Shayna Hubers murdered Ryan Poston – but she doesn't deserve to spend life in prison for it, a Campbell County jury decided Friday afternoon.

The jury recommended 40 years in prison, with credit for the time she has served so far.

Hubers, 24, of Lexington would be eligible for parole in 20 years.


Hubers will be formally sentenced in the coming weeks by Circuit Judge Fred A. Stine, who presided over the trial and has handled the case from the beginning.

But Commonwealth's Attorney Michelle Snodgrass argued for life in prison.

Sharon Hubers testified about her daughter's long list of academic and civic achievements as a honor student, athlete and vocalist. Shayna Hubers is exceptionally smart, graduating 🤬🤬🤬 laude with a degree in psychology from the University of Kentucky five months before the shooting.

Defense attorney David Mejia had asked the jury to take her character and clean record into account, arguing 20 years in prison would give her the chance to rehabilitate herself.

NEWPORT – The trial took nine days, but it took a Campbell County jury just under five hours to find Shayna Hubers guilty of murder.

The graduate student shot her boyfriend, attorney Ryan Poston, six times in the dining room of his Highland Heights condominium the night of Friday, Oct. 12, 2012.

Sentencing is scheduled for 10 a.m. Friday. The Poston and Carter families released a joint statement to The Enquirer early Friday morning via spokesman Pat Crowley.

This case is an outstanding example of our justice system at work.

Unlike some others.

Wow. Just wow. Way to go, jurors! Oh, and kudos to the judge for the no nonsense approach. It is a shining example of what should happen in all US courtrooms! Granted, some judges are blessed with defiant, contemptible defendants and even worse defense attorneys, but any judge worth their salt will quickly reign in the bullcarpery.

How in the world can they rectify Murder One with a chance of parole in 20 years? I am sickened but not surprised.

I am so so so so so sick of the injustices done for victims if their murderer happens to be a female and that includes females who murder their own children or when they sexually assault someone.

I hope the Judge looks at this case through a clear lens and will change it to the just verdict of LWOP.

This has to be devastating for his family and friends who love him. She murdered him in cold blood and then mocked her victim. Another psychopath like Arias that deserves to be locked up forever.

I remember some of our posters right here who have said they are bi-polar but also said it doesn't make them want to murder someone.:( I respect them so for their honesty.

Why is it today so many parents only care how many community activities their children are in and how smart they are? Do they think they will develop a good character all by themselves?

I don't think she will get paroled the first time around. Probably not even her second time. What I don't like about the sentencing process is the credit for time already served. If that means first parole hearing could happen in 17 years, then she might be out in 20-25. It's not likely she will get parole even then but just the possibility being there is unnerving. Especially since we don't know what prison population numbers will be by then--overcrowding sometimes gets parole granted sooner than it would be granted otherwise.

It's only a recommendation at this point. Hopefully the judge will make some adjustments. It's hard to have hope anymore though, given some of the carp we've seen go down in our courts of law.

I agree. A chance of parole after 20 years for what she did is lenient------- but perhaps the jurors didn't know that when they recommended 40 yrs. Maybe they thought 40 yrs meant 40 yrs.

Hope Jodi doesn't trash her new condo when she gets wind of this.

Somebody mentioned this earlier, but I knew she was a cold blooded murderer as soon as I heard that the poor guy even picked up crazy eyes and carried her outside to try and make her leave. I just wish he didn't have so much patience and allowed her to come back in...

I hope she doesn't get parole after 20 years either, but if the judge sticks with the recommendation I bet she does. At least by the 2nd time. Which will suck. I want her to stay in jail for the rest of her life.

Another similarity between this and the TA/JA relationship was the lack of follow through on the part of the man in the relationship re: truly ending a relationship. Both men wanted to break up, but would continue to have sexual encounters with the woman. I don't get that. Women in general put a lot of stock in sexual intimacy. I get that for men it is often just sex, but it would behoove them to understand that many women take sex to mean real intimacy. A woman who is wired like that is someone to stay away from if the man does not wish to have an emotional relationship. It in no way gives the woman the right to kill the man, of course. But men who are involved with women who care way more than they do should not be surprised when the woman continues to stay emotionally invested if the man doesn't also break off the sexual relationship.

I've never understood how TA could complain so much about Jodi stalking him, yet he would still engage in sex with her. And Ryan Poston claimed to be afraid of Shayna, yet would still allow her to stay over. Imagine how these mixed messages would be construed by a mentally ill, narcissistic, and/or borderline personality disordered woman. Maybe the men thought they were doing the women a favor by not completely rejecting them, but that was the worst possible tactic in dealing with these psychopaths. I guess the guys truly didn't realize who they were dealing with and how dangerous these women were.

Very sad.

In this case, just the fact of SH saying she gave him "the nose job he always wanted" would have convinced me as a juror that this lady needs to be kept away from civilized society forever. She will always be a menace. Her mugshot is actually horrifying.

On Tuesday – just four days after her two-week trial concluded – Hubers' attorneys filed a motion in Campbell Circuit Court seeking a new trial.<snip>

The trial began April 13.
On April 23, a jury of 12 men and women rejected Hubers' self-defense claim and convicted her of murder after hearing hours of testimony over nine days. They heard from 40 witnesses and saw more than 100 items entered into evidence.
On several occasions, Stine dismissed court or sent the jury on a break in order to confer with the attorneys and consider evidentiary matters. More than once, a witness took the stand only to be dismissed without giving any testimony.
The jury deliberated for five hours the night of April 23 before convicting Hubers of murder rather than a lesser charge, such as manslaughter.
The following day, April 24, the jury recommended Hubers serve 40 years in prison. She would be eligible for parole in 20 years. Mejia had sought 20 years, while Snodgrass had sought life in prison.

But 4 days after her conviction-she hasn't even been sentenced yet! Is this the fastest appeal ever?
