Is that an ADT (Security sign) in Irwin yard. WTH what "Kidnapper" would target that house??? Just saying.:banghead:

Someone who knew the house was no longer being monitored (if, in fact, it wasn't). Good catch!

ETA: Just saw someone reply that the sign is in a neighbor's yard. Still, good catch on your part to spot it and wonder! ;)
 
From what's been said by both parents and LE, I don't see the, someone going into the home during a garage sale, as plausible.

If that had happened I think both parents would have said so from the beginning, it would be huge.

No none of these people are playing God's role.

Yes we should hold one another accountable for our actions, but we should also look at our own lives and shortcomings before pointing them out in others. I am truly not meaning any harm here, I just get bothered by so many people that are ready to burn these parents at the stake! Without truly knowing for sure if they have harmed their daughter LISA!

I'm judging the hell out of her for that, and I don't feel the least bit bad about it. The same way I don't feel bad about judging drunk drivers.

I'm on the fence about DB harming Lisa, I'm not on the fence that Lisa deserves better from DB, every single day of the week.

That is the neighbor's house...I thought it was theirs awhile back too when the dad was sitting there...the Irwin's house has rock on the bottom half...

OMG! Great find! Now I wonder, if the teen neighbor knew the alarm code, not just the garage one?

Nevermind! It was the next door neighbor's house.
 
I've read plenty of search warrants. The "entire house" does cut it in this case because it is all considered a crime scene. I think you are confusing the description of the premises to be searched with the probable cause needed to search it as well as the items to be seized. These are all separate sections of a search warrant.

couldn't agree with you more there! even when i never had kids i never got into that state. if she had said she had 1 or 2 glasses i don't think everyone would have been so shocked but enough to blackout jeez

MyBelle - every case is different. I'm not saying you are wrong. If the search warrants were written in such a way as to include the entire house or other area, it would be okay. The point is that LE has to have some reasonable belief that searching the entire house is necessay. That's all.

Using this case as an example - the search warrant could be written to look for the 3 cell phones because LE has the phone and ping records and they may believe there is information on the cell phones that would help them look for Baby Lisa. The cell phones are small and could be hidden in any nook or cranny, inside or outside. So LE would probably ask for wide latitude to search in any area that might hold a cell phone.

And everything is relative - for a case with a missing person/homicide/violent crime, the 'reasonable certainty' threshold is probably (I don't know, I don't work in law enforcement) a bit less than what is needed to search for stolen goods or whatever.

My understanding was that we were discussing search warrants in general and what it takes to get one and what can be searched after the warrant is received.

No, I was discussing this case specifically. The entire house is a crime scene and the case still unsolved. All that is needed is a description of the property to be searched. The probable cause to search it has to be listed separately as does what they hope to find.

I work in a prison. I don't believe anyone in it has been wrongfully convicted and they are youth, not adults so their cases have been closely monitored as far as due process.

I am not In da Middle and I do not live in the area but if I may.. In reading In da Middle's posts of her perspective or living in the area and knowing and speaking with many of the ppl living in and around baby Lisa's home and the areas surrounding that have been the focus of much search.. I do not believe that she has in any way whatsoever expressed anything saying that people are angry and disgusted with it and to hell with baby Lisa and finding her.. Infact I've heard the total opposite that these neighbors and surrounding community that are within the scope of the searches are wanting desperately for this child to be found.. They care very deeply and in no way are expressing any negative feelings toward baby Lisa or finding baby Lisa..

What In da middle has taken time to kindly share with all of us is the "real perspective" of those living this up close and personal.. And in "real" that means telling it like it is.. Of course there are feelings of inconvenience and frustration as it does affect peoples daily lives, but they are not expressing frustration directed at baby Lisa AT ALL IN ANYWAY, nor blaming baby Lisa for the inconvenience that some aspects are causing.. But rather In da middle is saying that this neighborhood is willing to deal with all of this for baby Lisa and UNTIL BABY LISA IS FOUND.. that's a very realistic and true account of peoples lives while living this current unfortunate situation..

Thanks to In da Middle for sharing what details you have with us of living in this area at this time..

And I, in no way am attempting to speak for In da middle, but rather just my opinion on the details she shares with us about the ongoing case of baby Lisa from the unique perspective of living there.. Jmo, tho!!
 
being frustrated does not mean they want the whole shebang to pack up and go home, being frustrated means that they wish to be treated with common courtesy. they want their neighbor found but in the meantime they have lives and jobs to tend to as well. the main complaint i have heard is not against LE but against the media. there does not need to be 20 identical vans shining spotlights at all hours into uninvolved peoples houses, leaving cigarette butts and trash in lawns and further blocking an already dangerous intersection.

OIC....the local media?? Thanks...
 
For real???? OMG!! What if LE found baby Lisa today or something that is significant... all the defense has to say is they had no right to be in the home - and throw the evidence out of the court room....

Whether or not they found Lisa today, which they didnt, they would have every right to search that home. The warrant said so. You cannot throw the judges warrant out, what judge is going to do that, its a legal and binding document.
