Karim Baratov, alleged Yahoo hacker, to fight extradition in September

Accused Yahoo hacker Karim Baratov has decided to fight extradition to the U.S.

He is scheduled for a hearing on Sept. 8, in Hamilton. At the same time, his lawyer, Amedeo DiCarlo, says he is continuing to negotiate behind the scenes to possibly waive the extradition hearing and move on to fight the charges in the U.S. directly.

So now not only is he not waiving extradition, he's fighting it. So I suppose if his legal team, including a NY attorney, can't get an assurance that he won't do jail time if he turns himself in to US authorities, he'll fight to not be extradited. Must be costing him a lot of money. Wonder where he got all that money? :notgood:

And it looks like his expensive legal team have been able to work out a deal with the US and he will waive the extradition and go directly to the US to face the charges. I wonder what he's been promised in this deal?

Wonder if his lawyer will still be defending him in the US? Previously, hadn't he said he would escort him there himself? Now he will be escorted by by a US marshal? It sounds like things are moving quickly out of DiCarlo's control. He really thinks he's going to be incarcerated for less time in the US even though he may be subject to additional charges there?

From what I understand, DiCarlo has been working closely with a lawyer(s) in the US to get the discovery and perhaps work out a deal for KB or at least find out what he's facing. I assume that DiCarlo is satisfied that everything has been worked out and that KB will face little, if any, jail time so he's advised his client to waive the extradition, which is just making him spend more unnecessary time in a Canadian jail cell, and go directly to the US to face his charges. Sounds to me like he will also plead guilty to whatever they have worked out for him. I also suspect a big fine will be involved (;)) that he will have no problem paying. :rolleyes:

As his lawyer has stated, he was a small fish in that yahoo/google hack and didn't make a whole lot of money from his part. So the real question is where did he get all the money before he did that? And why would two Russian intelligence officers know of his "online services"?

It appears that KB will NOT plead guilty. He was taken to San Francisco on Tuesday and plead not guilty in court today. His defense is that he had no idea who he was "working" for or what he was doing. :rolleyes:

U.S. authorities allege Baratov, a Kazakhstan-born Canadian citizen, was a "hacker for hire" with Russian ties.

His U.S.-based lawyer, Andrew Mancilla, confirmed his client was extradited from Canada on Tuesday and is in federal custody south of the border.

I bet he gets a slap on the wrist and is back in Canada to pick up where he left off in no time. There is no justice for criminals in this world right now. Why would anyone want to tow the line and work hard when you can be an online hacker and make oodles of cash? :notgood:

After eight months of maintaining his innocence in a massive data breach at Yahoo, Karim Baratov feels like he's now, his lawyer says, doing the right thing by pleading guilty to charges stemming from his role as a hacker.

Baratov, who is from Hamilton, is scheduled for sentencing in February, after pleading guilty, in a U.S. court on Tuesday, to one count of conspiracy to commit computer fraud and abuse and eight counts of aggravated identity theft.

It says he made a plea deal.. had 47 counts of hacking charged against him, and 'espionage'.. but only plead guilty to one count of conspiracy to commit computer fraud and 8 counts of aggravated identity theft.... as far as I understand how things work, the prosecutors make the deal, but it is ultimately up to the judge to rule on his fate - and he may or may not agree with whatever deal was made. Sounds like the judge isn't simply rubber-stamping this 'deal', and is looking into Baratov's conduct (I assume while in prison??)

If I were Karim, I would be scared shiteless, since he is not in control of what is going to happen. I don't think they're quite as lenient in the US as we are over here. jmo.

And then to top it off... if I were Mr. Baratov aka Taloverov, aka Akehmet Tokbergenov, I really wouldn't be feeling overly comfy on this end either, and even when I was freed, I'd be feeling I'd have to be looking over my shoulder, forever...., but that's just me.:

Just realizing how very young Baratov was when he was already 'working' at this.. he is 23 now, according to MSM, so this would put him at 16 when he was actively involved in this..

"He is alleged to have collected more than $1.1 million in fees, which he used to buy a house and expensive cars.

“Deterrence is particularly important in a case like this,” the judge said during the hearing. He rejected prosecutors call for a prison sentence of nearly 10 years, noting Baratov’s age and clean criminal record prior to his arrest.

Lawyer Amedeo DiCarlo, who represented Baratov while he was in Canada, said in an email that Baratov is satisfied with the court’s decision.

“The judge used all criteria possible to assist Karim and, given the time he had already served and the time expected to serve, he will be out in approximately three years,” DiCarlo said. “The justice system worked for a man who took responsibility and I’m sure he learned many lessons.”

Baratov has been in custody since his arrest last year. He told the judge Tuesday that his time behind bars has been “a very humbling and eye-opening experience.”

He apologized to those he hacked and promised “to be a better man” and obey the law upon his release. The judge said it is likely Baratov will be deported once he is released from prison."
