, the leading is obvious. I can only imagine that JM has a plan that makes all of that negligible. Sometimes I think that if one went after everything, we would be mired in this crap forever.
On the HLN show an hour ago, a defense attorney was really criticizing our Juan for not speaking up and taking more control of what is happening in the courtroom, stating there are many appealable things happening and he should be protecting the case in the event of appeal.
I'd like to hear the opinion of our verified attorneys here...do you agree?
I know we've all talked about letting her ramble, that it just gives Juanderful more to cross her on.

I think Juan is saving his objections for the more serious screw ups by Nurmi. IMO the judge is pretty lenient with Nurmi. I commented yesterday on Nurmi's "objections to the objection". To me it's downright disrespectful to the judge AND the prosecution. Juan at one point yesterday even said to the judge "I object and you rule on it, that's the way it should go". It must be somewhat frustrating for him JMHO.

But I believe she is going to try the Betty Broderick approach. Remember how Betty Broderick testified that she had a gun on her person because her plan was to kill herself in front of her ex husband? Then she gave some drivel about how there was a movement in the room, the gun went off and "everything was just a big blur"?
I think JA is going to try the same thing. I was going to kill myself in front of him. He wanted to have sex and I through that meant he really wanted me. After, he called me names and I got upset. Then he attacked me. I grabbed the knife (used to cut the ever so soft bondage cordage) and stabbed him to protect myself. But he kept coming. I had to shoot him to save myself. It was all a blur.

I cannot imagine trying to defend JA. I am impressed that the defense was able to come up with and follow through on a defense theory, as ridiculous as it is. Nurmi has been more successful that I ever thought possible in decreasing the chance that JA will get the death penalty. This endless recounting of the minutia of JA's life through the voice of a frail, victimy, low self-esteemy JA could well work on one of the members of the heavily male jury. The pedophile allegation went too far but I think Nurmi is otherwise doing an excellent job. He really has so little to work with.
I am dying to see how JM approaches cross-examination. I would love to know how he organizes his thoughts in preparation for this- JA has given his so much to work with.

Nurmi cannot complain on appeal about his own questions and his client's answers. If error is committed through Nurmi's questioning, that would be what's called "invited error", and Nurmi can't use it as an appeal point. So I don't think there's anything Juan could be doing differently to protect the case from appeal points.
I do think Juan was objecting initially to relevance, and he was overruled several times. Clearly the judge is allowing a lot of latitude to the defense, and this is not something the defense can use for grounds for appeal.

Nurmi's attempt at prosecutorial misconduct. His suggested remedies - mistrial/remove the prosecutor/ or remove the death penalty. Denied.
I actually think Nurmi has helped Juan to put her on death row.
Juan is going to tear her up on cross with the never ending lies and inconsistencies so this jury is going to know she will lie about Travis in order to save herself.
I think the jury is going to be furious that she not only murdered Travis so heinously but also tried to smear him in death to get her sorry pathetic a** off.
