Houck for Crystal Rogers former

boyfriend and the main suspect in her

death has filed an appeal on his murder

conviction.

His attorneys point to him being denied

a new trial and the judge not recusing

himself from this case. Houck's attorney

also mentioned his trial being

consolidated with Joseph Lawson. Court

documents say the appeal is being taken

to the Kentucky Supreme Court. Houck is

serving a sentence of life in prison for

the 2015 murder of Rogers, his former

girlfriend.

Brooks Houck files official appeal of conviction in Crystal Rogers murder case​


The notice, filed in Nelson Circuit Court and dated Monday, Oct. 6, stated Houck's intention to take his appeal of the entire case to the Kentucky Supreme Court.

LOUISVILLE, Ky. (WAVE) - Brooks Houck’s attorneys have filed an appeal to the Kentucky Supreme Court asking that his conviction for the murder of Crystal Rogers be overturned.

The appeal filed by Houck’s attorneys cites what they believe to be several mistakes that should be reason for the conviction to be thrown out, including:

The Commonwealth not being able to prove that Rogers was murdered
Where the murder occurred
No physical evidence was provided to link Houck to the crime

“The Commonwealth offered no evidence of how the alleged murder was committed, presented no evidence of a murder scene, and could not even identify the venue of the alleged murder, the Special Prosecutor candidly admitting “I don’t know where she was murdered!” None of the types of evidence that has been relied on to support a conviction in the absence of direct evidence of a murder -- a confession, evidence of violence between the missing person and the defendant -- was presented here," the introduction of the appeal states.

Additional reasons cited in the appeal include a claim that potential jurors had prior knowledge of Steve Lawson being found guilty of his charges weeks before Houck’s trial started, the combining of Joseph Lawson’s trial with Houck’s, and Judge Charles Simms refusal to recuse himself from the case.

The appeal closes by stating that Houck’s attorneys believe that the listed errors should lead to his acquittal, however if the court does not agree, he should be given a new trial.
