Kathleen Savio's death #3

Apparently, Harry Smith, the divorce attorney for Kathleen appeared on a local Chicago radio program today. There is a thread about it at findstacypeterson.com. The highlights for me, things that haven't yet appeared in any articles:
"It is Kathleen Savio's divorce attorney and he is saying that Kathleen came to him first about a PFA against Drew a few weeks after the divorce.

He said they and Drew agreed to have the PFA dropped so he could continue to be a police officer. Kathleen wanted Stacy to be able to have medical insurance since she was pregnant."


and

"He said he asked Kathleen if she had a will and she said no."

and, he has given all his information to law enforcement.

Other general info is that the grand jury did not meet today. Therefore the 'boys' did not appear today. Possibly some attorney stalling.

"Brodsky said that retaining a separate lawyer for Peterson's sons was to assure someone is protecting their interests.

"Drew¹s not manipulating the situation," he said. "He has to protect their rights, make sure they're not being harassed or bullied," Brodsky said. "They need a very tough criminal defense lawyer. And that¹s what they got."

Since when do young boys, ages 13 and 14, need a "tough criminal defense lawyer" to protect their interests when testifying before a grand jury?

Someone is very concerned about what those two boys might reveal.

That is the first thing I thought too Leila....13 and 15 year olds don't need a tough criminal defense attorney if they told the truth the first time when they were before the GJ.

Brodsky says Drew is not trying to manipulate this situation...then this would be the first situation in his life he didn't try to manipulate. Drew is all about manipulation and control. Brodsky knows that Drew is a manipulator and that's why the big criminal defense attorney for the boys.
 
So Stacy was using the same divorce attorney Kathleen had..makes sense if you are wife number 4, know how wife number 3 died and are also scared you may end up the same way. He would already have had a lot of info on Drew from Kathleen to help support Stacy's divorce plea.

Also it is very important that he asked Kathleen about a will and she stated she had none/ Now the info is out I am sure he was already before the GJ and told them that too. Interesting..this little hand written will that appears out of the blue..all signed off on by Drew and his friends and family. What a wicked web Drew has woven for himself.

But Drew claims he found it after her death

While she was divorcing Drew Peterson, Kathleen Savio said she didn't have a will, her former lawyer said Friday.

Attorney Harry Smith's statement raises new questions about a two-page, handwritten will that Drew Peterson unveiled 15 days after his ex-wife drowned in her bathtub in 2004.

The will -- dated March 2, 1997 -- named Peterson's uncle James B. Carroll as executor of Savio's estate.

"We just tucked it away, and I found it after she died," Peterson said earlier this year. "There's nothing sinister and out of line about it. Everything was done proper."

A Will County judge accepted the will as valid in 2005 after two of Drew Peterson's friends testified they had witnessed Peterson and Savio sign the document.

Brodsky and DP stepped in it again! They just can't seem to keep their boots clean, can they?!

What those boys need is a good lawyer to file emancipation from DP so they can choose to take their money and get the hell away from their father!! Daddy has been sponging off them long enough. Someone should be looking out for their best interests against DP before they have nothing left! A Guardian Ad Litem would be a good start instead of a criminial defense lawyer!!
 
Has it ever been confirmed by anyone who's handwriting it is that wrote the will??

I think that is why the FBI was origanlly brought in, why the new sherrif is trying to clean things up and brought some charges against Drew back in September and why the past cornorer, DA and politicians are all pointing fingers at each other now. This is going to be a political hot potato for those involved previously. You know Drew is not going down by himself on this. Oh no..he is going to bring everyone that any part in this down with him.

DeltaDawn.............I agree! In order for DP to have gotten away with the murder of Kathleen Savio, there had to have been other people involved who would look the other way.

It seems to have been generally known by the people in Bolingbrook that there was corruption within the ranks of the local police department. That's why Cass went to the state police instead of the city police initially. And from what the paster said, it appears that Stacy was afraid to go to the local police too. The overall appearance is of a small city where certain police officers are untouchable and the locals know that to lodge a complaint against one of those untouchable police officers it will never go anywhere, and instead, it may come back to harm the individual who complained.

In order to attain the position of a police officer that's untouchable, that officer has to be in the favor of higher officials that protect them.

In this case, DP knew he had gotten away with the murder of his ex-wife. He fully expected that the disappearance of his current wife, Stacy, would remain a local media event and he would get away with this one too. He knew he could bamboozle the local people into believing Stacy had left him for another man. He didn't count on the glare of the national media, and that his every action would be carefully scrutinized. And in his wildest dreams he never thought that Stacy's disappearance would lead to exhuming Kathleen Savio's body and further investigation into her death.

I expect that when this is over and done with, there will be a complete political shake up in Will County and perhaps beyond.
 
Ooh...I hadn't thought of that!

Another document that is in question is a power of attorney. I took it that Drew also wrote that out by hand.

Lawsuit could alter Savio estate

"In February, some members of Savio's family filed documents in court asking a judge to reopen her estate. They wanted to take control of it and remove Carroll as executor while considering the possibility of a wrongful death lawsuit. Other members of Savio's family also filed a similar request, and now both sides are working together, explained Lawrence Varsek of Joliet, one of the lawyers representing the relatives.

In Goodman's courtroom Monday, Joel Brodsky, Drew Peterson's Chicago lawyer; Varsek; and Martin Glink, an Arlington Heights-based lawyer who is also working with the Savios, hashed out some scheduling issues. They also submitted documents outlining their arguments.

Varsek and Glink asked the court to reopen Savio's estate because there could be new assets to consider. If a wrongful death suit is filed and is successful, there would be damages, meaning money, Varsek explained. In short, that cash would be the newly discovered asset.

But Brodsky argued that the possible wrongful death suit isn't part of the original estate or a newly discovered asset. So by law, there's no reason to reopen the estate, he said."

"After the brief hearing, Varsek and Glink talked about what happened that morning.

"The case will be reopened, and (James Carroll) will be removed, Varsek predicted.

If the Savio family prevails, any money gained will go to the children, Glink said. The family won't profit.

"The Savios are after justice," Glink added.

When Brodsky walked out of the building, he answered only a few questions. Then a light-colored Mercedes sedan appeared in front of the River Valley Justice Center, and Brodsky hopped in.

If DrewP showed up to pick JAB up it sounds as though he might be really concerned. Otherwise he would have just made an appointment with JAB for later in the week at the office or talked to him on the phone about what happened in court. It also sounds like JAB was uncharacteriscally quiet.

LOL, if the money is put in the kids names and an admin appointed, that could seriously put a cramp in DrewP's "style." Can you imagine DrewP having to go to an admin to ask for money for the kids? No longer in "control" of the finances?

I am glad the family is now going to work together. I think that will be best for the case. They can handle any problems privately.
 
EEEEEW! Now it sounds to me like there's more to their relationship than lawyer-client! He picked him up at the courthouse? Are they good buddies now? Yikes, this is really icky!

JOLIET – Will County Judge Carmen Goodman ruled Thursday morning that the estate of Kathleen Savio could be reopened.

Goodman also removed Drew Peterson’s uncle, James Carroll of Westchester, as the executor of Savio’s estate. Instead, Savio’s sister and father will become executors of the estate.

The judge also appointed a guardian ad litem, or court-appointed attorney, to represent the interest of Savio’s children.

Wow...........this is great! I think this may be the beginning of the long arm of justice finally reaching out for DP!
