Murder trial date vacated, waits on Ky Supreme Court

The trial was postponed due to a motion filed on behalf of Miller to preclude the death penalty because he was under 21 when he was charged with the murder. There is a pending case out of Fayette County that is expected to be heard by the Kentucky Supreme Court by the end of the year to determine whether its constitutional to sentence someone to death who was under age 21 at the time of the alleged crime.

A new trial date was scheduled to begin Feb. 18.
