OMG do you think she gave the stolen DVD player (or sold it) to DB and that is the remote she took to him after Salinas? Sorry if this has already been discussed...

It is hard for me to believe that MM or DB could be that deep into her cover up. Do you all really believe this? I do believe MM knows all about the forged letters. But DB has a son to protect. Actually I think MM has a family now too. Wow. Just wow. If they did help her cover up her crime in any way I hope they both spend some time in jail. Seriously!

Well first of all Jodi cannot be considered "reasonable"....so case closed right there:floorlaugh:

Has anyone posted posted possible jury instructions yet? I found the 'self defense' instruction particularly interesting. And, by interesting, I mean that I cannot conceive of any juror who has been sitting in that courtroom not saying "nice try Jodi' and zooming right on to the 1st degree/premeditation issue.

Section 4.04 et seq (starts at Page 32):

4.04 − Justification for Self-Defense
A defendant is justified in using or threatening physical force in self-defense if the following two conditions existed:
1. A reasonable person in the situation would have believed that physical force was immediately necessary to protect against another’s use or apparent attempted or threatened use of unlawful physical force; and

2. The defendant used or threatened no more physical force than would have appeared necessary to a reasonable person in the situation.

A defendant may use deadly physical force in self-defense only to protect against another’s use or apparent attempted or threatened use of deadly physical force.
Self-defense justifies the use or threat of physical force or deadly physical force only while the apparent danger continues, and it ends when the apparent danger ends. The force used may not be greater than reasonably necessary to defend against the apparent danger.

The use of physical force is justified if a reasonable person in the situation would have reasonably believed that immediate physical danger appeared to be present. Actual danger is not necessary to justify the use of physical force in self-defense.
You must decide whether a reasonable person in a similar situation would believe that: physical force was immediately necessary to protect against another’s [use] [attempted use] [threatened use] [apparent attempted use] [apparent threatened use] of unlawful physical force; or

You must measure the defendant’s belief against what a reasonable person in the situation would have believed.
[The threat or use of physical force is not justified:
1. In response to verbal provocation alone;
2. To resist an arrest that the defendant knew or should have known was being made by a peace officer or by a person acting in a peace officer’s presence and at the peace officer’s direction, whether the arrest was lawful or unlawful, unless the physical force used by the peace officer exceeded that allowed by law; or
3. If the defendant provoked the other’s use of unlawful physical force, unless:
a. The defendant withdrew from the encounter or clearly communicated to the other person the defendant’s intent to withdraw, reasonably believing that the defendant could not withdraw from the encounter; and
b. The other person nevertheless continued or attempted to use unlawful physical force against the defendant.]
The State has the burden of proving beyond a reasonable doubt that the defendant did not act with such justification. If the State fails to carry this burden, then you must find the defendant not guilty of the charge. [The user is directed to the Prefatory Use Note regarding the applicability of this paragraph.]

I'm watching the pm portion right now. It's very likely I missed it and I was right there. There's only so much of this demon I can take in to my head at a time.


Katie I'm not sure how big of a point that acknowledgement was from Jodi. She admits killing Travis, she was alone in the killing, the first people to discover Travis's body in the shower immediately called 911. Besides if cornered Jodi could lie and say she assumed she must have been the one to put Travis in the shower but it is a fog....

I did. Honestly it's like losing a friend. I watched every single day. When I was working I'd beg to get the channel changed to Court Tv.

I am trying to recall how the "travis back into the shower" came up.

I believe it was during the portion where he said to her something like even if you don't remember doing it, you do admit you were alone with him? (yes) and you do see him in the shower dead? (yes) so you had to have put him there.

FGS, they didn't even convict her with the neglecting a child charge as they said that they couldn't agree that Casey was the one responsible for her! :furious: :furious:

There were also more charges, weren't there, ATL?
I thought murder 2 or manslaughter or both were also on the table??

If I was on this jury...I would have a major problem with her going right and into the closet where she knew a gun supposedly was...rather than going left and out the bedroom door. I mean, the bedroom door was right there! To me, that is a big hurdle and shows premeditation to go towards where she says a gun was. ( of course I know this is all a lie)

Yesterday, he locked her into saying she didn't even think about the guy UNTIL she was in the closet! SNAP! And also, her story about not running the other way was due to "that would have been suicide" "that is where he grabbed my wrist before" ....well, that doesn't wash as she indeed DID go down that hallway to get to the other end of the closet!

Can't wait for AFTER the experts as I may do some RL during the time they are on..........

Well, he's onto her leaving the house now and making her acknowledge that she didn't use gas when she drove through the state, no mention of her placing him back in the shower at all.

I would hope that at that time DB had no way of knowing that it was stolen and would tie in to a murder.

MM is a curiosity to me. Seems she's emotionally blackmailing him in some way. DB seems like a good hearted person who's lucky to have survived the clutches of this demon. He didn't seem to push her same buttons as the other ones though.

I think it's entirely possible. DB may not have even known at the time what was going on. Say she did give him the "stolen" DVD player. I could totally see her telling him "If you tell them I gave it to you, I'll tell them you helped me! You'll lose your son! You'll be in prison for being an accessory!" No wonder the guy was a nervous wreck and didn't want his face shown. JMO

Jodi testified that she put on socks and shoes and left, driving away wearing the bloody clothes. It's obvious why she had to toss the car mats, but what I do not understand is how there was not blood elsewhere in the car, maybe on the seat or back rest, or even down on the front of the seat area from her pants legs. Certainly she had a lot of blood on her clothes so how was the car returned as clean as it apparently was? The rental agent testified it had two small stains that looked like Kool-Aid. I find it really hard to believe that's all there was for staining considering the crime scene.

I don't believe that. I think she changed at the house put those clothes in a bag and then burned them in the desert. No way she walks out in those murder clothes and does not have blood on her.

I think she said she drove in them, to say, LOOK, IT was not that bad! I did not have that much blood on me so I could not have been that vicious. Whatever the reason, in her sick demented mine it helps her.

I was worded a little differently.
Juan points to the spot right in front of the shower and asks her if that's where she was standing when she put him in the shower.
She says yes - you know, in that pitiful crying voice of hers. lol

Your mistake here is the first two words "Jodi testified". LOL

IIRC there were black socks in the washer. She took them off at the carpet where his throat was slashed. My guess is that she balled them up, slipped on TA's slippers, walked downstairs and threw them in the wash with the other stuff, brought the slippers back up and placed them on the clean carpet. I believe investigators think so too, which is why they have a nice pic of the slippers and why there would be a nice little fiber on the stairs.
