IMO, Crystal should be given full custody of JR. SHE is not the one in jail at the time for felony trafficing.

I agree completely! Please let his mother get him. She deserves to have her son! I mean what has she done really since this case? She hasn't done one thing.

Crystal is a stay at home mom who is busy raising Jr.'s only siblings. He BELONGS there, in every sense of the word. :banghead:

IMHO.. Living with Crystal and her family can't be any worse than where he is living NOW.. Personally and IMHO.. I suspect it would be a much better place, and he would be much happier........JMO

ITA, and I'm sure that he would like to be near his little sister too.

I can envision GGMS and TN busily cleaning up their own houses last night in preparation for a visit. It would not surprise me at all if they were each knowledgeable about the drug dealing and allowing it to happen. JMO.

I think they both knew about what was going on with those drugs. I've seen parents who would keep quiet about their drug dealing kids because they were being well taken care of.....new cars, etc.

Some may feel that the grandmas are a better fit for Jr. He is used to living with them, for example. I would think the LAW requires Jr. to be with his mom. We haven't heard what Crystal is doing about all of this yet.

Whatever happens, we will not being allowing anyone to diminish another poster's opinions of this subject. If you have facts contradicting their opinion, feel free to post them in generic form. Thanks!

BBM. I agree. Parental rights always supercede grandparent rights unless a parent is proven unfit. I can't see anything that would prove Crystal unfit. Especially since the courts have granted her unsupervised visitation. IMO neither grandmother stands a chance at obtaining custody. Visitation perhaps, but not custody.

Can Ronald give custody to GGS?

Can Ronald give custody to GGS?

It could very well be out of his hands right now.. He may have absolutely nothing to say about it at the emergency hearing.

Nope. Not if the Law in FL is like in Va. The non-custodial parent would get custody unless they have priors of abuse filed against them through the courts. Now, Ron can try and sign custody over, but that is another ball game. GGMS would have to file for custody of Jr. and Ron would just tell the judge his reasons why he feels Jr. needs to be with GGMS. But that would be a different hearing. Once he is convicted CS can file to take away his parental rights. I may be wrong though, that is just how it is here in VA. I had emailed Marie a bunch of info and codes for the state of FL a few months back, I hope she took the time to read them. I know it was said that CS was using and I pray she got help if she was and is clean because this little boy needs his mother. I will leave it at that because I don't live with them and I don't know what really is going on. I just want what is best for Jr. and obviously the state of FL (among the many other states), doesn't know crap about what is in the "Best Interest Of a Child". IMO

When is do grandparents or other relatives have custody or visitation rights

Generally, the natural parents will have a presumptive right to custody. Only in cases where the parents are found to be unfit, or there are exceptional circumstances, will third parties be granted custody. At any time after a divorce, grandparents may petition the court for visitation rights

Oh Man - it's just really tough to know what would be the best decision for this little boy without actually being there.

Normally, I would say - hands down - that he should be with his Mom...but - my head and heart are not as convinced as some. Wish I could get over some of the issues I have with Crystal.

Something else to think about.

As most of us know there are always loop-holes in the laws, who you know and so forth. I was just thinking about one of the Statue here in Va. If the child lives with you for 3 yrs then you would have more of a chance at gaining custody. Now, I am not sure about FL. Some states have different time brackets. From my understanding Ron had sole physical custody of the children, but we never found out who took care of the children. Misty was not in his life that long before Haleigh went missing. So, maybe GGMS and TN will be claiming that they provided most of the care for Jr. and Haleigh. That could be another reason why the children were never taken away by DCF. I could never figure out how they could look the other way with all the reports that came in.

While we are waiting on an update here are a couple reference links.
"Snip" http://www.18884mydivorce.com/pub/statutes/childcustodystatute.htm

2. The court shall order that the parental responsibility for a minor child be shared by both parents unless the court finds that shared parental responsibility would be detrimental to the child. Evidence that a parent has been convicted of a felony of the third degree or higher involving domestic violence, as defined in s. 741.28 and chapter 775, or meets the criteria of s. 39.806(1)(d), creates a rebuttable presumption of detriment to the child. If the presumption is not rebutted, shared parental responsibility, including visitation, residence of the child, and decisions made regarding the child, may not be granted to the convicted parent. However, the convicted parent is not relieved of any obligation to provide financial support. If the court determines that shared parental responsibility would be detrimental to the child, it may order sole parental responsibility and make such arrangements for visitation as will best protect the child or abused spouse from further harm. Whether or not there is a conviction of any offense of domestic violence or child abuse or the existence of an injunction for protection against domestic violence, the court shall consider evidence of domestic violence or child abuse as evidence of detriment to the child.

