AZLawyer answered a question of mine in the legal question thread and I must say I'm a little confused. I don't think the state would get a conviction on the felony murder charge if it fails to get a conviction on premeditated murder.
"Felony murder" gets you a first-degree murder conviction without the need to prove premeditation. It applies where a murder takes place in the course of committing another felony. In the indictment, the felony that was listed as the basis for the felony murder charge was 2nd degree burglary, based on Jodi entering TA's home without permission or remaining there after she was no longer a welcome guest with the intent to commit another felony. I think JM said in argument that the other felony she intended to commit was aggravated assault? But I'm not sure.
I can't really see JA being there without permission. Maybe he didn't invite her to stay but he didn't ask her to leave (as far as we know, based on the pictures and so forth). And aggravated assault? I think her plan was to murder him, not just hurt him.
I think she'll be found guilty of premeditated murder or nothing.

I think perhaps Jodie dragged Travis's body into the shower to wash Travis and herself of blood. She put shoes on , ran downstairs and by the time everything was in place she was dry. Just put clean cloths on, left the house.
She would have to have all blood removed or risk leaving traces in the rental car, right?

That's why it always bothers me when people refer to Travis' death throes as a "fight" with jodi. He had no chance to fight. She sucker punched him with a fatal blow. His attempts to survive were to lurch for a few moments, to the sink and then to crawl a little bit down the hall.
Poor man.
But who was designated to care for Napoleon? I don't remember. because if it was a sitter, they would have come in the home, right? Napoleon was upstairs when the monster got there. Where was he when Travis was discovered?
Yes, but the really intense decomp smell wasn't until the door to Travis room was opened.
I never understood why this bothers people. It is somewhat mysterious but clearly jodi did this alone and they roommates had no idea what had happened. Sometimes there are things that don;t make perfect sense in a case but it is irrelevant.
In any event, they were young men who probably were not alarmed by off smells. Further, you know how people can;t smell their own breath very well? Apparently, our noses filter out smells that become constant so that we can concentrate on more unique smells. That may explain why they didn't notice the lingering decomp smell wafting through the house which likely grew with time.

So basically, (simplifying it a lot tbh), the moment Jodi started attacking Travis, she became guilty of 2nd degree burglary (and or assault). So because death is a result of that, they got her for felony murder? :waitasec:

I think he could have easily overpowered JA - and likely would have lunged at that tiny gun, even if shot (maybe not in the head). The only problem, imv, is that she stabbed him in the heart first... somewhere at or near the sink, which he leaned against, in shock and weakening fairly rapidly - but with just enough strength to try to flee - but he only made it to the end of the bathroom hall and a few feet into his bedroom. Where his throat was slit. I don't know when the multiple stabs in his back and head were done, but from the way the wounds look (to my layperson's eye) I believe he was basically immobilized when she did those. It looks like they were both stationary because the angle is so consistent.
I don't know when she shot him or why, but she didn't have to do it within the time frame of the photos... she could have waited a minute, a few... gurgling body noises may have prompted the shot, in her concern that he'd survive. I don't know.
On a side note - wasn't the roommate expected to be an hour late that day?
