DeSoto Grand Jury to Hear Case Against Brian Horn Wednesday

March 10, 2021
A DeSoto Parish Grand Jury takes up the first degree murder case against Brian Horn today. He is on death row at Angola for the 2010 murder of 12-year-old Justin Bloxom of Stonewall. But Horn's previous conviction was overturned by the State Supreme Court.

During the initial trial, Horn's attorney admitted in front of the jury that his client had killed young boy. But appeals attorneys for Horn say that admission went against Horn's wishes. And because of the U.S. Supreme Court ruling in the McCoy v Louisiana case, The high court ruled in that case that such concessions from an attorney during a trial violate a defendant's right to counsel.

The attorney was trying to get the jury to find him guilty of the lesser crime of 2nd degree murder. But that strategy did not work.

DeSoto District Attorney Charles Adams will be presenting the evidence against Horn to the grand jury. In Horn's original trial, he was convicted of first degree murder and sentenced to death.

The D.A.is again pushing for the death penalty in this case.

*Grand Jury Hearing (@ am ET) - LA – Justin McClain Bloxom (12) (Mar. 30, 2010, Stonewall; abducted & murdered) – *Brian Douglas Horn (34 @ time of crime/43/now 45) arrested & charged (3/31/10), arraigned (1/3/12) & indicted (6/17/19) with 1st degree murder & 2nd degree kidnapping. Plead not guilty. DA seeks DP.
Suspect texted Justin pretending to be a 15-yr old girl.

Trial started 3/18/14, jurors reached a verdict on 4/2/14. Took the jurors about 45 minutes to reach guilty verdict; received the death sentence in May, 2014. Conviction was overturned 9/7/18. 9/7/18: The U.S. Supreme court said Friday that Horn's rights were violated when his lawyer conceded at the 2014 1st degree murder trial that Horn killed Justin in DeSoto Parish. Horn disagreed with that strategy & made it known to the district judge before & during the trial, the ruling said.
6/15/19 Update: Pros have filed an amended bill of indictment. Horn with 1st degree murder, while attempting to carry out a 2nd degree kidnapping; original indictment included aggravated kidnapping. Horn plead not guilty. Pros & defense agree jury will come from another jurisdiction. Judge McCartney gave both sides 15 days to offer suggestions. Defense filed a motion seeking to re-litigate the entire case. Judge McCartney denied their request. Gave attorneys until 7/1 to decide if they will appeal. Set Aug. 1 date for next status hearing.

This is all I could find when searching for this case. I know no one here can access the LA court site - but just in case anyone sees "when" his next hearing is for a new trial - please post! TIA! :)

Louisiana vs. Horn:

Defendant Brian Horn was indicted by a grand jury for the first-degree murder of 12-year-old Justin Bloxom. Following the close of evidence at trial, a jury unanimously found defendant guilty as charged and, at the conclusion of the penalty phase of the trial, recommended the death sentence. In his appeal to the Louisiana Supreme Court, defendant raised seventy assignments of error. Finding merit only in defendant’s assignment of error asserting a violation of his Sixth Amendment right to counsel, the Court vacated defendant’s conviction and sentence and remanded this matter to the district court for a new trial.

Sorry the top is cut off and part of the bottom. I screenshot it so I didn't have to pay for it through work. I found this on the Desoto Parish Clerk of Court website. It's an Indictment. At the bottom it is signed by the jury foreperson.

The jury deliberated for less than 30 minutes before finding David Neil McFarlin, 57, guilty of second-degree rape. He was remanded into the custody of the sheriff’s office.


He faces five to 40 years when sentenced on Sept. 2.

McFarlin was arrested in August 2019 for raping a woman in a Bossier City tavern.

That was only part of the article. This guy is the same guy that owned the taxi company that was released from liability of Justin’s lawsuit.
