This is an order from July, 2003.......so this is how The Honorable Perry rolls!!!!!!! Even better because now there is no room to whine that they are being singled out.

Yes, but for some reason he felt a need to attach it. :waitasec:

BBM.
What does everyone think he means by this? Is it a generalization he's making, sort of an introduction of how he wants things done, or is he referring to something in particular? Here's the policy he's talking about (if I found the right one, I hope!)
http://www.ninja9.org/publications/policies/courtroom decorum policy.pdf

from the link, #4:

"Refer to all persons, including witnesses, other counsel and the parties by their surnames and not by their first names or given names unless the permission of the Court is sought in advance."

I recall CM referring to JA as "Jeff". I suppose this will not be allowed, good.

#6
"Counsel shall request permission before approaching the bench."

Got that, hosey-dosey?

#15
"No gum chewing is permitted."

Well...I wonder if they'll give KC a copy of this so she can brush up on the new rules of the game before her next hearing. Ought to pass it along to the A's too. :)

I'm just happy that Judge Perry will not tolerate Cindy and George chomping on their gum like cows!!!!!! It's so disrespectful in a courtroom.

"15. No tobacco use in any form is permitted. No bottles, beverage containers, paper cups or edibles are allowed in the courtroom, except as permitted by the Court. No gum chewing is permitted."

But something tells me they are going to try and get away with their smacking. I would love to see Perry stop and make them take out their gum or leave.

And BTW an order like the one Judge Perry just issued is very common. Especially among Judges who run very very tight ships. They aren't all the same and vary from Judge to Judge.

I recall another chief Justice procedural order that was much more strict than even Perrys.

Your post is indicative to the fact that Cindy has some major adjustments to make.

This is a zinger from Judge Perry directly to the Defense and I love it:

"The order reflects Perry's reputation for efficiency. He also asked attorneys to provide him a list of motions that will require evidentiary hearings and those based on pleadings and to give courtesy copies to the court of future motions."

No more 11th hour sensationalizing to the media for the Defense!

Yes this does seem to apply directly to the defense in this case, IMO almost all of them do. However I do notice that this is how honorable Judge Perry runs and operates his court. JB' in for a major culture SHOCK IMO! His days of sneakiness, rudeness and the like are now long gone. Has anyone gotten the actual date for the hearing yet? I thought it was to be the 30th but now have heard another date?

When I read Judge Perry's excellent Courtroom Decorum Policy I thought it was written based on the antics of the counsels in this case. Then I saw that he had signed it on "this 1st day of April, 2003."

So then I realized that they must have thought it had been an April Fool's joke. :D

Does anyone see JB beating CM over the head with his shoe....."THIS (whop)...WAS (whop)...A (whop)...VERY (whop)......BAD (whop, whop, whop)....IDEA (whop)?

Sorta like this:

Excellent news! I know I can be among the first to poke fun at any chance of Baez goofing off, but I am so pleased to hear this case will now be run with the Judge clearly in control, with high expectations of professional conduct.

Seriously I will be holding my breath is Baez gets up to speak. I'm thinking of the day in court Andrea Lyons was obviously cross at him. He was stuttering and stumbling and managed to knock a file of papers off his desk onto the floor. To my way of thinking JB has conducted himself with an extraordinary sense of arrogance and entitlement - which I would love to see curbed so we could get down to the business at hand which is pursuing justice for Caylee. She seems to get lost in all this nonsense.

BBM

ITA!

It has been the absolute most frustrating of all IMO. This is/should be all about Justice for little Caylee!!!! I have a sense that Judge Perry won't let it be forgotten in his courtroom.

A question just occurred to me about JS recusing himself for the “blogging” incident.....how does the defense know that new judge hasn’t blogged, read blogs, etc. in this case? Soooo, what, then was the entire recusal thing actually about?

Not that it matters, but new judge had every right to read anything and everything about this case prior to being assigned. HA! Wouldn't it be priceless if he were a "sleuther"!!!!

I think you may have misinterpreted the intent of the underlined above. I was not implying that a "hard nosed" judge IS NOT fair and balanced. I was referring to a "hard nosed" judge who may not be AS fair and balanced (as Strickland, who was extremely careful in trying to avoid any appellate issues).

Very good advice to research the respective parties' records in court before making assumptions, and I am one step ahead of you! Been researching Mr. Mason on Pacer for two days now and slowly reading through all court documents of previous cases defended by him. Very interesting indeed!

I know I was critical of CM for saying this was going to be FUN, but now I've got to agree with him, this is going to be fun, just not the kind he envisaged.

JS and JP between them, by thinking about what's best for Caylee rather than how to serve their individual egos, have played a different move than the defense expected and have thoroughly outwitted, outclassed and out-zinged them. JS was a genius to step down, and JP was a genius to step up. Oh how I <3 them both.

My friend Cat tells me that Judge Perry does not like cameras in the courtroom and sees them as a hindrance to justice.

I have been wondering what tactical advantage JB or CM could possibly have by getting rid of Strickland, when there was every indication that whoever they got would be stricter. Perhaps they guessed it would have to be Judge Perry.

And perhaps they were willing to go along with all the no-nonsense if it kept their client out of the cameras. This girl doesn't ever need to testify to make herself look bad. She does not present a sympathetic appearance in her many court appearances and they may not want her body language hyperanalyzed any longer. I cannot imagine that Perry will somehow reverse any rulings so I am still perplexed at why CM would think this was a good strategy. Unless it was simply to get her out of the public eye.

Great theory! But how to explain the 4 motions leaked to the media with Judge Strickland's name on them after filing the motion for recusal? Especially because the defence has not followed through in filing the motions after JS immediately recused himself.

It is possible, as some have speculated, that the defence simply guessed wrong, and now they don't have JS to kick around anymore (from their POV).

And the fact is, there is lots of repetitious video out there in the media that has cooked the perp's goose, so if the public doesn't get to see her, neither can she try to rehabilitate the image that the public has been left with. It's a win-win, in my books.

I like the new Judge. I like the idea of order in the court.

  • #176
Well this should be interesting. I am glad he is a no nonsense Judge and I hope he will hold true to that in this case...it has been dragging on way to long.

Strickland put up with a lot of immaturity IMO on the defense side, I'm not sure I have ever seen anything like it. I just hope it is nipped in the bud as of April 30th.

Here you go.
It's after the 8 minute mark.

LOL if you watch the bailiff while MN is at the podium ,she tells someone in the courtroom to spit out their gum and zip it. I had not noticed that before.

Yep I saw them playing with the pen. What really makes me sick is they are doing this when MN was talking about the remains of Caylee.

I love what I'm reading about this new judge. Biaz and Casey are going to be way out of their element. If she did not understand the gravity of her situation I would guarantee one maybe two hearings she will. Instead of making smiley faces for jose on the paper in front of her if thats what she does she better learn to take real notes. I think the lightbulb will go off and she will believe her life is truly on the line. I personally cant wait to see it. IMO
