'Just noticed this proposal in the local news. Even though the BH trial isn't likely to be happening soon... I hope this rule will not be enacted causing a ban on media coverage.


More than 40 years after the state Supreme Court first allowed cameras in Kentucky courtrooms, a proposed rule would give judges the power to restrict or ban them in ways that the Kentucky Press Association says would “harm transparency.“
The revision, which the high court proposed and could enact at any time, would prohibit video or still coverage of any witness who objects in writing or on the record before testifying.

Would audio still be allowed?

The statue of limitation may have run out for charges to be brought regarding the sale of the firearm. The statue for most federal crimes would be five years. Using a false name or falsifying the ATF form when purchasing a firearm would be a federal crime. I would assume falsifying the seller name would be the same crime.
I don't think we know when it was sold. Do we? Otherwise, it seems that the state would have already tested it.

Also, regarding the recording of the GJ testimony, according to the link above at Court TV, their expert says he expects charges for those family members.

I don't know. I'll have to take a look into that proposal again (in the morning when I'm awake)... I might have to make myself a note to remember.

He is charged with conspiracy to commit murder and tampering with physical evidence.
He was scheduled to have a pre-trial hearing in Nelson County Circuit Court on Thursday, but Judge Charles C. Simms III has pushed that date back to Jan. 5, 2024.

Oh, I think we're all a bit biased when it comes to HDV. Good luck finding a judge who treats it casually, Mr. Brooks.

The judge would have the ability to ban both. (The proposal is confusing given the current laws. And, I think it would have to jump through more hoops to actually be considered/passed so I'm not worried... yet. imo)


Currently, judges have discretion to allow the media or the public to record audio or video in courtrooms during open proceedings such as trials, and to set rules for how recording can be done. Judges can also restrict certain things from being recorded, such as the faces of jurors.

The proposed rule is different, in that it would require the media organization or member of the public to seek a court order from the judge. A court order is formal, and would require an attorney to file a motion for the order and to appear in court.

BARDSTOWN, Ky. — Brooks Houck, the man charged with murder in the death of his girlfriend, Crystal Rogers, wants to disqualify the judge in his case.

Houck’s attorneys, Brian Butler and Michael Denbow filed an affidavit on Tuesday, Oct. 24 to remove Nelson Circuit Court Judge Charles Simms from the case claiming he’s biased against Houck.

The document claims there are numerous demonstrations of bias against Houck. The affidavit says, “Judge Simm’s behavior with regard to Mr. Houck is such that his ‘impartiality might reasonably be questioned from the perspective of a reasonable observer who is informed of all the surrounding facts and circumstances.’”

The document also points to Houck’s $10 million cash bond, calling it “grossly excessive” and attorneys saying it points to Simm’s inability to be impartial.

Houck entered a not guilty plea at his arraignment on Oct. 5. He is scheduled to be back in court in Feb. 2024.

If he was arrested first, I think I read that, Houk's goose is cooked! I'm sure he'll flip and tell all for a deal.

Crystal Rogers case | Kentucky Supreme Court weighs in on Brooks Houck's request to remove judge



LOUISVILLE, Ky. — Brooks Houck, the man charged with murder in the disappearance of his former girlfriend Crystal Rogers, wants a new judge on his case.

His attorneys claim Nelson County Judge Charles Simms shows bias toward Houck through current and former court proceedings. On Thursday, Kentucky Supreme Court Chief Justice Laurence B. VanMeter weighed in on the request.

According to court documents filed Wednesday, the Chief Justice is remanding the defense attorneys’ request to dismiss Judge Simms, and instead insisting they file a new motion in court asking the judge to take himself off the case.

All I know is - Lawson has a pretrial hearing on 1/5/24 & Houck on 2/8/24
