A judge has denied a new trial for a Kansas home day care worker who was convicted in the death of a 9-month-old baby.

The Lawrence Journal-World reports that the sentencing for 44-year-old Carrody Buchhorn is now set for Nov. 18. She faces nine to 10 years in prison.

A woman convicted in the killing of a 9-month-old boy at a Kansas day care has been sentenced to more than 10 years in prison.

Forty-five-year-old Carrody Melissa Buchhorn was found guilty in July of second-degree murder in the September 2016 death of Oliver Ortiz at the Sunshine Kids Group Daycare Home in Eudora.

She was sentenced Monday.

TOPEKA, Kan. — A split decision by the Kansas Supreme Court means a woman accused of killing a child in her custody will get a new trial.

In August 2021, the Kansas Court of Appeals ordered a new trial for Carrody Buchhorn, of Eudora, who was convicted of second-degree murder after a baby died at her daycare center. She was sentenced to 10 years in prison.

Buchhorn’s attorneys have argued that a new preliminary hearing is required to establish probable cause since the first determination of probable cause relied on the testimony of Coroner Erik Mitchell, who posited “depolarization” as the cause of Oliver’s death and whose testimony will not be used by the prosecution in the second trial.
