KY - Byron Perkins skipped out on son awaiting kidney, 2006

To my dearest fellow Websleuths,:blowkiss:

:woohoo:

I am so happy to announce to you that the waste of skin couple Byron Perkins and Lee Ann Howard are incarcerated. They apprehended in Mexico in May. (how did we miss that one???)

Father who abandoned son needing kidney returned to Kentucky

Perkins, 38, and Lee Ann Howard were flown back from California Friday afternoon and processed by federal authorities in Louisville, said Rich Knighten, chief deputy U.S. Marshal.
Perkins and Howard, 36, will likely appear in court early next week, Knighten said.

CNN

"There's a lot of anger between me and him right now," Destin Perkins said. "I would like to see him and tell him what I think and just ask one question: Why he did it? It's kind of sad that he would run out on me like that."

I cannot find anything stating what the two got for a sentence.
They went to court in May.

D_S, the two were returned to the US and Perkins will have to serve the terms on his original sentence. He was also charged with some escape charges- I don't know if that has gone to trial yet. Howard was charged with federal aiding and abetting charges. Also don't know if she has gone to trial yet. And I am not positive but I am thinking she may have already been awaiting trial on some kind of charges when she ran, so she may have a sentence awaiting her on that. The court appearances they had when they returned were arraignments on the new charges against them. Depending on the courts and the attorneys, it could take 6 months to two years for this to go to trial.

You're very welcome.

To my dearest Mysteriew,:blowkiss:

Will the judge give the two the max sentence knowing that Destin was dependent on his father's kidney to live? It is a miricle that Destin was able to get a donor at the last minute.
My heart truly hurts for Destin. I cannot even imagine his terror thinking that he was going to die because his father chose to leave him for dead.

I appreciate your posts.

Who knows d_s. Legally I don't think there is any provision for it- but certainly the judge will know about it and if I was the judge that would affect sentencing. So a lot is going to ride on the judge and whether he has any lee way in sentencing. Also whether anyone offers him any plea deals.

Destin Perkins is 16 years old. He found out last year that his kidneys shut down and he needed a transplant. His mother donated hers. But unfortunately, his body rejected it so he is now in need of another transplant.
His father offered his. But there was a problem. Byron Perkins was in jail awaiting a court sentencing date. Arrangements were made to allow him out to donate his kidneys to his son.
He did not show up for the hospital. He ddn't go back to the jail. He is now on the run with his girlfriend, Lee Ann Howard, who is also a felon, who is awaiting trial. Both are considered to be habitual offenders.
They are to be considered armed and dangerous.
Accoding to the court order that allowed for his release, if Perkins failed to live up to the court order, he would be arrested by U.S.Marshalls. They are looking for him now.
Before he left, he wrote a note to his mom saying he would be close and she wasn't to worry. And that he would come through for Destin someday.
