A jilted lover on trial for shooting her boyfriend in the face claims she killed him in self defense after their abusive relationship broke down.

Shayna Hubers is accused of 'cackling' as she shot attorney Ryan Poston six times just before he was due to meet Miss Ohio 2012 Audrey Bolte for a date.

The 27-year-old testified at her trial on Thursday she killed him in his penthouse in Cleveland on October 12, 2012, because she 'feared him'.

That was soon after he demanded she talk 25 per cent less, get a hobby, and have threesomes with him and other women if they were to get back together.

Hubers recounted how they went on their first date on her 20th birthday in April 2011 after meeting on Facebook months earlier.

She said even then she was rattled by his physicality and how forward he was and called a taxi from the bathroom of a bar to get away.

Hubers: Commonwealth cross examining Thomas Schacht. In a questionnaire Hubers said she had never faked an illness for sympathy. The Commonwealth says this is contrary to what she did when she told Poston she had heart problems when she did not. @WCPO

A neighbor of Ryan Poston testified Friday that Shayna Hubers once came to her door crying with a red mark on her arm.

Nikki Carns said Hubers told her she was thrown out of Poston's apartment without her purse in the summer of 2012.

Carns also said Hubers would send Carns texts asking if Poston's car was at his Highland Heights condominium.

Carns read a September text message from Poston at the request of Campbell County Prosecutor Michelle Snodgrass.

“She said he was probably at the bar and she wanted to make sure he wasn’t cheating on her,” Carns said about the text.

Prosecutor Michelle Snodgrass asked Carns to read another part of the text verbatim.

“He’s such a loser,” Hubers said in the text. “I swear to God he doesn’t have a job. LOL.”

Thomas Schacht, a licensed psychologist in Tennessee, also took the stand for the defense on Friday.

Schacht said He believes Hubers has borderline personality disorder, a disorder characterized by unstable behavior and moods.

Hubers was probably exhibiting signs of borderline personality disorder and complex post-traumatic stress disorder when she shot Poston, Schacht testified.

He said she was also probably showing signs of secondary sexual abuse trauma and sexual dysfunction, which showed up in her text messages.

Shayna Hubers' defense team rested Friday after days spent arguing her Oct. 12, 2012 shooting of boyfriend Ryan Poston was a consequence of long-running physical abuse and psychological trauma -- not, as the prosecution argued, a consequence of an obsessive personality unable to process rejection.

Psychologist Dr. Thomas Schact, the defense's final witness, testified Hubers was under extreme mental stress the night she shot Poston to death.

Schact interviewed Hubers for 37 hours over a six-day period and talked to her parents for seven hours at their Lexington home to get an idea of the conditions in which she grew up. He also reviewed Hubers' medical records dating back to childhood.

It sounds like they both had issues.

I will never understand why they both did not go to the police if their relationship was that bad.

Not sure what other issues he had, other than trying to get rid of her.

I don't understand if she is claiming Ryan abused her why didn't she report it. Why didn't she have any injuries on her person. Shayna stayed with Ryan for 18 months and as far as I know there was not 1 report of abuse of domestic violence. Sounds a lot like Jodi Arias. jmo

Hubers: Commonwealth asks Birkenhauer to show the bra Hubers was wearing on the night of the shooting. She claims Ryan Poston picked her up more than once by the bra to throw her. The bra is perfectly intact and the night of the shooting Hubers had no injuries. @WCPO

Different experts have shared vastly different opinions of Shayna Hubers' mental health during her murder retrial.

Dr. Dustin Boyd Wygant, a rebuttal witness for the prosecution, disagreed with the defense psychologist’s diagnosis of PTSD when he testified in Hubers’ murder retrial Monday. He said that while Hubers has a borderline personality disorder, she does not have post-traumatic stress disorder.

Wygant interviewed Hubers for 15 hours in May and concluded she knew what she was doing during the 911 call and her videotaped statement to police. He said he didn't believe Hubers showed any dissociation.

"She was able to recall how she felt during the shooting and shortly thereafter," Wygant said. "She was able to provide some connection to what Mr. Poston might have been feeling, that he was suffering and she would end his life because of that."

Psychologist: Hubers has borderline personality disorder, not PTSD
