Correct, manslaughter is not an option. Only 1st degree Felony Murder with Premeditation (if they find with premeditation she gets the Death penalty) OR the only lesser charge the Prosecutor charged her with is 1st Degree Felony Murder (no premeditation) that carries Life Without Parole.

The guy friend said he and Jodi talked about how she thinks this will go. She feels she will have a hung Jury and she will sit in Jail another 5 or so years waiting for a re trial. At her re trial she will be charged with Manslaughter and get 5 years and be out.

What she is assuming is that on the re trial the Prosecutor will add in a lesser charge of Manslaughter for the Jury to pick from and as they say..."In Her Dreams"

seems to me it would be the defense who would want that charge added. no? won't nurmi try to get that lesser included in this trial? or is that off the table?

Who found it, where and under what circumstances?

Did JA instruct someone where to find it because it would then be useful in her new version of events? TIA

Last week Gus said the phone was found while cleaning out the car. He didn't say his car but it sure sounded that way imo.

Are you sure felony murder only gets LWOP? I thought anytime someone is murdered during the course of another felony it also can be punishable by death?

She also mentioned yesterday that she had TWO cameras on this trip (lie). I think she said that to cover up her previous story of the camera already being in the car. So now when JM brings that up, she can say she had 2 cameras with her.

to this day she's still busy fitting her story to the forensics or changing the story at will . . . . she never gives up! :jail:

Eight hours 10 minutes until cross examination resumes.... plenty of time to sleep, shower, scoop the litter box, make coffee and run the dishwasher. Although not necessarily in that order.

Me, too! Vinny and Jean can seem so obtuse at times, but Joey is always right on the money. And his voice is fantastic!

I think what Juan is leading up to with the missing rope is that she attempted to clean up the crime scene and to remove everything that might connect her with the crime, (i.g. the knife, the rope, the gun and who knows what else). It goes towards the premeditation and cover-up that she did after he died.

It also kind of blows her "I don't remember anything until I was lost in the desert" story. And there were some fibers found from the decorative roping at the scene. It was a soft silky rope with a tassel possibly that you might see being used to tie back curtains. I do not believe that it would be possible to cut through that type of rope very easily with just a knife unless it was extremely small in diameter.

Her indictment reads 2 options

1st Degree Felony Murder (Premeditation)

or

1st Degree Felony Murder

(one has Premeditation in parenthesis, and the other just says felony murder, both 1st degree) So they are giving the Jury the choice of ONLY 1st degree murder.. But the Prosecutor wanted to give the lesser option of "no" premeditation in case they did not find that...so the least she gets is LWOP.. But they are asking for Charge #1 which was 1st degree felony murder with premeditation.. Which gets the Death Penalty...

I think he is proving that the rope never existed except in her diabolical head.
