Gabrielle Maina: Cyrus Maina is innocent, lawyer says after Australian woman's husband arrested over her killing
ABC News
BY AFRICA CORRESPONDENT SALLY SARA
ABOUT 2 HOURS AGO (as at 09:33 AEDT 25 October 2017)

‘The lawyer representing two men arrested in connection to the shooting of Australian teacher, Gabrielle Maina, says his clients are innocent.

Gabrielle Maina's husband, Cyrus Bernard Maina Njuguna, and his cousin John Njuguna Waithira have been arrested in connection to the killing.

They appeared in court in the Nairobi neighbourhood of Kibera but no charges have been laid.

Ms Maina was shot dead last Thursday as she walked home along a road in Nairobi.

The lawyer for the two men, Wilfred Nderitu, said Mr Maina was not at the scene at the time of the killing.

"There is evidence that is capable of corroboration by many people, as many as 10, that Cyrus was in his office at the time that the murder took place. Therefore, there is no way he can be placed at the scene," he said.

The court has upheld a request by police to hold the men in custody for another seven working days to allow more time to gather evidence.’

Gabrielle Maina, murdered Australian teacher, accused husband of domestic violence, court documents show
ABC News
EXCLUSIVE BY AFRICA CORRESPONDENT SALLY SARA IN NAIROBI
UPDATED 10 MINUTES AGO (as at 20:53 AEDT 16 January 2018)

‘Court documents obtained by ABC News show Australian teacher Gabrielle Maina, who was shot dead in Kenya, feared for her safety and accused her husband Cyrus Maina of psychological torture.’

‘Police are still investigating whether the shooting was a random robbery or a targeted killing.

Ms Maina was granted a restraining order against her husband in April 2017 — six months before she was murdered.

In an affidavit lodged with the Chief Magistrate's Court in Nairobi, she alleged her husband "became extremely violent and was of uncontrollable anger" after they moved from Australia to Kenya with their two sons in 2016.‘

‘Ms Maina's lawyer, George King'ori, lodged a certificate of urgency on Ms Maina's behalf to obtain a restraining order against Mr Maina, alleging: "The Respondent who is the estranged husband of the Applicant has uncontrollable anger and irrational behaviour.’

‘Gabrielle Maina's husband Cyrus lodged an affidavit with the court in August 2017, dismissing the allegations.’

‘ABC News requested an interview with Mr Maina, via his lawyer, Wilfred Nderitu.

Mr Nderitu declined the request on behalf of his client.

The police investigation into the killing is continuing.’