That is the way it is here as well Kimster. I do recall that KP said the reason she did not help CS file for custody was because CS was using drugs and other. Allegations per KP.

I wonder if TN and GGMS will bring this up in court this morning? DCF is a huge waste, it will take months for them to investigate the allegations and as we know if DCF doesn't see a child in ICU they do nothing.

The one that will suffer is JR. because if these grandmas go to court mud slinging Jr. will end up in Foster Care.

I just pray that he ends up in a permanent home full of love. Enough is enough, this child deserves the best the world has to offer. He did not ask to be brought into this world.

Last night when all this was going down, I was SO glad that something/anything may finally bring some new information regarding HaLeigh. At the same time my heart was breaking for Jr. First, his sissy is gone, now his daddy. I know Ron is a @$%z^&@, but that doesn't matter to a child as most love unconditionally...at the very least that was all they knew. I have seen so many children whose parents beat the crap out of them, yet it is devastating to them when the parents are hauled off to jail. :(

Poor baby needs his mama more now than ever and I pray that Crystal has had a wake up call, straightened herself up and will be able to give him the most normal childhood that's possible at this point.

Me too suspicious! My son has a long time friend from elementary school who always dabbled in drugs from about age 13-14. At about age 16-17, he and his mother moved 1 house down from us. Thank goodness the boys were not close friends and I never had to put my foot down and tell my son not to hang around with him. But I could watch and see the traffic in and out everyday and KNEW that his mother HAD to know what was going on because she was very often @ home and this was a small house. The guy and his mom now live a couple streets over from me and just down the street from my son and his family and it STILL goes on. Only now the police have gotten wise and the house has been searched several times. His mother knows (and from what I've heard uses the prescription pain killers herself) and she has ALWAYS known. This guy is 24 yrs. old and sadly if he makes it to 30 I would be shocked..

You raise a good point...Jr. will suffer regardless. As a victim of child abuse/sexual abuse...I still love my father, as sick as that sounds. Part of me still loves him.

Jr.loves his father and mother and in his little head he doesn't know what the heck is going on, except that he misses his sister and now his father will be out of his life. I have been praying for months that Haleigh would be found and CS got her self straight for these children that need her. I fear for Jr.'s safety and the emotional shock he is about to encounter, it seems nobody in DCF has taken this case seriously. I feel strongly that if DCF would of done their job a long time ago Haleigh would not be missing. But that is JMO. I know the main fault falls back on Ron for leaving Haleigh in Misty's care, then Misty and whom ever took her.

((hugs)) MADJ. That doesn't sound sick at all to me, it sounds normal and I have encountered it more often than most could imagine. Butterbean is way too young to understand any of this and as much as I can't stand Ron and hope he rots in he!!, this little boy loves his daddy. :( His life (as pitiful as it was already prior to last Feb) has been turned upside down. I hope Crystal is prepared to be drug tested because if DCF puts him in anyones care without doing so first, I'm going to be livid! Hopefully she has cleaned up her act and is ready to offer him a good stable safe home. That would be the best case scenario imo IF she has her life in order. Otherwise I'm afraid of where Butterbean may end up at least temporarily. :(

Heck, I know I am preaching to the choir and this was an obsession with me regarding JR. but the courts had never done their job. RC had a conviction of drugs prior to getting custody. He was not jailed. He was given a fine. CS had no convictions. While RC was filing and giving false addys for CS, he managed to get another arrest for drugs. Did they do anything?...NO.

I want them to immediately give jr back to CS. Now I am seeing there has to be a conviction before they do so. His attorneys could hold this up for years. Neither jr's GMA or GGMA will give him up even for his best interest. If by some fluke CS gets her child, we should all pray that rc never gets out of jail because that could be the worst thing in this story. I bellieve with all my heart that TN, GMA and RC will do ANYTHING to keep the child. RC is violent and the other two raised him and now they have JR. Please, if there is a God, Please intervene in Butterbean's behalf.

On a side note, during the Balloon Release and fund raiser, when Butterbean got out of his father's car, he ran to his mother and didn't want to leave her side the entire day. Little boys need their mother. For all her faults, CS appears to be very loving. Her words say it all (read her writing) and watch her interactions with the family during the old videos. She did much comforting to everyone.

IMHO, I think that Miss Nancy owes Crystal Sheffield, Marie Griffis & their whole family a HUGE public apology. She treated Crystal like a criminal and acted like Ron & Misty were angels.

She actually gave her one when she learned that Misty was involved with drugs. Hopefully she'll give them that huge one.
