Mark my words. Once she's convicted and sentenced to death, this afternoon's testimony will be appealed. They will say the testimony she gave basically agreeing with the State that she was consensual in the sexual relationship and not abused or manipulated was based on her having a migraine and not getting enough calories thus rendering her confused.

that's what we have to look forward to in a few years.

I think you are totally correct in your thinking here katiecoolady. After the lunch break she just seemed consigned to just tell the truth about the willingness and enjoyment of the sex.

I'm confused. If the 4:00 a.m. and 6:00 p.m. are the regulated feeding times for the inmates, wouldn't EVERY single person on trial face this dilemma of being hungry?

I agree with the minority though that it does seem to be too long to go without food if you are on trial fighting for her life.

Newsflash - hunger affects her MEMORY!!! That's it!

ETA: I just read the article posted above from the AZ Central website and it looks like it is an issue for other inmates as well. Joe may want to rethink his policies.

I agree with your second point but stand by my first.

In our case they successfully launched an appellate argument, got the lawyers assembled, the convicted felon transported from FLorence to Phoenix to hold an appeal arguing I sat in the courtroom between my rounds of testimony which they knew FULL WELL was legal due to the Victims bill of Rights. Ridiculous rounds of appeals go on ad nauseum in Death Row cases.

I don't think they have a leg to stand on but I do believe they will argue it down the road...appellate lawyers looking for anything I mean.

Fair enough, they may complain about it on appeal, but they will get nowhere.

It is eerily very accurate and Jodi's sudden onset migraine made me remember it.

I mean, Hello ... she's been on the stand for 10 days now, and this trial has been going on for almost 2 months now ?

JA and her DT know the program by now about lunch ...

I was going to make a "sarcastic" comment about this ... but I guess I will refrain until I find out what happened since I missed this afternoon's trial ...

Honestly folks, I'm getting very very worried. I am really afraid that the jury's going to be sympathetic and let her off. I know this is heresy but I don't think that the prosecution is laying out a logical case - he's all over the place, and he lets his disgust for her show too much. I hope to god I'm wrong.

I am extremely pleased the way the cross has gone. Everything he has said has been quite logical and filled with commonsense to me........something that JA does not have.

There is going to be a conviction for first degree imo. I have no doubt whatsoever.

If one read the link I put up this morning he is handling JA perfectly. It talked about how to cross examine a sociopath and he is spot on.

The only one that goes off on a illogical tangent is the defendant.

I also think she should be given lunch, ESPECIALLY when she is testifying. I don't care about the other days. Many people get headaches and dizziness from low blood sugar and I suppose it could be an appellate issue. Just give her lunch - it is an easy fix.

Or was she complaining that something in the lunch is giving her a migraine? MSG is guaranteed to give me a migraine if I consume it.

But in this case I think it is intentional and Nurmi has been keeping this back to use it when needed. Not only is he trying to stop and salvage what has been going on today - I think he is trying to ruin Juan's rhythm. Juan just lost a couple of hours of testimony and may lose an additional 1/2 hour every day going forward. He will have to rethink his timing so that he can continue to end each day on an important point.

IMO.

How is that? Court ends at 4:30 already, Nurmi just wants to make sure it never goes late. jmo

Do Victim's rights EVER trump defendants or criminal's rights??

IMO, if Mr. Martinez stopped his cross and never called another witness, I still believe the jury would convict her of murder one. They hear what we hear.

It's true. I mean, they could be passing contraband. It has to come from the sheriff's office, and I think it is just mean to not give her a lunch. I don't like the woman, but what is right is right.
If I don't eat, I get a terrible headache and can barely think. Not that that happens to JA, but it is an excuse for her, and she will look to blame anybody for her fu** up.

I wonder if Nurmi knows it, but after all of this, she is going to throw him under the bus. Claim he was a lousy lawyer, misrepresented her, and Willcott also. I would imagine they are used to it.

So, who's lobbying for changes in the system? Seriously, lack of lunch deprives someone of their rights? Is this what we've come to?

Hey, how about all the points Juan Martinez scored today. Did he not decimate JA's testimony on so many levels?

They would have to take her to the hospital (ER) if she had a migraine headache keeping the room dark and be very quiet. She would not be able to sit on the stand act like Royalty for 6 hrs. Sheesh.

How Histrionic can on get sheeeeeeeesh

I can TESTIFY to this exact action INCLUDING hitting emerg for a shot and having hubby drive me home. She showed no signs of actual migraine. IMO

If I'm not mistaken when NG toured Jodi's jail didn't the sheriff say they don't do lunch.

Sympathetic on what grounds?

I find it extremely powerful that so many women on this board who have lived the life Jodi describes on the stand, and for some far worse, feel so little empathy for her and instead throw the weight of their compassion to Travis.

Doesn't it stand to reason if anyone is likely to find empathy it would be those who are intimately familiar, having lived it themselves?

If everyone of us who had parents who may dealt heavy handed discipline once & awhile.. Dated a guy who was for one thing even though we thought he was the one felt that was a pass to kill...Well... We'd have bodies stacked on the street corners! I have NO EMPATHY for this sorry excuse of a being! umm that's JMO

He did, which is why Jodi fabricated a migraine and blamed it on the missing lunch.

IMO this should be handled so Jodi cannot make an issue of such things.
